Czech Fiction? Kafka And History In Czech Literature, Zachary Macholz
Czech Fiction? Kafka And History In Czech Literature, Zachary Macholz
Independent Study Project (ISP) Collection
Much of Czech literature of the twentieth century leans heavily on the political and historical context of a given time period. This is not true of Franz Kafka, but his work is nonetheless reflective of many elements of Czech history after the turn of the century. This paper explores the role that Kafka’s The Trial and Czech political and social history plays in the formation of works of fiction and drama, and concludes that Czech authors Hašek, Hrabal, and Havel all deal explicitly with political and historical themes, and draw from Kafka, while the authors Škvorecky and Kundera are also …

Student Perspectives On Rubric-Referenced Assessment, Heidi L. Andrade, Ying Du
Educational & Counseling Psychology Faculty Scholarship
This study suggests that students use rubrics to support their own learning and academic performance. In focus groups, fourteen undergraduate students discussed the ways in which they used rubrics to plan an approach to an assignment, check their work, and guide or reflect on feedback from others. The students said that using rubrics helped them focus their efforts, produce work of higher quality, earn a better grade, and feel less anxious about an assignment. Their comments also revealed that most of the students tend not to read a rubric in its entirety, and that some may perceive of a rubric …

The Birth Of The Authornym: Authorship, Pseudonymity, And Trademark Law, Laura A. Heymann
The Birth Of The Authornym: Authorship, Pseudonymity, And Trademark Law, Laura A. Heymann
Notre Dame Law Review
Consumers in the marketplace of ideas are well acquainted with one aspect of the Foucauldian concept of the “author function”. the way in which an author's name serves to organize both producer inputs—the various works the author wishes to have associated with his name—and consumer inputs—the readers' interpretive reactions to any particular body of work. Indeed, choosing to write under a pseudonym or under one's true name is the way in which an author exerts control over this function by grouping certain works (for example, scholarly pieces) under one name and other works (for example, mystery novels) under a different …

Forsaking The Forests For The Trees: Forestry Law In Papua New Guinea Inhibits Indigenous Customary Ownership, Alyssa A. Vegter
Forsaking The Forests For The Trees: Forestry Law In Papua New Guinea Inhibits Indigenous Customary Ownership, Alyssa A. Vegter
Washington International Law Journal
Illegal logging in the tropical forests of Papua New Guinea is one of the greatest threats to the forests and indigenous people of this island nation. Increasing pressure from the commercial logging industry, legislation that restrains customary ownership, and an unclear legal basis for this ownership subjects the indigenous people of Papua New Guinea to unscrupulous, unsustainable, and illegal logging practices. As a region central to the preservation of global ecological and cultural diversity, the devastating consequences of illegal logging in Papua New Guinea have become nationally and internationally significant. Customary ownership of the forests by the indigenous clans of …

Review Of Caddo Verb Morphology By Lynette R. Melnar, David Rood
Review Of Caddo Verb Morphology By Lynette R. Melnar, David Rood
Great Plains Research: A Journal of Natural and Social Sciences (through 2013)
When I was a graduate student on the West Coast, we used to playa little game to make fun of East Coast formal linguistics by asking each other, "What would transformational grammar look like if Chomsky spoke X instead of English?" Obviously, if Caddo were X, the answer would not involve tree diagrams, phrase structures, or transformations. Things haven't changed very much. Faced with describing a language like Caddo, a linguist receives virtually no help from the massive literature on syntactic and morphological theory from the last forty or fifty years.

Review Of Enduring Legacies: Native American Treaties And Contemporary Controversies Edited By Bruce E. Johansen, Taiawagi Helton
Great Plains Research: A Journal of Natural and Social Sciences (through 2013)
Even casual observers know of disputes between Natives and non-Natives over governmental authority or natural resources. In the nearly forty years since tribes gained direct access to federal courts, they have been pursuing their rights with increasing fervor. With rare exceptions, those rights are declined in a treaty. Indeed. treaties provide the foundation for the hulk or the relationship between Tribal Nations and the United States and remain a vibrant source of tribal, international, and federal law. Nevertheless only a small fraction of the general public understands the text of these documents. Interpreting treaty language requires an understanding of the …

Crossing Borderlands: The Face Of Chicana Border Literature, Irene Ruiz
Crossing Borderlands: The Face Of Chicana Border Literature, Irene Ruiz
McNair Scholars Research Journal
Chicana literature details the trials and tribulations of Chicana life at the borderlands of the United States and Mexico. In particular it focuses on different challenges Chicana women face at the borderlands they must cross. While borderlands are usually represented as physical, many are not. Using Sandra Cisneros’ Women Hollering Creek, Denise Chavez’s Loving Pedro Infante, Maria Amparo Escandon’s Esperanza’s Box of Saints, and Alicia Gaspar de Alba’s, The Mystery of Survival, I will explore several common themes that relate to Chicana identity and the struggles that they must go through to overcome these barriers. I will examine the Chicana …
Against Dictionaries: Using Analogical Reasoning To Achieve A More Restrained Textualism, Jason Weinstein
Against Dictionaries: Using Analogical Reasoning To Achieve A More Restrained Textualism, Jason Weinstein
University of Michigan Journal of Law Reform
This Note argues that new textualists should abandon dictionaries as a source for legal interpretation. Textualists believe in restricting judges to the intent discernible from the words of a statute and contend that legislative history is unacceptable as a source of this intention. Both of these sentiments lead textualists to dictionaries as the intuitively correct solution for ambiguities in a text. The author argues, however, that dictionaries by their very nature cannot help discern between reasonable definitions at the margins of meaning. The use of dictionaries in these situations allows for a sham formalism, unrestrictive in result and unrevealing of …

The S-Aux-O-V-Other Syntagm In Atlantic, George Tucker Childs
The S-Aux-O-V-Other Syntagm In Atlantic, George Tucker Childs
Applied Linguistics Faculty Publications and Presentations
As the largest language phylum in the world and the most geographically widespread (Williamson & Blench 2000), Niger-Congo understandably exhibits some variation at all grammatical levels. Basic word order stands as no exception to this generalization, and there have been partisans for both an SOY and an SVO reconstructed word order. Gensler 1994 attempts to reconcile the two by claiming that neither proposal is correct; he suggests that both SOY and SVO are derived from Proto-Niger-Congo *S-AUX-O-V-Other. Because of the pattern's "quirkiness" (being found virtually nowhere else in the world) and because it is so widely attested in geographically widely …
