The Billable Hours Derby: Empirical Data On The Problems And Pressure Point, Susan Saab Fortney Jan 2005

The Billable Hours Derby: Empirical Data On The Problems And Pressure Point, Susan Saab Fortney

Fordham Urban Law Journal

This Article addresses the frustration with billable hours in large law firms. The Author gathered empirical data to gauge the short and long-term effects of increases in billable hour expectations. An empirical study was conducted in 1999-2000 of associate satisfaction, law firm culture, and billing practices. The Article compares these findings to a 2005 NALP study on billable hours and a Work-Life split. The Article concludes by considering what forces and players will change the current course of conduct in which law firm leaders treat increases in billable hours expectations as a necessary evil. The studies show the costs and …

How Law Firms Can Do Good While Doing Well (And The Answer Is Not Pro Bono), Russell Pearce Jan 2005

How Law Firms Can Do Good While Doing Well (And The Answer Is Not Pro Bono), Russell Pearce

Fordham Urban Law Journal

This Essay looks at whether large law firm business lawyers can do good in today’s society. The author describes the change in the large law firm mentality since the 1960s – most specifically the shift to a focus centered solely on making money. The Article looks at the changes in the legal profession that facilitated this shift. The author proposes that instead of trying to separate making money and doing well, the legal profession should try to integrate the two. The Essay proposes specific suggestions to accomplish this goal, including the creation of a new Model Rule that would restore …

Toxicity and its detection in the dinoflagellate fish predators Pfiesteria piscicida and Pfiesteria shumwayae depend on the strain and the use of reliable assays. Two assays, standardized fish bioassays (SFBs) with juvenile fish and fish microassays (FMAs) with larval fish, were compared for their utility to detect toxic Pfiesteria. The comparison included strains with confirmed toxicity, negative controls (noninducible Pfiesteria strains and a related nontoxic cryptoperidiniopsoid dinoflagellate), and P. shumwayae strain CCMP2089, which previously had been reported as nontoxic. SFBs, standardized by using toxic Pfiesteria (coupled with tests confirming Pfiesteria toxin) and conditions conducive to toxicity expression, reliably detected …

Parental Responsibility Statutes: An Organization And Policy Implications, Eve M. Brank, Stephanie Carsten Kucera, Stephanie A. Hays

Department of Psychology: Faculty Publications

We find ourselves at a confusing time in the history of juvenile justice. As a nation, we are transferring children into an adult system at a greater rate than we have ever seen before. Public response urges that juveniles be locked away not only to punish them, but also to keep the public safe. The public views these delinquent children as a threat and something to fear. Legislators respond to the public fear with more liberal transfer options into the adult system and punitive juvenile sanctions within the juvenile system. If a juvenile escapes transfer into the adult system, then …

In The Shadow Of Delaware - The Rise Of Hostile Takeovers In Japan, Curtis J. Milhaupt Jan 2005

In The Shadow Of Delaware - The Rise Of Hostile Takeovers In Japan, Curtis J. Milhaupt

Faculty Scholarship

Despite longstanding predictions to the contrary, hostile takeovers have arrived in Japan. This Essay explains why and explores the implications of this phenomenon, not only for Japanese corporate governance, but also for our understanding of corporate law development around the world today. Delaware law figures prominently in the recent Japanese events. A highprofile battle for corporate control has just generated a judicial standard for takeover defenses that might be called a Unocal rule with Japanese characteristics. Meanwhile, ministy-endorsed takeover guidelines have been formulated that are heavily influenced by the familiar "threat" and "proportionality" tests under Delaware law, along with many …

Watchdog Or Demagogue? The Media In The Chinese Legal System, Benjamin L. Liebman Jan 2005

Watchdog Or Demagogue? The Media In The Chinese Legal System, Benjamin L. Liebman

Faculty Scholarship

Over the past decade, the Chinese media have emerged as among the most influential actors in the Chinese legal system. As media commercialization and increased editorial discretion have combined with growing attention to social and legal problems, the media have gained incentives to expand their traditional mouthpiece roles in new directions. As a result, the media have emerged as one of the most effective and important avenues of citizen redress. Their role in the legal system, however, has also brought them increasingly into conflict with China's courts.

This Article examines the implications of the media's roles in the Chinese legal …

Seeing Crime And Punishment Through A Sociological Lens: Contributions, Practices, And The Future, Calvin Morill, John Hagan, Bernard E. Harcourt, Tracey L. Meares Jan 2005

Seeing Crime And Punishment Through A Sociological Lens: Contributions, Practices, And The Future, Calvin Morill, John Hagan, Bernard E. Harcourt, Tracey L. Meares

Faculty Scholarship

There is a rich intellectual history to the sociological study of crime and punishment that encompasses multiple and interrelated traditions. Some of these traditions trace their roots to the European social theorists of the nineteenth century, particularly Emile Durkheim, Max Weber, and Karl Marx. Although only Durkheim and Weber systematically studied law (and only Durkheim actually studied punishment), all three social theorists facilitated the development of sociological research and theory on crime and punishment. Durkheim's Suicide: A Study in Sociology for example, investigated the relationship between social integration and suicide rates, which, in turn, provided a model of inquiry for …

Spectral Imaging Using A Commercial Colour-Filter Array Digital Camera, Roy Berns, Lawrence Taplin, Mahdi Nezamabadi Jan 2005

Spectral Imaging Using A Commercial Colour-Filter Array Digital Camera, Roy Berns, Lawrence Taplin, Mahdi Nezamabadi

Articles

A multi-year research programme is underway to develop and deliver spectral-based digital cameras for imaging cultural heritage at the National Gallery of Art, Washington DC, and the Museum of Modern Art, New York. The cameras will be used for documentation, production imaging, and conservation science. Three approaches have undergone testing: a liquid-crystal tunable filter (LCTF) coupled with a monochrome camera, a six-position filter wheel containing absorption filters coupled with a monochrome camera, and a two-position filter slider containing absorption filters coupled with a colour-filter array (CFA) colour camera. The last approach is the most practical as it uses conventional digital …

Evaluation Of A Modified Sinar 54m Digital Camera At The National Gallery Of Art, Washington Dc During April, 2005, Roy Berns, Lawrence Taplin

Articles

On April 26 – 27 2005, the RIT team brought their prototype Sinar 54M camera system to the National Gallery of Art’s Imaging Department. The team included Lawrence Taplin, Mitchell Rosen, and Roy Berns. RIT brought a spectroradiometer to measure the daylight fluorescent viewing illumination and if time allowed, NGA’s CRT display. They also brought a Macintosh G5 to control the camera and for image processing. NGA is using a production Sinar 54M. This enabled a direct comparison between NGA’s digital imaging workflow and the RIT workflow. Both cameras used the same lighting, Broncolor pulsed Xenon, lighting geometry, and photography …

Solving An Mri Spin Relaxometry Problem With Parallel Computing, Alan Kaminsky, Luke Mcomber Jan 2005

Solving An Mri Spin Relaxometry Problem With Parallel Computing, Alan Kaminsky, Luke Mcomber

Articles

MRI spin relaxometry is the process of recovering the spin density spectrum from the time samples of the spin signal for each pixel of a magnetic resonance image. Since healthy tissue exhibits different spin relaxation rates from diseased tissue, MRI spin relaxometry potentially has utility for diagnosing disease. However, recovering the spin relaxation rates involves solving an inverse problem which requires substantial computation. The computation's running time can be reduced by processing the pixels in parallel on a parallel computer. A parallel program for solving the MRI spin relaxometry problem, SRSolve, was implemented in Java with MPI, its running time …

A Simulation Of Composite Dispatching Rules, Conwip And Push Lot Release In Semiconductor Fabrication, Nizar Bahaji, Michael Kuhl Jan 2005

A Simulation Of Composite Dispatching Rules, Conwip And Push Lot Release In Semiconductor Fabrication, Nizar Bahaji, Michael Kuhl

Articles

This paper evaluates dispatching rules and order release policies in two fabs representing two wafer fabrication modes, namely, ASIC and low-mix high-volume production. Order release policies were fixed-interval (push) release, and constant work-in-process, CONWIP (pull) policy. Following rigorous fab modeling and statistical analysis, new composite dispatching rules were found to be robust for system cycle time and due-date adherence measures, in both production modes.

Integral Field Spectroscopy Of 23 Spiral Bulges, Dan Batcheldor, David J. Axon, David Merritt, M. A. Hughes, A. Marconi, J. Binney, A. Capetti, M. Merrifield, C. Scarlata, W. Sparks

Articles

We have obtained Integral Field Spectroscopy for 23 spiral bulges using INTEGRAL on the William Herschel Telescope and SPIRAL on the Anglo-Australian Telescope. This is the first 2D survey directed solely at the bulges of spiral galaxies. Eleven galaxies of the sample do not have previous measurements of the stellar velocity dispersion([sigma]*) . These data are designed to complement our Space Telescope Imaging Spectrograph program for estimating black hole masses in the range 10[to the 6th power] −10[to the 8th power] M⊙ using gas kinematics from nucleated disks. These observations will serve to derive the stellar dynamical bulge properties using …

Articles

The Advanced Camera for Surveys (ACS) Virgo Cluster Survey is a large program to image 100 early-type Virgo galaxies using the F475W and F850LP bandpasses of theWide Field Channel of the ACS instrument on the Hubble Space Telescope (HST). The scientific goals of this survey include an exploration of the three-dimensional structure of the Virgo Cluster and a critical examination of the usefulness of the globular cluster luminosity function as a distance indicator. Both of these issues require accurate distances for the full sample of 100 program galaxies. In this paper, we describe our data reduction procedures and examine the …

We investigate the central regions of 23 spiral galaxies using archival NICMOS imaging and STIS spectroscopy. The sample is taken from our program to determine the masses of central massive black holes (MBH) in 54 nearby spiral galaxies. Stars are likely to contribute significantly to any dynamical central mass concentration that we find in our MBH program and this paper is part of a series to investigate the nuclear properties of these galaxies. We use the Nuker law to fit surface brightness profiles, derived from the NICMOS images, to look for nuclear star clusters and find possible extended sources in …

Geometric Modeling Of Engineered Abrasive Processes, Andres L. Carrano, James B. Taylor Jan 2005

Geometric Modeling Of Engineered Abrasive Processes, Andres L. Carrano, James B. Taylor

Articles

One of the common issues that arises in abrasive machining is the inconsistency of the surface roughness within the same batch and under identical machining conditions. Recent advances in engineered abrasives have allowed replacement of the random arrangement of minerals on conventional belts with precisely shaped structures uniformly cast directly onto a backing material. This allows for abrasive belts that are more deterministic in shape, size, distribution, orientation, and composition. A computer model based on known tooling geometry was developed to approximate the asymptotic surface profile that was achievable under specific loading conditions. Outputs included the theoretical surface parameters, R^sub …

Another Ingredient Contributing To Recent Audit Failures: A Study Providing Insights On Management Integrity, Bruce Oliver

Articles

Integrity is evidenced through behavior. It is evidenced by actions an individual's consistent observation of a code of conduct based upon a coherent set of moral (ethical) or artistic values. It suggests such a high level of trustworthiness that it is difficult to conceive of a person being false to a trust. In an audit, beginning with evaluating of the reliability of a client's accounting control systems, the auditor relies heavily on the perceived integrity of management. Thus management integrity has the potential to significantly influence the nature and scope of the independent audit. Decision-making is influenced by personal beliefs …
