This article discusses the psychological influences on referent selection. The nature of contemporary work environments, ones characterized by instability and uncertainty, may create increased needs on the part of individuals for comparative information. Individuals use social comparisons for managing both uncertainty and environmental change, and for making critical decisions about one's job. Most literature on referent selection can be categorized along two basic schema: identification of the types of referents that exist and examination of the outcomes that result from referent selection. The Executive Committee of the Association of American Law Schools has adopted a Statement of Good Practices that purports to limit the times when law schools may make offers to hire faculty members at other schools. Schools are generally not to make offers for indefinite appointments to professors on other faculties after March 1, subject to extension for two months with the consent of the incumbent's dean. They also are not to make offers contemplating resignation from a current faculty position more than two weeks following those deadlines. The Promise And Perils Of Collaborative Law, John M. Lande

Getting people to use an interest-based approach in negotiation has been a difficult problem. Experts provide helpful suggestions for changing the game, though these are usually limited to case-by-case efforts within a culture of adversarial negotiation. Collaborative law (CL) is an important innovation that establishes a general norm of interest-based negotiation and intentionally develops a new legal culture. This article describes CL's promise and potential perils, focusing particularly on the perils to complement the literature touting the promise.

Issue Brief: The Impact Of Cost Sharing And Benefit Changes To Oregon Health Plan Beneficiaries: Results, Two Years Later, Bill J. Wright, Matthew J. Carlson

This study was launched in 2003 and followed a representative sample of OHP enrollees through the redesign of the program (OHP2) to gain a better understanding of the impact of those changes, including increased cost-sharing, cuts to benefits and stricter rules around payment of premiums. The objectives of this ongoing study are to assess the short and long-term impacts around five main outcome areas: health insurance coverage, access to care, utilization of care, individuals’ financial well being and health status. The key findings from the second round of surveying are detailed in this brief and reflect impacts approximately 18 months …

The Community Income Theory Of The Charitable Contributions Deduction, Johnny Rex Buckles

The charitable contributions deduction, a longstanding yet controversial feature of the Internal Revenue Code, has been justified under subsidy theories and tax-base theories. Focusing on the latter, this Article presents and explains a new tax-base theory in support of the charitable contributions deduction-the community income theory. This theory posits that some income, designated as "community income, " is properly excluded from the personal income tax base because it is more naturally attributed to the community than to the individual members of the community. The Kindynamic Theory Of Tort, Christopher P. Guzelian

Commentators complain of two major deficiencies in modern tort law: (1) that liability concepts such as "negligence" or "duty " are so vacuously defined as to permit inadvertent subjectivity and error to hinder proper case adjudication, and (2) that tort is too slow in recognizing newly discovered risks and properly compensating nascent classes of injury. We accordingly report on the Kindynamic Theory, an emerging philosophy that overcomes these twin deficiencies and sharpens understanding of poorly articulated tort intuitions

OBJECTIVE: To examine the localization and over expression of heat shock protein 70 (HSP70) and p53 in patients with colorectal cancer and compared it with control tissue (including normal colon tissue). METHODS: This was a retrospective study of 60 patients with colorectal adenocarcinoma at the Jordan University of Science and Technology (JUST), Irbid, Jordan from 1997 to 2000. The Pathology Department at JUST is the chief provider of surgical pathology services in the north of Jordan. It receives specimens from both government and private hospitals. The exact composition of the complex microsystem that constitutes the gut flora continues to be explored as molecular methodology supplements traditional microbiological studies. The current study reports a random analysis of the faecal flora composition for 31 neonates in the 0–1 day age group, 41 neonates aged 2–5 days and 33 6-week-old neonates. All infants, born at the National Maternity Hospital, Ireland, were considered healthy, full-term normal deliveries and were either exclusively breastfed or formula-fed from birth. Economic Costs Of Low Safety Belt Usage In Motor Vehicle Crashes In Kentucky, Michael Singleton, Qing Xiao, Kenneth R. Agent

Kentucky Transportation Center Research Report

By passing legislation in 2006 to mandate primary enforcement of the Kentucky state law requiring safety belt use for motor vehicle occupants, the state could expect to realize an overall savings of at least $118 million in direct medical costs over the ten-year period from 2006 to 2015. Charges to Medicaid over that period would be about $34 million less than under the current secondary enforcement model. In addition, there would be at least $67 million saved in medical costs to commercial insurers, $2.3 million to Medicare, $3.3 million to Worker’s Compensation, and $11.2 million to other sources.
