The Middle Passage: Migration And Displacement Of Sri Lankan Tamil Women Of The Diaspora, Sivamohan Sumathi Jan 2005

The Middle Passage: Migration And Displacement Of Sri Lankan Tamil Women Of The Diaspora, Sivamohan Sumathi

Socio-Legal Review

The article attempts to grapple with the different facets of marginalisation produced by a specific type of Diasporic activity - as women, as Sri Lankan Tamils, and as participations that must negotiate a process that is at once transnational and postcolonial. Through the examination of different cultural modes of expression, novels, stories, and pamphlets, it attempts to answer as to how the Sri Lankan Tamil woman, away-from-home, makes sense of her world and how she sees it vis-a-vis her 'homeland.' Though displaccement itself contains the libertatory potential, is this 'truth' of a better world often distorted by the indirect and …

Migration And Home Gardens In The Brahmaputra Valley, Assam, India, Rahul J. Shrivastava, Joel T. Heinen Jan 2005

Migration And Home Gardens In The Brahmaputra Valley, Assam, India, Rahul J. Shrivastava, Joel T. Heinen

Journal of Ecological Anthropology

The Brahmaputra is the largest river system in northeast India. Its valley, in the State of Assam, is home to the Assamese people, indigenous Mishing and Karbi tribes, and Kaziranga National Park. A spectacular array of wildlife shares the floodplain including the endangered Asian elephant, tiger, one-horned rhinoceros and wild buffalo. The fertile floodplain and tea estates have attracted immigrants from within India and from neighboring countries. Migration has been linked to Assam's high population density and agriculture expansion. Based on household surveys in 37 villages in the park's periphery, we compared home garden productivity and economic return among residents …

Liberty Versus Property? Cracks In The Foundations Of Copyright Law, Richard A. Epstein Jan 2005

Liberty Versus Property? Cracks In The Foundations Of Copyright Law, Richard A. Epstein

Faculty Articles

Many modern intellectual property scholars have argued that the creation of patents and copyrights, for inventions and writings, respectively, should be resisted on the grounds that these forms of property necessarily infringe ordinary forms of liberty, in contrast to property that is found in tangible things. This article rejects that claim by showing how property conflicts with liberty in both settings, but that the different configurations of rights observed in these various areas is defensible on the grounds that the loss of liberty for all persons is, to the extent that human institutions can make it, compensated by the increased …

Which Judges Write Their Opinions (And Should We Care)?, Stephen J. Choi, G. Mitu Gulati Jan 2005

Which Judges Write Their Opinions (And Should We Care)?, Stephen J. Choi, G. Mitu Gulati

Faculty Articles

Common wisdom holds that many federal judges do not write their own opinions. While their degree of input into opinion writing varies, almost all rely to some extent on law clerks, typically recent law school graduates, to research and draft substantial sections of the opinion. Why should we care which judges write their opinions? We posit that determining the actual input of federal judges into the authorship of opinions provides useful information in a number of contexts, including judicial promotion decisions, the allocation of scarce judicial resources, and the judicial clerkship market for law students. We start with generic tests …

Thinking Like A Lawyer, Peggy C. Davis, Aderson Belgard Francois Jan 2005

Thinking Like A Lawyer, Peggy C. Davis, Aderson Belgard Francois

Faculty Articles

In this article the authors explain what it means to train lawyers for intellectual versatility. The authors then describe, and attempt to explain, the resistance this kind of training can engender. Next, they draw on post-realist legal thought to explain why training for intellectual versatility is necessary to capable and responsible legal practice. The authors conclude with suggestions about how continued engagement with the work of Carol Gilligan can deepen their analysis of why training for intellectual versatility is resisted, and why it is nonetheless profoundly important.

The Ali Principles On Transnational Intellectual Property Disputes: Why Invite Conflicts?, Rochelle C. Dreyfuss Jan 2005

The Ali Principles On Transnational Intellectual Property Disputes: Why Invite Conflicts?, Rochelle C. Dreyfuss

Faculty Articles

As those members of the innovation community who focus on procedural law know, the American Law Institute (ALI) is engaged in a project to facilitate litigation of intellectual property disputes that cross national borders. The enterprise owes its origins to the 1999 Draft of the Convention on Jurisdiction in Civil and Commercial Matters, negotiated at the Hague Conference on Private International Law. By now, it has undergone several iterations. Columbia University Professor Jane Ginsburg and I used the Hague material as the starting point for proposing a stand-alone convention dealing not only with the general problems of international litigation, but …

Nomadismos Lingüisticos Y Culturales En Yo-Yo Boing De Giannina Braschi (Linguistic And Cultural Monadisms In 'Yo-Yo Boing' By Giannina Braschi), Laura R. Loustau

World Languages and Cultures Faculty Articles and Research

Keynote Address: Law And Politics In The Canadian Constitutional Tradition, Michael Ignatieff Jan 2005

Keynote Address: Law And Politics In The Canadian Constitutional Tradition, Michael Ignatieff

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

Once again we are approaching one of those moments in Canada in which constitutional law becomes central to our politics. The fundamental cost of the current political crisis is its impact on the national unity of our country. Whenever the next election comes it might result in the failure of any of the federal parties to secure national representation in all our regions, particularly in Quebec. Professor Ignatieff takes issue with those who believe that politics does not need ideas and those who would avoid constitutional discussion. He believes the challenge to federalism should be met head on saying that …

Educational Interpreting: Access And Outcomes, Marc Marschark, Patricia Sapere, Carol Convertino, Rosemarie Seewagen

Articles

This chapter argues that the assumption that mainstream education—supported by sign language interpreting—can provide deaf students with fair and appropriate public education may be unfounded. It describes research that emphasizes the need to understand better the complex personal and functional interactions of students, instructors, interpreters, and settings if educational interpreting—and interpreted education— is to be optimally beneficial for deaf students.

The Head-Modifier Principle And Multilingual Term Extraction, Andrew R. Hippisley, David Cheng, Khurshid Ahmad Jan 2005

The Head-Modifier Principle And Multilingual Term Extraction, Andrew R. Hippisley, David Cheng, Khurshid Ahmad

Linguistics Faculty Publications

Advances in Language Engineering may be dependent on theoretical principles originating from linguistics since both share a common object of enquiry, natural language structures. We outline an approach to term extraction that rests on theoretical claims about the structure of words. We use the structural properties of compound words to specifically elicit the sets of terms defined by type hierarchies such as hyponymy and meronymy. The theoretical claims revolve around the head-modifier principle which determines the formation of a major class of compounds. Significantly it has been suggested that the principle operates in languages other than English. To demonstrate the …

Does The Discourse Of Employer Linked Charter Schools Signal A Commitment To Work Force Development Or Transformational Learning?, Eric Freeman, Richard D. Lakes Jan 2005

Does The Discourse Of Employer Linked Charter Schools Signal A Commitment To Work Force Development Or Transformational Learning?, Eric Freeman, Richard D. Lakes

Mid-Western Educational Researcher

The latest model for educational reform emerging in the US vocational-technical delivery system is the employer linked charter school (ELCS). This emerging concept is viewed as a partnership between constituents in the regular school organization and employers who are directly involved in the school’s design, governance, and delivery of learning to students. The incursion of neo-liberalism into educational politics, policy, and discourse has permitted educational experiments such as the ELCS to link skills training to corporate imperatives of building enterprise culture and entrepreneurial attitudes in direct opposition to liberal humanist values and culture.

Charter schools in general and an ELCS …

The Turkish Foreign Aid Program: A Helping Hand Or A Snake Infested Olive Branch, Aisha T Bigbee Jan 2005

The Turkish Foreign Aid Program: A Helping Hand Or A Snake Infested Olive Branch, Aisha T Bigbee

UNLV Retrospective Theses & Dissertations

Turkey's long-standing struggle to fulfill the ideas of Kemalism has led to a long-standing dedication to help "heal" an ailing region and its often acting as an intermediate between Western powers and the Middle East. Turkey is at the strategic meeting point of Asia, Europe, and the Middle East. Turkey has a unique blend of secular democracy and Islamic society that makes it a vital asset to both the West and Islamist radicalism. As a result, Turkey's foreign aid program was developed in the last decade to primarily focus on the objectives of fostering a stable platform in Central Asia, …

"We Insist! Freedom Now": Does Contract Doctrine Have Anything Consitutional To Say?, Hila Keren Jan 2005

"We Insist! Freedom Now": Does Contract Doctrine Have Anything Consitutional To Say?, Hila Keren

Michigan Journal of Race and Law

This Article first exposes the detachment between contract doctrine and the scattered antidiscrimination norms and analyzes the harmful consequences of this detachment. It then creates an original meeting point between the two bodies of law, one of which is intentionally located within contract doctrine. This point is found by dismantling the dominant concept of "freedom OF contact", and especially by defining and establishing the freedom to make a contract.

Introduction To G.E. Moore's Principia Ethica, G. Scott Davis Jan 2005

Introduction To G.E. Moore's Principia Ethica, G. Scott Davis

Religious Studies Faculty Publications

When Principia Ethica appeared, in 1903, it became something of a sacred text for the Cambridge-educated elites-Lytton Strachey, Leonard Woolf, John Maynard Keynes-who, along with Virginia Woolf, would form the core of the Bloomsbury Group. In a letter of October 11, 1903, Strachey confesses to Moore that he is "carried away" by Principia, which inaugurates, for him, "the beginning of the Age of Reason." Moore's critique of convention, his caustic dismissal of his philosophical predecessors, and the relentless rigor of his method promised a revolution in morality commensurate with the modernist transformation of art and literature. Principia Ethica shifted …

Assessing The Accuracy Of The Differential Assessment Of Autism And Other Developmental Disorders (Daadd) As A Screening Tool, Christine Jurgens Jan 2005

Assessing The Accuracy Of The Differential Assessment Of Autism And Other Developmental Disorders (Daadd) As A Screening Tool, Christine Jurgens

Masters Theses

Professionals are encountering children with developmental disorders more often and with more diversity than ever before. Disorder labels are being introduced increasingly early in a child's life in order to qualify them for services. However, characteristics of developmental disorders overlap significantly in young children, with features beginning to differentiate as the child enters formal education at kindergarten age. Debate continues on whether the autistic spectrum is being over-diagnosed, based on increasing incidence and prevalence statistics.

Research has suggested that developmental disorders impact multiple developmental areas, including language, socialization, sensory, motor, and medical/physical aspects and skills. Therefore, distinguishing one developmental disorder …

An Assessment Of Speech-Language Pathologists, ' Special Educators, ' And Elementary Teachers' Language Knowledge Related To Reading Instruction, Jessica Catto Jan 2005

An Assessment Of Speech-Language Pathologists, ' Special Educators, ' And Elementary Teachers' Language Knowledge Related To Reading Instruction, Jessica Catto

Masters Theses

An assessment was designed from Louisa Cook Moats' (1996, 2000) research and questions to assess the knowledge of elementary education teachers (grades 1-3), special education teachers, and speech language pathologists in regard to several areas of reading instruction including phonemic awareness, phonics, and vocabulary/morphology.

Subjects consisted of a total of 57 educational professionals, 19 subjects in each group. Results revealed that speech-language pathologists scored significantly higher on the phonemic awareness portion of the assessment as well as total test score, when compared with elementary and special education teachers. Mean scores on the total test ranged from 78-89% accuracy. Mean scores …

Bringing Her Fist Down On That Wholeness: Rewriting Gendered Narratives In Zoeìˆ Wicomb's Fiction, Rachel Heicher

Masters Theses

This thesis situates South African writer Zoë Wicomb's fictional work within a critical context of current feminist theory, exploring Wicomb's response to a central problem for poststructuralist feminism-how can we deconstruct femininity while simultaneously conserving a platform for feminist political activism; how can we assert. on the one hand, that there are no "women", and then, on the other, continue to campaign on behalf of "women's" rights? Wicomb's two novels to date, You Can't Get Lost in Cape Town (1987) and David's Story (2000) serve as test studies for a model of gender that fluctuates and purposefully and constructively embodies …
