Above Contempt?: Regulating Government Overreaching In Terrorism Cases, Peter Margulies
Law Faculty Scholarship
Prosecutors face the continual temptation to overreach in decisions about the control of information. At each phase of a criminal proceeding, from investigation through trial, prosecutors make crucial decisions about information to disclose and highlight with courts, juries, and the public. In ordinary times, courts, defense counsel, the media, and internal sources of oversight can place some constraints, however tenuous, on the prosecutor’s efforts to monopolize the management of information. However, external events, such as the attacks of September 11, 2001, can weaken these constraints, producing alarming spikes in prosecutorial power.

From Lavender To Purple: Privacy, Black Women, And Feminist Legal Theory, Jennifer C. Nash
Cardozo Journal of Equal Rights & Social Justice
The article critiques traditional feminist legal theory for its narrow view of privacy as inherently oppressive, particularly for women of color. It argues that privacy can be a source of empowerment and safety for Black women, challenging the one-size-fits-all approach of mainstream feminist theory. The author advocates for a more nuanced, intersectional perspective that considers how privacy affects different groups differently.

You have the right to have as many children as you desire. You can have seven like the Waltons, six like the Brady Bunch, or none at all like Oprah. It is all left to your discretion-unless you fail to pay child support, and as a result end up facing criminal charges. The United States Constitution protects the right to freedom in procreation decisions. Generally, this means that the government cannot interfere with such decisions unless it has a compelling reason to do so. Even then, such interference must be narrowly tailored to meet government interests.

Regionalism, or interlocal cooperation, is an important consideration for elected officials in the Bluegrass Area Development District. The reasons to join in a partnership and the suspected outcome are of great concern to the judge-executives and mayors but also to the communities they serve. In order to assist elected officials in their decision-making capacities, this study was designed to primarily analyze what factors lead to success in regional projects within the Bluegrass ADD. A secondary consideration was to look at when and why local governments enter into regional efforts.

First Responders On The Front Line: Measuring The Effect Of Mobilization On Emergency Services, Kate Pringle

Statement of Problem
National guardsmen are a unique human resource issue because their association with the guard is frequently part-time with another position, such as a State Trooper, acting as primary employment. When mobilized, the guardsman leaves an opening in their department, which must be available upon return. This can create operational and management stresses, especially if the guardsman has unique skills. Moreover, the loss of personnel can mean critical loss of manpower to small emergency service departments.

A Property Rights Approach To Sacred Sites Cases: Asserting A Place For Indians As Nonowners, Kristen A. Carpenter

Although the Free Exercise Clause prohibits governmental interference with religion, American Indians have been unsuccessful in challenging government actions that harm tribal sacred sites located on federal public lands. The First Amendment dimensions of these cases have been well studied by scholars, but this Article contends that it is also important to analyze them through a property law lens. Indeed, the Supreme Court has treated the federal government's ownership of public lands as a basis for denying Indian religious freedoms claims.
