Some Yemeni Ideas About Human Rights, Sheila Carapico Jan 2005

Some Yemeni Ideas About Human Rights, Sheila Carapico

Political Science Faculty Publications

Yemeni intellectuals voiced human rights concerns throughout the twentieth century. Of course, as elsewhere, the early incarnations of a human rights movement in this most populous corner of Arabia did not use the term huquq al-insan (human rights), popularized only in the 1990s. Moreover, the emphasis was consistently on limiting arbitrary governance and justice. Still, Yemenis tackled issues such as social equality, popular participation, judicial autonomy, due process, prison conditions, and intellectual freedom, among others. This chapter explores how a fragmented yet tenacious intellectual movement grounded in indigenous political culture produced writings intended to breach authoritarianism for over half a …

Performance Management In Local Law Enforcement Agencies, Jason Vibbart Jan 2005

Performance Management In Local Law Enforcement Agencies, Jason Vibbart

Senior Honors Theses and Projects

Over the past twenty years, nothing has affected the way we structure, operate, and manage organizations more than the performance management movement. Performance management is a form of management in which an organization seeks to maximize its productivity by instituting a system of measures by which to gauge performance levels of each element of the organization. The aim of performance management is to achieve the goals of the organization as effectively and efficiently as possible. In the age of budget cuts that we live in today, performance management is being used more and more to help organizations effectively meet their …

Should Antitrust Education Be Mandatory (For Law School Administrators)?, Thom Lambert, Royce De R. Barondes Jan 2005

Should Antitrust Education Be Mandatory (For Law School Administrators)?, Thom Lambert, Royce De R. Barondes

Faculty Publications

The purpose of this essay is merely to examine the pertinent antitrust issues. The essay proceeds on the assumption that the AALS policy, whose terms are precatory, speaks to what is in fact an agreement among law schools. As noted below, the policy itself contemplates that law school deans will seek waivers, in individual cases, extending the time periods for up to two months. Were the policy to be litigated, law schools might dispute the existence of an agreement. We believe, though, that the nature of the policy strongly suggests that it represents an agreement among law schools and that …

State Sentencing Policy And New Prison Admissions, Ben L. Trachtenberg Jan 2005

State Sentencing Policy And New Prison Admissions, Ben L. Trachtenberg

Faculty Publications

As the academy's focus has turned to sentencing in the wake of Blakely v. Washington and United States v. Booker, most commentators have continued their benign neglect of actual sentencing practices as they occur in state courts, not to mention whether and how such policies are effective in achieving the goals of criminal justice. This note examines trends in state sentencing policies and prison populations from the perspective of a would-be state reformer hoping to decrease her state's prison budget. Economic pressures, efficiency arguments, and social justice claims have combined to cause some states to desire lower prison populations, but few …

A New Circularly Polarized Rectenna For Wireless Power Transmission And Data Communication, Mohammod Ali, G. Yang, Roger A. Dougal Jan 2005

A New Circularly Polarized Rectenna For Wireless Power Transmission And Data Communication, Mohammod Ali, G. Yang, Roger A. Dougal

Faculty Publications

Small distributed wireless sensors are becoming very important in many aspects of our lives. While low data rate passive sensors operate with little energy there is a need for moderate to high data rate distributed sensors for infrastructure monitoring and other applications. Such sensors will require their batteries or onboard capacitors to be charged when depleted for proper operation. In this letter, we propose a circularly polarized (CP) microstrip patch antenna that can function as a WLAN antenna in the 5.15-5.35 GHz and as a rectenna at 5.5 GHz.

Minnesota: Leading The Way On Canadian Prescription Medicine Importation, Kevin Goodno, Karen Janisch Jan 2005

Minnesota: Leading The Way On Canadian Prescription Medicine Importation, Kevin Goodno, Karen Janisch

William Mitchell Law Review

In the United States, about $160 billion is spent on prescription medicines each year, with Minnesotans spending about $3 billion. The costs of prescription medicines receive so much attention in large part because, although prescription medicine costs constitute only 10.5% of total health care spending, they account for 23% of the total out-of-pocket costs that people incur when purchasing health care. Minnesota has been a leader in controlling prescription medicine costs. It has aggressively used purchasing pools when possible, and encouraged the use of lower cost, generic prescription medicines when appropriate. Even with these efforts to control costs, prescription medicines …

Fighting Epidemics With Information And Laws: The Case Of Sars In China (Book Review), Vincent R. Johnson, Brian T. Bagley

Faculty Articles

In Chinese Law on SARS, Chenglin Liu recounts the tale of China’s efforts to cope with the recent SARS epidemic. The outbreak of SARS coincided with the full session of the 10th National People’s Congress, which elected a new Central Government in response to governmental failures in dealing with the crisis. The new government’s “proactive” approach to addressing the epidemic was to enact new legislation, republish an important law, and issue authoritative interpretations of existing criminal law provisions.

Liu offers a savvy analysis of why China’s centralized framework initially impeded the fight against SARS, and discusses the new government’s decisions …

Back To Bakke: Defining The Strict Scrutiny Test For Affirmative Action Policies Aimed At Achieving Diversity In The Classroom, Leslie Yalof Garfield

Elisabeth Haub School of Law Faculty Publications

This Article will identify the new strict scrutiny test, and will consider the reason for creating a separate definition of strict scrutiny for evaluating affirmative action policies that achieve diversity in the classroom. Part II of the Article will review constitutional challenges to affirmative action policies prior to Grutter and Gratz, and will discuss the split in the circuits that resulted from the Court's failure to endorse Justice Powell's definition of a compelling governmental interest in Bakke. Part III will provide an analysis of the Grutter and Gratz decisions, with a particular focus on each Court's discussion of the strict …
