The State Of American Federalism, 2004: Is Federalism Still A Core Value?, Dale Krane, Heidi Koenig

Federalism as a political issue was conspicuously absent from the 2004 presidential contest. Unlike many previous campaigns, neither party’s candidate made much mention of problems besetting states and localities. The war against global terrorism and the changing situation in Iraq shaped the election. Progress was made on homeland security, but intergovernmental wrangling over federal grants continued unabated. Federal-state feuds were common in several policy areas, including education, environmental protection, and health care. State finances received a revenue boost as economic growth picked up, but rising costs for Medicaid, education, employee pensions, and prisons clouded states’ financial forecasts. Proper stormwater management acknowledges both water quantity and water quality. Historically, stormwater quantity and quality have been separately considered; runoff was routed as quickly as possible into the nearest body of water. Although this alleviates potential flooding concerns, water quality is often compromised. Common stormwater quality problems include gross pollutants, sediment, nutrients, and heavy metals. The chronic elevated presence of these pollutants is detrimental to the environment. As a result, the government has passed legislature to protect waterways. The passage of the National Pollution Discharge Elimination System (NPDES) permit requires that municipalities implement stormwater treatment techniques, known as Best Management …

Who Needs Freedom Of Religion?, James W. Nickel

This article proposes that we view freedom of religion as a specific application area of more general basic liberties such as freedoms of thought, expression, association, assembly, movement, privacy, political participation, and economic activity. Separate enumeration of freedom of religion in national and international bills of rights may be useful, but it is not indispensable. In this respect freedom of religion is more like scientific freedom or artistic freedom than like freedom of expression. Recognizing that separate enumeration of freedom of religion is dispensable has salutary consequences for how we conceive and justify freedom as it applies to religion. First, …

In response to domestic violence involving victims who do not wish to cooperate in the prosecution of their abuser, prosecutors endeavor to frame cases around other evidence establishing a defendant’s guilt regardless of the victim’s testimony. Domestic violence cases set for trial are being thrown out of Texas courts because of the recent U.S. Supreme Court ruling that reasserts a defendant’s right to confront his accuser in court. Prosecutors believe that strong legal arguments exist to continue successfully prosecuting abusers without the cooperation of the victim at trial. Even though the availability of AEDs have increased significantly since they first came to existence and people can identify the importance of implementing an AED program to increase the survival rate of cardiac arrest victims, AEDs are not being used on the vast majority of people experiencing out-of-hospital cardiac arrest. New Orleans’ voters elected Sidney Barthelemy as the city’s second African American mayor in 1986. Historical treatments of Barthelemy’s tenure generally do not hold him in the same high regard as New Orleans’ first African American mayor, Ernest Morial. Yet, unfavorable evaluations of Barthelemy reflect the maturation of African American politics in the Crescent City. Symbolic victories no longer resonate with an African American populous in need of substantive gains to redress longstanding social and economic inequities. Too little attention has been given to the gender-differentiated effects of natural disasters, that is, women’s losses relative to men’s, how women’s work time and conditions change (both in terms of care-giving and income-generating work), or how disaster-related aid and entitlement programs include or marginalize affected women. The detailed case studies from three earthquake-stricken areas in India and Turkey that are contained in this issue of SEEDS help fill this information gap. In response to increased annual wildfire destruction and insufficient wildfire mitigation approaches from the federal government, the state of California adopted Public Resources Code Sections 4290 and 4291 in the year 1991. These laws force the removal of fire-causing agents from public and private areas, and establish what is known as defensible space. Defensible space is defined in Section 4291 as the area within the perimeter of a parcel, development, neighborhood, or community where basic wildland fire protection practices and measures are implemented, providing the key point of defense from an approaching wildfire or escaping structure fire. Sexual assault disproportionately affects female college students, more so than any other group of women in the general population. Therefore, consideration for the safety needs of this particular group of women constitute a great concern for university administrators. Safety measures currently utilized at universities for decreasing sexual assault rates have been insufficient. Some researchers have turned their attention to the role of campus sexual assault policies as a means in which to alleviate this crisis.
