Discovering Your Cinematic Cultural Identity, John Shelton Lawrence, Marty S. Knepper Jul 2005

Discovering Your Cinematic Cultural Identity, John Shelton Lawrence, Marty S. Knepper

Reconstruction: Studies in Contemporary Culture

This paired set explores the experience of cultural identities constructed by and experienced through popular film. The essay “Discovering Your Cinematic Cultural Identity” reflects the authors’ decades of residence in the state of Iowa and their personal irritation with the stereotypes that Hollywood regularly calls upon in evoking the American rural. We gained a new perspective on this sort of imagery when it surfaced again in Field of Dreams (1989) and The Bridges of Madison County novel (1992) and film (1995). Each of these films triggered unprecedented film tourism for the state. Through an exploration of these films and others …

For Whom The School Bell Tolls But Not The Statute Of Limitations: Minors And The Individuals With Disabilities Education Act, Lynn M. Daggett, Perry A. Zirkel, Leeann L. Gurysh Jul 2005

For Whom The School Bell Tolls But Not The Statute Of Limitations: Minors And The Individuals With Disabilities Education Act, Lynn M. Daggett, Perry A. Zirkel, Leeann L. Gurysh

University of Michigan Journal of Law Reform

This Article explores whether claims under the federal special education statute should be tolled on account of minority. Adult disabled students typically assert this type of tolling claim when alleging statutory violations dating back ten or more years, when they were minors. However this tolling claim is decided, there may be undesired results. First, even if the student has a very strong case, the merits are never reached if the court dismisses the hearing request as untimely. Second, if the hearing request is timely and the case proceeds to the merits, the student must remain in her current educational placement, …

Bayes' Law, Sequential Uncertainties, And Evidence Of Causation In Toxic Tort Cases, Neal C. Stout, Peter A. Valberg Jul 2005

Bayes' Law, Sequential Uncertainties, And Evidence Of Causation In Toxic Tort Cases, Neal C. Stout, Peter A. Valberg

University of Michigan Journal of Law Reform

Judges are the gatekeepers of evidence. Arguably, the most difficult duty for a judicial gatekeeper is to screen the reliability of expert opinions in scientific fields such as medicine that are beyond the ken of most judges. Yet, judges have a duty to scrutinize such expert opinion evidence to determine its reliability and admissibility. In toxic tort cases, the issue of causation-whether the alleged exposures actually caused the plaintiffs injury-is nearly always the central dispute, and determining admissibility of expert causation opinion is a daunting challenge for most judges. We present a comprehensive review of the courts' struggles with the …

Intention To Seek Information On Cancer Genetics, James E. Andrews, J. David Johnson, Donald O. Case, Suzanne L. Allard, Kimberly Kelly

Communication Faculty Publications

Objective. The public has a high interest in seeking personal genetic information, which holds implications for health information seeking research and health care policy. Rapid advances in cancer genetics research promise early detection, prevention and treatment, yet consumers may have greater difficulty finding and using the information they may need to make informed decisions regarding their personal health and the future of their families.

Design. A statewide telephone survey was conducted of non-institutionalized Kentucky residents 18 years of age or older to investigate factors associated with the intention to seek cancer genetics information, including the need for such information seeking …

Ranking Law Schools: A Market Test?, Cass R. Sunstein Jul 2005

Ranking Law Schools: A Market Test?, Cass R. Sunstein

Coase-Sandor Institute for Law & Economics Research Paper Series

Instead of ranking law schools through statistical aggregations of expert judgments, or by combining a list of heterogeneous factors, it would be possible to rely on a market test, simply by examining student choices. This tournament-type approach would have the large advantage of relying on the widely dispersed information that students actually have; it would also reduce reliance on factors that can be manipulated (and whose manipulation does no good other than to increase rankings). On the other hand, a market test has several problems as a measure of law school quality, partly because cognitive biases and social influences may …

Boundedly Rational Borrowing: A Consumer's Guide, Cass R. Sunstein Jul 2005

Boundedly Rational Borrowing: A Consumer's Guide, Cass R. Sunstein

Coase-Sandor Institute for Law & Economics Research Paper Series

Excessive borrowing, no less than insufficient savings, might be a product of bounded rationality. Identifiable psychological mechanisms are likely to contribute to excessive borrowing; these include myopia, procrastination, optimism bias, "miswanting," and what might be called cumulative cost neglect. Suppose that excessive borrowing is a significant problem for some or many; if so, how might the law respond? The first option involves weak paternalism , through debiasing and other strategies that leave people free to choose as they wish. Another option is strong paternalism, which forecloses choice. Because of private heterogeneity and the risk of government error, regulators should have …

Vacatur Of Labor Arbitration Awards: Watering Down The Supreme Court's Drawn From The Essence Precedent May Sound The Death Knell For Labor Arbitration , Jonathan R. Waldron

Journal of Dispute Resolution

In CITGO Asphalt Ref. Co. v. Paper, Allied-Indus., Chem., & Energy Workers Int'l Union Local No. 2-991, the Court of Appeals for the Third Circuit, while merely giving lip service to Supreme Court precedent, further contributes to the situation where many circuit courts insidiously refuse to follow the Supreme Court's prohibition against reaching the merits of a labor arbitrator's award. It would appear that only through renewed Supreme Court vigilance and clarity can this trend be impeded.

Role Of The Distal Sara Promoters In Sara Expression In Staphylococcus Aureus, Ambrose L. Cheung, Adhar C. Manna Jul 2005

Role Of The Distal Sara Promoters In Sara Expression In Staphylococcus Aureus, Ambrose L. Cheung, Adhar C. Manna

Dartmouth Scholarship

The global regulatory locus sarA comprises a 375-bp open reading frame that is driven by three promoters, the proximal P1 and distal P3 and P2 promoters. We mutated the weaker P3 and P2 promoters to ascertain the effect of the change on SarA protein and target gene expression. Our results indicated that the solely active P1 promoter led to a lower SarA protein level, which has an effect on agr transcription and subsequently had corresponding effects on hla, sspA, and spa transcription, probably in both agr-independent and agr-dependent manners.

Thymidine-Dependent Staphylococcus Aureus Small-Colony Variants Are Associated With Extensive Alterations In Regulator And Virulence Gene Expression Profiles, Barbara C. Kahl, Gunnar Belling, Petra Becker, Indranil Chatterjee, Katrin Wardecki, Karin Hilgert, Ambrose Cheung

Dartmouth Scholarship

Chronic airway infection is a hallmark of cystic fibrosis (CF) and many CF patients are infected persistently by Staphylococcus aureus. Thymidine-dependent trimethoprim-sulfamethoxazole (SXT)-resistant S. aureus small-colony variants (SCVs), often in combination with isogenic normal S. aureus phenotypes, are highly prevalent and persistent in airway secretions of CF patients due to long-term SXT therapy (B. Impact Of Changes To Premiums, Cost-Sharing, And Benefits On Adult Medicaid Beneficiaries: Results From An Ongoing Study Of The Oregon Health Plan, Bill J. Wright, Matthew J. Carlson, Jeanene Smith, Tina Edlund

Sociology Faculty Publications and Presentations

In 2003, Oregon implemented changes to its Medicaid program to cope with budget shortfalls. In addition to reducing benefits, increasing premiums, and implementing copays for a substantial portion of enrollees, the Oregon Health Plan (OHP) also eliminated premium exemptions and instituted a six-month lockout for individuals missing premium payments. In 2004, OHP rolled back some of these policies. An ongoing study of the impact of OHP’s program changes finds that, after the initial cost-sharing increases and benefit reductions, nearly two-thirds of individuals surveyed had lost their coverage, many directly resulting from increased costs. Those who left because of premiums and …

Cervical Cancer Screening Disparities In An Ethnically Diverse Population Of Women Residing In The United States In 1999: A Secondary Analysis Of Data From The 1999 Behavioral Risk Factor Surveillance System, Chodaesessie Wellesley-Cole Morgan Jul 2005

Cervical Cancer Screening Disparities In An Ethnically Diverse Population Of Women Residing In The United States In 1999: A Secondary Analysis Of Data From The 1999 Behavioral Risk Factor Surveillance System, Chodaesessie Wellesley-Cole Morgan

USF Tampa Graduate Theses and Dissertations

Black American women have the highest screening rates for cervical cancer among all the ethnic groups in the United States. Even though evidence from the literature suggests that the number of deaths from cervical cancer in the United States could be reduced by preventive screening, this particular minority population still suffers disproportionately higher mortality from the disease than the other minority and majority populations in the United States. This study was proposed to investigate cancer screening disparities among different subpopulations of women residing in the United States during 1999, and to recommend public health interventions that could potentially increase cervical …

Time And Frequency Of Applications Of Entomopathogenic Nematodes And Their Persistence For Control Of Western Flower Thrips Frankliniella Occidentalis, Difabachew Belay, Lemma Ebssa, Christian Borgemeister

All Peer-Reviewed Publications

Post application persistence of two entomopathogenic nematode (EPN) species, Heterorhabditis bacteriophora strain HK3 and Steinernema carpocapsae strain DD136, was studied against soil-dwelling late second instar larvae (L2) of western flower thrips (WFT) Frankliniella occidentalis (Thysanoptera: Thripidae). The nematodes were applied at 200 and 400 infective juveniles (IJ) cm-2, and L2 WFT were introduced at 0 (same day), 3, 6, 9 or 12 days after nematode application (DANA). Heterorhabditis bacteriophora caused higher thrips mortality than S. carpocapsae in most of the tests and both species persisted for at least 6 days, causing WFT mortality of up to 76 and 37.8%, respectively. …

Functionally Active T1-T1 Interfaces Revealed By The Accessibility Of Intracellular Thiolate Groups In Kv4 Channels., Guangyu Wang, Mohammad Shahidullah, Carmen A Rocha, Candace Strang, Paul J Pfaffinger, Manuel Covarrubias

Department of Pathology, Anatomy, and Cell Biology Faculty Papers

Gating of voltage-dependent K(+) channels involves movements of membrane-spanning regions that control the opening of the pore. Much less is known, however, about the contributions of large intracellular channel domains to the conformational changes that underlie gating. Here, we investigated the functional role of intracellular regions in Kv4 channels by probing relevant cysteines with thiol-specific reagents. We find that reagent application to the intracellular side of inside-out patches results in time-dependent irreversible inhibition of Kv4.1 and Kv4.3 currents. In the absence or presence of Kv4-specific auxiliary subunits, mutational and electrophysiological analyses showed that none of the 14 intracellular cysteines is …

Corporal Punishment And Its Relation To Race, Psychological Well-Being, And Parental Relationship, Michelle P. Kravitz Jul 2005

Corporal Punishment And Its Relation To Race, Psychological Well-Being, And Parental Relationship, Michelle P. Kravitz

Psychology Theses & Dissertations

Previous research has documented the numerous negative effects associated with corporal punishment (Gershoff, 2002). The present study examined whether experiencing corporal punishment as a child is related to one's perception of the legitimacy of corporal punishment, race, the nature of the parent-child relationship (i.e., biological parent versus step-parent), and psychological well-being. Compared to college students who did not experience corporal punishment during childhood, college students who experienced higher levels of corporal punishment are expected to report that corporal punishment is a more acceptable form of discipline. College students who grew up with a stepfather were expected to be more likely …

Pursuit Of Professionalism In Bureaucracy: Perceptions About Bureaucratic Values Of Civil Service Employees In The Ethnic Federalism Of Ethiopia, Mary Elizabeth Vogel

School of Public Service Theses & Dissertations

In the 1980s an array of world events including the dissolution of the Soviet Union, a movement toward restructuring and downsizing government bureaucracies, and rapidly evolving technology prompted significant changes to governments. Many developing nations began the transition from command to market economies, and new government structures emerged to address a variety of root problems including the rise of ethnic consciousness and conflict. As a consequence of these events, changes in societies, governments, and bureaucracies, were drivers for changes to bureaucratic values.

The current research addresses a gap in knowledge about bureaucratic values specifically in a government organized under the …
