Legal Reform And Social Justice: An Introduction To Latcrit Theory, Praxis And Community, Francisco Valdes Jan 2005

Legal Reform And Social Justice: An Introduction To Latcrit Theory, Praxis And Community, Francisco Valdes

Articles

This article provides a general overview of LatCrit theory as a genre of contemporary critical legal scholarship. LatCrit theory self-consciously does not limit itself to law or to scholars: students, activists and other interested parties from various disciplines, backgrounds and regions, help to constitute LatCrit theory as a collective enterprise in every respect. The ties that bind this fluid group together are a shared commitment to antisubordination purpose and praxis. The article begins with a brief account of the jurisprudential context for the emergence of LatCrit theory in 1995, then briefly describes the origins and evolution of this enterprise, before …

Dealing With Illiteracy, Helen Ann Myers Jan 2005

Dealing With Illiteracy, Helen Ann Myers

All Capstone Projects

This research project is to investigate illiteracy and join the battle to help alleviate this widespread disease, and its related problems. Illiteracy has been a very hotly debated issue in the United States for years. The number of illiterate adults is extremely high and the related challenges on this population are overwhelming. Because of this controversy, there is much debate over the best method of educating our young children to be good readers as well as how to address those who have difficulty reading.

“The Indispensable Basis Of Democracy”: American Catholicism, The Church-State Debate, And The Soul Of American Liberalism, 1920–1929, Zachary R. Calo Jan 2005

“The Indispensable Basis Of Democracy”: American Catholicism, The Church-State Debate, And The Soul Of American Liberalism, 1920–1929, Zachary R. Calo

Scholarly Works

Several recent works of scholarship explore how Establishment Clause jurisprudence has been shaped by broader political debates over the role of religion in public life. This literature focuses on the politics of anti-Catholicism, particularly during the early years of Establishment Clause jurisprudence in the1940s and 1950s. While not questioning the centrality of this period to the historical narrative, this Note argues that the political contest over church and state took shape in an earlier debate over the compatibility of Catholicism and the Constitution during the 1920s. The Church’s response to the anti-Catholicism of this period was of particular importance. Catholic …

Self-Determination In International Mediation: Some Preliminary Reflections , Jacqueline Nolan-Haley Jan 2005

Self-Determination In International Mediation: Some Preliminary Reflections , Jacqueline Nolan-Haley

Faculty Scholarship

Few concepts have generated as much discussion in the post-war international legal system as that of “self-determination.” Scholars debate the proper identity of the "selves" endowed with this right, its boundaries, and its normative relevance. When the focus turns to mediation, the discussion becomes murky because the concept of self-determination has both procedural and substantive components, and is noticeably different in the private and public sectors. The generic concept of self-determination relates to ideas of democratic governance and the Enlightenment belief that legitimate government depends upon the consent of the governed. As adapted to private mediation theory, the right of …

Altmann V. Austria And The Retroactivity Of The Foreign Sovereign Immunities Act, Carlos Manuel Vázquez Jan 2005

Altmann V. Austria And The Retroactivity Of The Foreign Sovereign Immunities Act, Carlos Manuel Vázquez

Georgetown Law Faculty Publications and Other Works

In Republic of Austria v. Altmann, the U.S. Supreme Court decided that the Foreign Sovereign Immunities Act of 1976 (FSIA) generally applies to claims based on events that occurred before the Statute's enactment. To decide the retroactivity question, the Court had occasion to consider the essential nature of foreign sovereign immunity: is it merely a procedural immunity providing foreign states with present protection from the inconvenience and indignity of a lawsuit, or is it something more than that? The Court's examination of this question was brief and unsatisfying. Its analysis would have been enriched by a recognition that foreign …

Community Self Help, Neal K. Katyal Jan 2005

Community Self Help, Neal K. Katyal

Georgetown Law Faculty Publications and Other Works

This paper advocates controlling crime through a greater emphasis on precautions taken not by individuals, but by communities. The dominant battles in the literature today posit two central competing models of crime control. In one, the standard policing model, the government is responsible for the variety of acts that are necessary to deter and prosecute criminal acts. In the other, private self-help, public law enforcement is largely supplanted by providing incentives to individuals to self-protect against crime. There are any number of nuances and complications in each of these competing stories, but the literature buys into this binary matrix.

Academics And The Federal Circuit: Is There A Gulf And How Do We Bridge It?, John R. Thomas Jan 2005

Academics And The Federal Circuit: Is There A Gulf And How Do We Bridge It?, John R. Thomas

Georgetown Law Faculty Publications and Other Works

Many of the great research universities of the United States enjoy a close relationship with innovators. Names like Carnegie, Cornell, Hopkins, Stanford, and Vanderbilt bring to mind not so much these men, but the academic institutions that they founded. The mention of other research institutions, such as the Universities of Chicago and Virginia, allows us to recall entrepreneurial founders such as Rockefeller and Jefferson. It is appropriate then, to consider how university research - and in particular, the work product of the law schools - is faring before that court whose rulings most directly impact American innovation policy.

Words, Words, Words!!! Teaching The Language Of Tax, Stephen B. Cohen Jan 2005

Words, Words, Words!!! Teaching The Language Of Tax, Stephen B. Cohen

Georgetown Law Faculty Publications and Other Works

The basic course in federal income tax is usually a challenge for both teacher and student because so many different and difficult things are being taught at once: a prolix and opaque statute; complex financial transactions; and economic, political, and social analysis of the effects of the tax law. In addition, I believe that a teacher of tax must be a teacher of language, focusing explicitly and self-consciously on the ambiguous, imprecise, and confusing words that are embedded in tax law and discourse and that constitute a significant obstacle for students taking the basic course in federal income taxation.

Surface Textures For Enhanced Lubrication: Fabrication And Characterization Techniques, Sriram Venkatesan Jan 2005

Surface Textures For Enhanced Lubrication: Fabrication And Characterization Techniques, Sriram Venkatesan

University of Kentucky Master's Theses

Theoretical and experimental results show that the performance of a load-bearing surface in hydrodynamic lubrication may be enhanced by engineering a definable surface texture onto the surface. These surface textures are in the form of protrusions (positive asperities) or cavities (negative asperities) of known size and geometry. The benefits of such surface textures include lower friction torque, higher load capacity and lower operating temperatures. This Thesis details a fabrication process to manufacture such surface textures/asperities on flat surfaces. The asperities are fabricated using a UV photolithography process followed by electroplating. A complete surface characterization is done to evaluate the effectiveness …

Physical Properties Of Holmium Promoted Superconductivity In Nd-Doped Ybco Ht_C-Superconductors, Morsy Abou Sekkina, Abdul Raouf Tawfik, Osama Hemeda, Mohamad Ahmad Taher Dawoud, Samy El-Attar

Turkish Journal of Physics

Samples of the nominal composition (Y_{0.5}Nd_{0.5-x}Ho_x) Ba_2Cu_3O_{7- \delta} , 0 \le x \le 0.5, have been prepared using the conventional solid state reaction. The effect of holmium and neodymium substitution on electrical resistivity, transition temperature T_c, lattice parameters, size of crystallite and grain size has been investigated. X-ray diffraction, electron micro-probe, scanning electron microscope and IR spectra, have been used in our investigation. The results show that the transition temperature T_c, electron-hole jump rate and lattice parameters (a, b) have minimum values at x = 0.2, while c increases to maximum at x = 0.2. The size of crystallite, the …
