Deconstructing Davis V. United States: Intention And Meaning In Ambiguous Requests For Counsel, David Aram Kaiser, Paul Lufkin Jan 2005

Deconstructing Davis V. United States: Intention And Meaning In Ambiguous Requests For Counsel, David Aram Kaiser, Paul Lufkin

UC Law Constitutional Quarterly

The authors discuss the United States Supreme Court's decision in Davis v. United States, 512 U.S. 452 (1994), arguing that its holding-that police officers do not have to cease questioning a criminal suspect who utters an ambiguous request for counsel during custodial interrogation-depends on concepts of interpretation that have been discredited by the deconstructionist theory of Jacques Derrida and subsequent literary critics.

Derrida criticized theoretical movements, such as structuralism, that ignored the role of ambiguity in language. In turn, reacting to Derrida's emphasis on the indeterminacy of meaning, other literary critics sought criteria for "objective" interpretation, the search for which …

Pomona Faculty Publications and Research

Statistics is a wonderfully diverse profession and graduate students making career choices have many options — especially in light of the dearth of students moving into the statistical sciences today. The three main career paths at the PhD level are in academics, industry/business and government. Each of these job types offers its own mix of intellectual challenges, financial reward, pressure and security. How a new researcher selects (or is selected by) a specific occupation in the statistical sciences sometimes seems more a function of luck than of conscious decision making. This consideration was one of the first concerns addressed by …

Leveraging One-Class Svm And Semantic Analysis To Detect Anomalous Content, Ozgur Yilmazel, Svetlana Symonenko, Niranjan Balasubramanian, Elizabeth D. Liddy

School of Information Studies - Faculty Scholarship

Experiments were conducted to test several hypotheses on methods for improving document classification for the malicious insider threat problem within the Intelligence Community. Bag-of-words (BOW) representations of documents were compared to Natural Language Processing (NLP) based representations in both the typical and one-class classification problems using the Support Vector Machine algorithm. Results show that the NLP features significantly improved classifier performance over the BOW approach both in terms of precision and recall, while using many fewer features. The one-class algorithm using NLP features demonstrated robustness when tested on new domains.

Analyst-Focused Arabic Information Retrieval, Robert N. Oddy, Ann R. Diekema, Jean Hannouche, Elizabeth Liddy, Grant Ingersoll

School of Information Studies - Faculty Scholarship

An English-Arabic Cross-Language Information Retrieval Environment was created in which the analyst can query an Arabic database in English and retrieve a set of relevant Arabic documents. The retrieved Arabic documents are automatically translated into English to facilitate readability by the English-only analyst. Proper names of people, places, and organizations are extracted from the retrieved documents and transliterated from Arabic into English. They are presented to the analyst and serve to provide a brief summarization of the retrieved document search query in English. Cross-Language Information Retrieval (CLIR), itself a desideratum in the ARDA workshop, is a special case of Information …

Measure For Measure: Modeling Entrepreneurial Self-Efficacy Onto Instrumental Tasks Within The New Venture Creation Process, Jill Kickul, Robert S. D'Intino Jan 2005

Measure For Measure: Modeling Entrepreneurial Self-Efficacy Onto Instrumental Tasks Within The New Venture Creation Process, Jill Kickul, Robert S. D'Intino

New England Journal of Entrepreneurship

We examine the various components of entrepreneurial self-efficacy within the entrepreneurship literature from a measurement perspective. Two published entrepreneurial self-efficacy instruments are tested and compared. Additionally, we study how self-efficacy relates with many of the tasks and roles identified within the entrepreneurial new venture life-cycle. Our study suggests relationships between self-efficacy, perceived skills, and abilities to manage a new venture, and entrepreneurial intentions to start a new venture. We discuss relationships between entrepreneurship research and university teaching and make specific suggestions on how further work on improving measurement in entrepreneurship will benefit both research and teaching effectiveness.

Balance In Language Teaching And Learning: Honoring Tradition And Celebrating Innovation, Natalia Tsarikova Jan 2005

Balance In Language Teaching And Learning: Honoring Tradition And Celebrating Innovation, Natalia Tsarikova

MA TESOL Collection

This paper presents a study aimed at finding a flexible approach to teaching that is responsive to learner needs and preferences whilst at the same time utilizing communicative language teaching and form-focused instruction. In other words, the author aims to find a balance between CLT (learner centered approaches) advocated by many trainers and teachers in Uzbekistan and the Grammar Translation method (teacher centered approaches) that has been widely practiced as well. The author’s primary purpose is to find an approach which is centered principally on learning rather than on the teacher or the learner. The author maintains that teaching is …

It identifies and examines the major challenges that language teachers in Haiti will face in incorporating peer interaction within the Haitian public school context. It explains the advantages of using peer interaction as a way to generate knowledge. The author concludes by providing practical guidelines and strategies of how to cope with these challenges and describing what he has learned from his research.

Since language is learned mainly through interaction with other learners and speakers of that language, this paper aims at persuading Haitian language teachers …

A Framework For Teaching A Foreign Language Class Based On The Principles Of Chaos/Complexity Theory, Michael Kozden Jan 2005

A Framework For Teaching A Foreign Language Class Based On The Principles Of Chaos/Complexity Theory, Michael Kozden

MA TESOL Collection

Chaos/complexity theory first emerged in the study of the natural sciences over thirty years ago. Through the years, experts from a variety of fields have held this theory up as a new way in which to view the world around us, including its applications to the study of second language acquisition. The language classroom, like the natural world, can also be observed from this perspective because it exhibits many features of chaotic/complex systems. Language instruction in a classroom setting not only produces strange attractors and fractals, but is dynamic, complex, nonlinear, chaotic, self-organizing, unpredictable, sensitive to initial conditions, open, feedback …

Integrating Writing Within The Foreign Language Classroom: Shifting Dynamics, Not The Task, Patricia Ann Evans Jan 2005

Integrating Writing Within The Foreign Language Classroom: Shifting Dynamics, Not The Task, Patricia Ann Evans

MA TESOL Collection

This classroom based research project considers the following questions: Why should my foreign language students write? From Pedagogy to Purpose; what happens when students use technology with their writing; what transitions take place with regard to the role as teacher when integrating writing into the Spanish language classroom? This project follows the shift from writing , disconnected activities to writing. How a student-centered writing process and technology support the shift away from the perception that good writing is voiceless and mechanical. It traces the shift from learning to write to writing to learn. The project studies the shift that occurs …

Exploring The Teen Efl Classroom: The Students, Their Teachers, And The Tangles Of Dealing With Discipline And Motivation, Anna Burbridge Jan 2005

Exploring The Teen Efl Classroom: The Students, Their Teachers, And The Tangles Of Dealing With Discipline And Motivation, Anna Burbridge

MA TESOL Collection

This paper discusses specific elements of teaching teens in an EFL context, in particular the areas of teen motivation and discipline. This was a teacher’s development project involving six teachers (including the writer), and lasting for one semester in a Brazilian bi-national language institute. The project was built on videotaped class observations, readings, group meetings, and journal writings. The result was a deeper reflection into the developmental stage dubbed “teenhood”, followed by subsequent considerations of motivation and discipline of teen groups, the role of the teen teacher, the importance of knowing and connecting with the inner teacher, and practical implications …

Women In The Web Of Secondary Copyright Liability And Internet Filtering, Ann Bartow Jan 2005

Women In The Web Of Secondary Copyright Liability And Internet Filtering, Ann Bartow

Law Faculty Scholarship

This Essay suggests possible explanations for why there is not very much legal scholarship devoted to gender issues on the Internet; and it asserts that there is a powerful need for Internet legal theorists and activists to pay substantially more attention to the gender-based differences in communicative style and substance that have been imported from real space to cyberspace. Information portals, such as libraries and web logs, are "gendered" in ways that may not be facially apparent. Women are creating and experiencing social solidarity online in ways that male scholars and commentators do not seem to either recognize or deem …

Who Will Watch The Watchdogs?: International Human Rights Nongovernmental Organizations And The Case For Regulation, Robert C. Blitt

Scholarly Works

Human rights nongovernmental organizations (NGOs) have become a fixture within the international system and a driving force for creating and enforcing human rights norms at international law. This essay examines the growth of human rights NGOs and argues that the industry is in urgent need of formal regulation. After assessing the failure of informal market controls for ensuring accountability within the human rights NGO sector, this paper applies a law and economics consumer protection model to underscore the need for more formal regulation. However, rather than advance a case for government intervention, this paper proposes that human rights NGOs themselves …
