Tuberculosis, and Malaria Act of 2003 (“Global AIDS Act” or “GAA”) places two limitations on organizations that are eligible to receive funding under this Act. First, funding may not be used to “promote or advocate the legalization or practice of prostitution or sex trafficking.” Second, any organization that receives funding must have a “policy explicitly opposing prostitution and sex trafficking . . .” The Trafficking Victims Protection Act of 2003 (“TVPA”) has similar requirements. It states that no funding can be made available to “promote, support, or advocate the legalization or practice of prostitution,” and that any organization receiving funding …

Professor Dragich uses the Blackmun papers to augment our understanding of Justice Blackmun's "evolution" on the question of capital punishment. Though the evolution was gradual, she finds that the case of Warren McCleskey seems to have deeply affected Justice Blackmun.

Perceived Competence Of Aging Pilots, Laura M. Stelmach

This study investigated the relationship between age and the perception of competence of pilots by the traveling public. Scenarios were utilized that depicted an airline captain successfully landing an airplane amidst adverse conditions. Scenarios varied only by the age of the Captain: Young, Old, or Unspecified Age and that the Young and Old scenarios included a photo of the captain. Perceived effectiveness, competence, avoidance, blame, and attribution as depicted by the Captain's performance in the scenario were assessed by 180 participants in three age groups (18-34, 35-55, and 56

As we see in this symposium, Justice Harry Blackmun is as controversial in death as he was in life. We live in a time of increasing absolutism, where things are either black or white, red or blue, you are either for me or against me, my way or the highway. It is when we are swayed by the sirens of absolutism that we are most likely to make mistakes, for absolutism diminishes our capacity to see nuance, much less to appreciate and account for it in our reasoning. The information revolution has dramatically altered the legal research landscape, expanding the bounds of legal authority. Practitioner research requires more than traditional legal research. It also encompasses factual investigation, non-legal information, interdisciplinary and audience research. Many new lawyers are ill-prepared to research novel and unusual situations, to cope with unwritten laws and local customs, and to meet shifting authority expectations.

Explicating Factors That Foster Civic Engagement Among Students, Masami Nishishiba, Hal T. Nelson, Craig Shinn

This paper investigates many facets of civic engagement by analyzing how college undergraduate students conceptualize civic engagement and by examining factors that predict greater student involvement in political, social, and community affairs.We administered a survey to college students at the beginning of fall, winter, and spring terms, 2001-02.We analyzed survey responses using a structural equation modeling (SEM) technique. The analysis examines how expectations of community and political efficacy, attitudes regarding citizen control of government, and attitudes toward diversity relate to the students’ civic engagement behaviors such as monthly volunteer hours, organizational participation, advocacy, voting, direct political action, and action to …

Multi-Party Mobilization For Adolescent Literacy In A Rural Area: A Case Study Of Policy Development And Collaboration, Edmund T. Hamann, Julie Meltzer

Department of Teaching, Learning, and Teacher Education: Faculty Publications

Between 2001 and 2005, the state of Maine shifted the focus of its statewide high school improvement efforts to include an explicit focus on adolescent literacy. One trigger for that change in focus was a 5-school adolescent literacy initiative previously launched in a rural county under the federal Northeast and Islands Regional Educational Laboratory contract. This monograph describes the multi-party mobilization that led to the creation and implementation of the adolescent literacy project and explains the link between the modest rural effort and the change in state-level reform efforts.

Underlying many of the policy questions about the legal treatment of nonprofit hospitals is one basic issue: Do they act the same as for-profit hospitals - and if not, what are the differences and are they big enough to matter?
