The Study Of Religion And The Rise Of Atheism: Conflict Or Confirmation?, Michael J. Buckley S.J. Jan 2005

The Study Of Religion And The Rise Of Atheism: Conflict Or Confirmation?, Michael J. Buckley S.J.

Religious Studies

'Religion' and 'theology' are not terms with fixed meanings and invariant applications. They are rather copies or commonplaces - not in the sense of the familiar and the trite, but in the classical sense of linguistic variables, terms ambiguous and capacious enough to house a vast diversity of meanings, arguments, and referents.1 The interconnection of such topics constitutes neither a determined problem nor an exact proposition. It constitutes what John Dewey called 'a problematic situation', an indeterminate area out of which problems and their resolutions can emerge only if these ambiguous terms are given specific meanings and definite applications …

Monasteries As Financial Patrons And Promoters Of Local Performance In Late Medieval And Early Tudor England, Christine Sustek Williams Jan 2005

Monasteries As Financial Patrons And Promoters Of Local Performance In Late Medieval And Early Tudor England, Christine Sustek Williams

Quidditas

The elaborate cycle plays produced in the larger, wealthy municipalities of York, Chester, Wakefield and Coventry receive the lion’s share of attention among scholars of medieval theatre. Until recently, performance activities in smaller communities have received little or no attention, except perhaps as something of antiquarian interest. And one area of theatre history that has been largely overlooked is the involvement of monasteries in local performance activities. Yet the precious few, fragmentary, monastic records that survived the dissolutions of the monasteries under Henry VIII and Edward VI, suggest that several monasteries gave active financial support to local theatre in England …

The Rule Of Law And The Origins Of The Bill Of Attainder Clause, Jacob Reynolds Jan 2005

The Rule Of Law And The Origins Of The Bill Of Attainder Clause, Jacob Reynolds

St. Thomas Law Review

Until recently, modem bill of attainder analysis has been fairly simple for courts and litigators alike - in order to be considered a bill of attainder, a law must "(1) specify the affected persons; (2) impose punishment; and (3) lack a judicial trial." Furthermore, the case law defining the appropriate analysis in bill of attainder cases is minimal and simple to understand: as one recent appointee to the D.C. Circuit has aptly noted, "[t]he Supreme Court's approach to the bill of attainder clause has been developed in only a handful of decisions. It is surprising that such a historically non-controversial …

The Presumption Of Guilt And The English Law Of Theft, 1750-1850, Bruce P. Smith Jan 2005

The Presumption Of Guilt And The English Law Of Theft, 1750-1850, Bruce P. Smith

Sturm College of Law: Faculty Scholarship

"When it is said that a defendant to a criminal charge is presumed to be innocent, what is really meant is that the burden of proving his guilt is upon the prosecution. This golden thread ... runs through the web of the English criminal law. Unhappily Parliament regards the principle with indifference - one might almost say with contempt. The statute book contains many offences in which the burden of proving his innocence is cast on the accused." (Glanville Williams, The Proof of Guilt: A Study of the English Criminal Trial (1955))

No principle in Anglo-American criminal law is more …

Mapping, Habitat Characterization, And Fish Surveys Of The Deep-Water Oculina Coral Reef Marine Protected Area: A Review Of Historical And Current Research., John K. Reed, Andrew N. Shepard, Christopher C. Koenig, Kathryn M. Scanlon, R. G. Gilmore

Faculty Scholarship

Deep-water Oculina coral reefs, which are similar in structure and development to deep-water Lophelia reefs, stretch 167 km (90 nm) at depths of 60-100 m along the eastern Florida shelf of the United States. These consist of numerous pinnacles and ridges, 3-35 m in height, that are capped with thickets of living and dead coral, Oculina varicosa. Extensive areas of dead Oculina rubble are due in part to human impacts (e.g., fish and shrimp trawling, scallop dredging, anchoring, bottom longlines, and depth charges) but also may be due in part to natural processes such as bioerosion, disease, or global warming.

When The Trumpet Call Is Unclear: A Rhetorical Analysis Of The Speech That Launched The Jesus Seminar, Mathew A. Cabot Jan 2005

When The Trumpet Call Is Unclear: A Rhetorical Analysis Of The Speech That Launched The Jesus Seminar, Mathew A. Cabot

Faculty Publications

Since the Jesus Seminar has become almost iconic in religious media coverage, it merits academic scrutiny. This article focuses on the Seminar's inaugural address given by founder Robert Funk on March 21, 1985, at the Pacific School of Religion in Berkeley, California. In that address, Funk set forth the Seminar's mission and method that has guided the association ever since. The main thesis of this article is that clues to the Seminar's successes and failures may be found in Funk's inaugural address, which may be uncovered through a "text-in-context" analysis of the speech.

The Disintegration Of Modern Culture. Nietzsche And The Information Age, Edgar Landgraf Jan 2005

The Disintegration Of Modern Culture. Nietzsche And The Information Age, Edgar Landgraf

German Faculty Publications

The article revisits Nietzsche’s provocative claim that the Enlightenment’s emphasis on education and open exchange of information promotes rather than prevents the “loss of meaning” from a media studies and systems theoretical perspective. Nietzsche in fact ties what he understands as modern culture’s disintegration to information-processing modes of modern society, that is, as effects of the modern educational system and the mass media (at his time, the printing press). The article argues that while Nietzsche is an astute observer of modernity, his call for a return to a more authentic culture (with its daunting political implications) is indicative of Nietzsche’s …

"Woke Up This Morning With My Mind On Freedom": Women And The Struggle For Black Equality In Louisiana, Shannon L. Frystak Jan 2005

"Woke Up This Morning With My Mind On Freedom": Women And The Struggle For Black Equality In Louisiana, Shannon L. Frystak

Doctoral Dissertations

This dissertation examines the role of female civil rights activists in the black struggle for equality in Louisiana. Drawing on the fields of history, sociology, political science, and gender studies, this project demonstrates that women were indispensable figures in the freedom struggle in Louisiana throughout the twentieth century, and highlights their roles as organizers, participants, and leaders.

The project focuses on the entire state of Louisiana, but more specifically in areas where civil rights organizations concentrated their efforts. While many historical studies of the movement begin with the Supreme Court decision in Brown v. Board of Education in 1954, this …

School Governance In New Hampshire: Revisiting A Study Of School Board -Superintendent Relations In Small Rural School Districts, Betsey Stebbins Cox-Buteau

Doctoral Dissertations

The purpose of this study was to replicate the dissertation of Dr. Phillip McCormack of 1988 and to compare the results of that study to the results of this study of 2004, fifteen years later. Dr. McCormack's original research questions were used but modified to include the comparison of data fifteen years apart.

A descriptive research design was used. It was based upon the design used by Dr. McCormack. The study used both a quantitative component and a qualitative component. Information was gathered, as it had been in 1988, through (1) questionnaires given to school board members and superintendents and …

Indians And Immigrants: Survivance Stories Of Literacies, Joyce Rain Anderson Jan 2005

Indians And Immigrants: Survivance Stories Of Literacies, Joyce Rain Anderson

Doctoral Dissertations

This item is not available from ProQuest Dissertations & Theses.

This project stems from my mixedblood heritage and from a community of mixedblood scholars. In this text, I relate stories of the early colonization of Southern New England, of the zones of contact between whites (primarily English) and Indians (primarily Massachusett or Wampanoag). I offer perspectives on competing views of literacy and explored texts translated from Massachusett Algonquin to see how Indians used writing to enact rhetorics of survivance which challenged the prevailing assumptions of the dominant culture. Within these texts we see how Indians continued to define themselves in …

Boundary -Work In United States Psychology: A Study Of Three Interdisciplinary Programs, Michael J. Root Jan 2005

Boundary -Work In United States Psychology: A Study Of Three Interdisciplinary Programs, Michael J. Root

Doctoral Dissertations

Between 1970 and 2000 scientists from three interdisciplinary programs---evolutionary psychology, cognitive science, and chaos theory---contributed to changing U.S. psychology's disciplinary boundaries. These interdisciplinary scientists brought about this change through their conceptual, material, and social practices. Psychologists used "boundary-work" as a means to control the influx of these various practices. Boundary-work connotes activities that promote scientists' epistemic authority in society. Boundary-work also serves to demarcate a science's particular collection of knowledge from other collections. Through their boundary-work activities, various psychologists resisted some of the practices of these interdisciplinary scientists while making accommodations for other types of practices. These resistances and accommodations …

Grandfathers, Grandsons, Morality, And Radical Politics In Late Colonial Buganda, Carol Summers Jan 2005

Grandfathers, Grandsons, Morality, And Radical Politics In Late Colonial Buganda, Carol Summers

History Faculty Publications

Late in 1948, one of the radical Luganda newspapers in Buganda printed Dionizio Sifirwakange's rhetorical and distinctly aggrieved questions: "Has it become a crime for schoolchildren to evince patriotic sentiments? Why does the Government prohibit the assembly of the Bataka at the houses of their 'grandfathers'?"1

Sifirwakange was complaining about the repressive response of the Kingdom of Buganda and its ally, the Protectorate of Uganda, to a political and social movement whose most visible adherents were the patriotic schoolchildren, along with other youth and men of all ages, who assembled by the thousands at the homes of their grandfathers …

Review Of Western Places, American Myths: How We Think About The West Edited By Gary J. Hausladen, Frances Flavin

Great Plains Quarterly (through 2013)

Western Places, American Myths is a collection of twelve essays covering a broad range of topics dealing with the myths, images, and perceptions associated with the American West and the region's historical geographyincluding ranches, national parks, Native American lands, the Spanish and Mexican Southwest, women in the West, Utah's Latter Day Saints, ghost towns, gambling, and the geography of Western films.

As in many essay collections, the quality is uneven. In his acknowledgments, editor Hausladen states that "the art of editing is to ask really good writers to contribute and then let them do what they do best." That may …

The Indemnity Principle: From A Financial To A Function Paradigm, Brad Wilson, Jeffrey E. Thomas Jan 2005

The Indemnity Principle: From A Financial To A Function Paradigm, Brad Wilson, Jeffrey E. Thomas

Faculty Works

Although the indemnity principle is well-accepted, its customary meaning has not kept up with insurance practice. This paper explores the evolution of the indemnity principle in the context of property insurance in the United States. When property insurance was standardized in the 19th century, "indemnity" had a strict, financial meaning. An insured was only entitled to receive actual cash value for a loss, less depreciation. This ensured that insureds received a financial recovery equal to the value of their property prior to the loss. This approach to indemnity was developed in the context of concerns about the morality of insurance, …

Centennial Bibliography On The History Of American Sociology, Michael R. Hill Jan 2005

Centennial Bibliography On The History Of American Sociology, Michael R. Hill

Department of Sociology: Faculty Publications

THE CENTENNIAL BIBLIOGRAPHY ON THE HISTORY OF AMERICAN SOCIOLOGY is intended as an inclusive clearinghouse for sources, studies, and other references that illuminate the origins and subsequent development of the sociological enterprise in the United States of America.2 As such, this bibliography is necessarily provisional and is envisioned as an on-going project to which further citations may be added as they are discovered and as new works are published. Due to the enormous scope of the project, and the short time frame within which the initial compilation was completed, countless useful and insightful references have been unintentionally omitted. Some portions …
