What You Can't Have Won't Hurt You - The Real Safety Objective Of The Firearms Safety And Consumer Protection Act, Dennis B. Wilson

Cleveland State Law Review

This article examines an aspect of the debate described above. It begins by describing the federal firearms safety regulation that does exist and explaining the reason that there is relatively little federal firearms safety regulation. It will then examine one legislative proposal to subject firearms to federal safety regulation, the Firearms Safety and Consumer Protection Act of 2003 (Firearms Safety Act) and compare it with the law that has been applied to seek to ensure the safety of other consumer products for over thirty years, the Consumer Product Safety Act (CPSA). That comparison will demonstrate that the genuine objective of …

Article 9 Of The Constitution Of Japan And The Use Of Procedural And Substantive Heuristics For Consensus, Mark A. Chinen

Michigan Journal of International Law

This Article’s purpose is to examine the revision debates through the lens of recent scholarship on constitutional decisionmaking to see what lessons might be drawn about constitutionalism in Japan and elsewhere. In Part I, the author discusses Article 9's text and interpretation and focus on three controversies: first, Japan's ability to use force to defend itself and the related issue of the constitutionality of the Japan Self Defense Force (SDF); second, Japan's ability to engage in collective self-defense, which impacts the state's security relationship with the United States under the U.S.-Japan Mutual Security Agreement; and finally, Japan's ability to participate …

Repudiating Morals Legislation: Rendering The Constitutional Right To Privacy Obsolete, Sonu Bedi Jan 2005

Repudiating Morals Legislation: Rendering The Constitutional Right To Privacy Obsolete, Sonu Bedi

Cleveland State Law Review

This article is set out in three parts. Part II outlines the difficulties with the right to privacy. Part III articulates the relationship between morals legislation and privacy, demonstrating that we no longer need the latter as long as the state eschews the former. Part IV argues that the Court in Lawrence articulates a new standard of rational review where specific appeal to morality is constitutionally suspect, allowing us to reject the right to privacy

Lawson Edward Thomas And Miami's Negro Municipal Court, Ernesto Longa Jan 2005

Lawson Edward Thomas And Miami's Negro Municipal Court, Ernesto Longa

St. Thomas Law Review

Lawson Edward Thomas, born in 1898 in Ocala, Florida, was both Miami's first black judge and the first black judge in the South since reconstruction. The municipal court Thomas presided over was located within Miami's Black Police Precinct and handled only cases involving black defendants arrested by black patrolmen. In other words, in 1950, Miami established a municipal court on purely racial lines. Amazingly, considerable research has not revealed a single scholarly article written about Miami's all-black court; Marvin Dunn's Black Miami in the Twentieth Century contains only four sentences on L.E. Thomas. Even Miami-Dade County's "local court historian" seems …

When Specialty Designs Cause Building Disasters: Responsibility For Shared Architectural And Engineering Services, Carl J. Circo Jan 2005

When Specialty Designs Cause Building Disasters: Responsibility For Shared Architectural And Engineering Services, Carl J. Circo

Nebraska Law Review

This article examines the development, current legal status, and long-range legal implications of shared design. Of special interest is the practice of assigning significant responsibility for specialty design to those who have no direct contractual relationship with the owner of the project or the owner's primary design professional. Part II examines how specialty design-build fits into the context of established design and construction contract structures. Part III explores the contract and tort theories that govern the liability of project participants for design errors and defects and that will guide courts, arbitrators, and construction lawyers who face the shared design conundrum. …
