Crops, Guns & Commerce: A Game Theoretical Critique Of Gonzales V. Raich, Maxwell L. Stearns

George Mason University School of Law Working Papers Series

In Gonzales v. Raich, the Supreme Court sustained an application of the Controlled Substances Act (“CSA”), banning all private use of marijuana, as applied to two women who had cultivated or otherwise acquired marijuana for the treatment of severe pain pursuant to the California Compassionate Use Act. Writing for the majority, Justice Stevens placed Raich at the intersection of two landmark Commerce Clause precedents: Wickard v. Filburn, the notorious 1942 decision, which upheld a penalty under the Agriculture Adjustment Act of 1938 applied to a local farmer who violated his wheat quota but who had used the modest excess portion …

Zoonotics and Wildlife Disease: Publications

This risk assessment has been carried out following the guidelines for Health Risk Analysis entitled “Wild Animal Translocations” prepared by the Canadian Cooperative Wildlife Health Centre (http://wildlife1.usask.ca). It includes 9 comprehensive appendices of bacterial, viral, parasitic and fungal organisms reported from domestic sheep, goats, llamas and wild sheep and mountain goats. The report is a breakdown of those appendices into discussions of organisms of major concern, organisms of unknown concern, organisms of minimal concern, and those that cause no apparent disease, are not transmissible between the species of interest, or do not occur in Canada. The Semi-Sovereign Corporation, Daniel J.H. Greenwood Aug 2005

The Semi-Sovereign Corporation, Daniel J.H. Greenwood

ExpressO

For at least a generation, corporate law scholars have worked within a paradigm of the corporation as a nexus of contracts, using metaphors drawn from contract, property, agency and trust to describe the relationships between shareholders and the firm as something like those of strangers in a market.

But historically, corporations were understood to be political organizations much like a miniature state or sovereign. The political view emphasizes that the participants in a firm include more than the public shareholders, that they have relationships with each other that extend beyond the momentary contact of strangers in a spot-market, and most …

Cybersecurity, Identity Theft, And The Limits Of Tort Liability, Vincent R. Johnson Aug 2005

Cybersecurity, Identity Theft, And The Limits Of Tort Liability, Vincent R. Johnson

ExpressO

This article considers to what extent database possessors (such as credit card companies and universities) can be held liable for harm caused to data subjects (such as consumers, applicants, and alumni) when information relating to those persons is hacked or otherwise subject to improper access. Addressing common-law and statutory sources (including new legislation in 17 states) the article clearly differentiates the duty to safeguard data from the duty to notify data subjects that the security of their information has been breached. By analogy to the “medical-monitoring damages” which some states award in toxic-exposure cases, the article argues that “security-monitoring damages” …

Survival Point Estimate Prediction In Matched And Non-Matched Case-Control Subsample Designed Studies, Annette M. Molinaro, Mark J. Van Der Laan, Dan H. Moore, Karla Kerlikowske

U.C. Berkeley Division of Biostatistics Working Paper Series

Providing information about the risk of disease and clinical factors that may increase or decrease a patient's risk of disease is standard medical practice. Although case-control studies can provide evidence of strong associations between diseases and risk factors, clinicians need to be able to communicate to patients the age-specific risks of disease over a defined time interval for a set of risk factors.

An estimate of absolute risk cannot be determined from case-control studies because cases are generally chosen from a population whose size is not known (necessary for calculation of absolute risk) and where duration of follow-up is not …

Political Humor In Late-Night Television: A Quantitative And Qualitative Examination Of Late-Night Talk Show Monologues, Eileen Shannon Aug 2005

Political Humor In Late-Night Television: A Quantitative And Qualitative Examination Of Late-Night Talk Show Monologues, Eileen Shannon

Theses

This study examines political trends that existed in late-night talk show monologues throughout October 2004. Designed to detect which candidates and issues were addressed, along with the degree to which hosts positively or negatively framed the candidates, the results clarify the issues and people that the public was familiar with.

The monologues of The Tonight Show with Jay Leno and The Late Show with David Letterman were examined. A content analysis and a semantic differential scale distinguished important issues, candidates and the framing of those candidates. Trends within each show were noted.

The results show President George W. Bush as …

Another Case In Lochner’S Legacy, The Court’S Assault On New Property: The Right To The Mandatory Enforcement Of A Restraining Order Is “A Sham, Nullity And Cruel Deception” , Christopher J. Roederer

ExpressO

This article provides a thorough critique of the Supreme Court decision of Castle Rock v. Gonzales 125 S. Ct. 2796 (2005) which dismissed respondent’s case for failing to establish that she had a property right in the enforcement of a restraining order that was worthy of procedural due process protection. The article critiques the Court’s methodology and substantive arguments. The article concludes by situating the decision in “Lochner’s legacy,” a legacy of decisions that Cass Sunstein has identified as privileging “government inaction,” and “the existing distribution of entitlements” as set by the common law. Just as the Lochner Court decided …
