The Failure Of The Rule Of Law In Cyberspace: Reorienting The Normative Debate On Borders And Territorial Sovereignty, H. Brian Holland Aug 2005

The Failure Of The Rule Of Law In Cyberspace: Reorienting The Normative Debate On Borders And Territorial Sovereignty, H. Brian Holland

Faculty Scholarship

The ultimate goal of this article is to suggest a different perspective on the issue of extraterritorial regulation in cyberspace.

Between 1996 and 2002, over the course of several law review articles, professors David R. Johnson, David Post, and Jack L. Goldsmith engaged in a highly influential debate addressing the significance and legitimacy of physical, geographically-defined borders and territorial sovereignty in the regulation of cyberspace. At bottom, it was a contest between internal or indigenous regulation and the imposition of existing external regimes. At its heart lay two overarching areas of disagreement: First, descriptively, whether and to what extent the …

Shifts In Policy And Power: Calculating The Consequences Of Increased Prosecutorial Power And Reduced Judicial Authority In Post 9/11 America, Chris Mcneil Aug 2005

Shifts In Policy And Power: Calculating The Consequences Of Increased Prosecutorial Power And Reduced Judicial Authority In Post 9/11 America, Chris Mcneil

ExpressO

Among many responses to the attacks of September 11, 2001, Congress and the states have shifted to the executive branch certain powers once held by the judicial branch. This article considers the impact of transferring judicial powers to prosecutorial officers, and compares the consequent increased powers of the prosecutor with those powers traditionally held by prosecutors in Japanese criminal courts. It considers the impact of removing from public view and judicial oversight many prosecutorial functions, drawing comparisons between the largely opaque Japanese prosecutorial roles and those roles now assumed in immigration and anti-terrorism laws, noting the need for safeguards not …

How High School Science-Related Experiences Influenced Career Persistence, Andrew Dwight Shaw Aug 2005

How High School Science-Related Experiences Influenced Career Persistence, Andrew Dwight Shaw

Dissertations

The events of 9/11 brought into focus two ongoing trends that were present before this tragedy and have continued since: 1) The United States needs more scientists if it is to ensure its freedoms and maintain its economy. 2) The number of scientists in the ¿pipeline¿ is declining because of the diminished presence of foreign scientists (they are wanted in their own countries), the under-representation of minorities and women, and the reduced numbers of students able and willing to take on the scholastic rigors necessary for a science or engineering degree. Though much has been written about improving science education, …

Lost In Translation: The Economic Analysis Of Law In The United States And Europe, Kenneth G. Dau-Schmidt Aug 2005

Lost In Translation: The Economic Analysis Of Law In The United States And Europe, Kenneth G. Dau-Schmidt

ExpressO

In this essay, we examine the reasons why the economic analysis of law has not flourished in European countries as it has in the U.S. In particular, we focus on three European countries - the United Kingdom (U.K.), Germany, and France. We argue that differences in culture, the legal system and the academy have led to differing degrees of success of the law and economics movement in each country. We speculate that, although there is currently less interest in the economic analysis of the law in Europe than in the United States, European interest could dramatically increase if scholars adopt …

Sall, Gilda, Bronx African American History Project Aug 2005

Sall, Gilda, Bronx African American History Project

Oral Histories

Gilda Sall, originally from Harlem, moved to the Soundview section of the Bronx with her mother at the age of six. Unhappy with the education that her daughter was receiving in Harlem, Sall’s mother moved to the city’s northernmost borough, which many still considered to be almost suburban at the time. Sall tells of her first impressions of the Bronx as clean, different from the city from where she came, and overall a beautiful community in which to live.

After attending P.S. 77 and M.S. 123, Sall participated in the College Bound program at Monroe High School, a special subsection …

Business Process Outsourcing: An Exploratory Study, David Johnson Aug 2005

Business Process Outsourcing: An Exploratory Study, David Johnson

LSU New Orleans Theses and Dissertations

This study examines the emergence of Business Process Outsourcing (BPO) in white collar occupations. Recent BPO practices are compared to the offshore outsourcing of production in the context of the shift from Fordist to flexible production. The study considers BPO in light of Harry Braverman's theory of work degradation and whether or not BPO extends the traditional division of labor between conception and execution to higher skilled white collar occupations. An exploratory qualitative approach comprised of informant interviews, a focus group, and literature review was used to analyze how BPO occurs, why it happens, and where it takes place. I …

Social Economic Strategies In Recent Economics, John B. Davis Aug 2005

Social Economic Strategies In Recent Economics, John B. Davis

Economics Faculty Research and Publications

This paper reviews three distinct strategies in recent economics for using the concept of social identity in the explanation of individual behavior: Akerlof and Kranton’s neoclassical approach, Sen’s commitment approach, and Kirman et al.’s complexity approach. The primary focus is the multiple selves problem and the difficulties associated with failing to explain social identity and personal identity together. The argument of the paper is that too narrow a scope for reflexivity in individual decisionmaking renders the problem intractable, but that enlarging this scope makes it possible to explain personal and social identity together in connection with an individual behavior …

Neil Gaiman's American Gods: An Outsider's Critique Of American Culture, Mark Hill Aug 2005

Neil Gaiman's American Gods: An Outsider's Critique Of American Culture, Mark Hill

LSU New Orleans Theses and Dissertations

In 2001, Neil Gaiman published American Gods, a novel of American life and mythology. As a British author living in the United States, Gaiman has a powerful vantage point from which to critique American culture, landscape, and ideology. Rich with re-invented deities, legends, mythic creatures, and folk heroes cast in a decidedly American mold, American Gods examines the American character, evaluating the myths and beliefs of the culture from the vantage point of an outsider. By examining the character's allegiance to particular cultural legacies (Wednesday as the American con artist, Shadow as the cowboy), I intend to assess this outsider's …

A Study Of Student Use Of An Online Message Board In An Introductory Physics Class, Wenjuan Song Aug 2005

A Study Of Student Use Of An Online Message Board In An Introductory Physics Class, Wenjuan Song

Theses and Dissertations

With the rapid development of the Internet, increasingly universities and colleges transfer some of their teaching assignments online. Online learning plays an important role in assisting or sometimes substituting for the traditional face-toace learning. An online message board is one of several online communication tools which are used to assist online learning. We have conducted a study on the role of the online message board in teaching one of these courses, an introductory course in calculus-based physics. The study analyzed students? use of the message board and investigated whether use is correlated with performance in the class. Results suggest that …

Gender-Based Education: The Pilot Year Of Single-Gender Classes At A Public Elementary School, Myra Bryant Gillis Aug 2005

Gender-Based Education: The Pilot Year Of Single-Gender Classes At A Public Elementary School, Myra Bryant Gillis

Theses and Dissertations

The No Child Left Behind Act of 2001 requires public schools to be highly accountable for dollars spent on education and for the achievement of students. To support this mandate, the law expanded local control and allowed schools to explore innovative ways to enhance student learning (U.S.D.E., 2004). Given the opportunity, some public schools have experimented with single-gender classes as an avenue for improving the way students are taught. Studies have indicated that separating students according to gender has a positive impact on learning (e.g., Haag, 2000; Maslen, 2001; and Sommers, 2001). Single-gender settings have also been reported to have …
