Justifying The Plaintiff's Receipt Of Punitive Damages, Marlisa Moschella Jan 2005

Justifying The Plaintiff's Receipt Of Punitive Damages, Marlisa Moschella

UNLV Retrospective Theses & Dissertations

This thesis addresses the punitive damages reform issue of whether or not the plaintiff should receive the award. Reformers argue the purposes of punitive damages would be better served with other distribution options; and prioritized societal gains, above the gains of the plaintiff. The various purposes of punitive damages show that receipt by the plaintiff is in accordance with original intentions of punitive damages and serves justice. The historical and modern purposes of punitive damages such as vengeance satisfaction, redeeming honor, repairing insult, and supporting 'private attorneys general,' are maintained by the plaintiff receiving damages. These purposes provide an important …

The Role Of Applied Potentials On Cracking Of Zircaloy-2, Unnikrishnan Valliyil Jan 2005

The Role Of Applied Potentials On Cracking Of Zircaloy-2, Unnikrishnan Valliyil

UNLV Retrospective Theses & Dissertations

Consistent with the earlier observation, this investigation revealed that Zircaloy-2 (Zr-2) may exhibit enhanced ductility at elevated temperature when tested under the combined effect of applied stress and an acidic environment. Since the cracking susceptibility of Zr-2 may be influenced by applied potentials, SCC tests were performed in a similar environment under cathodic and anodic controlled potentials (Econt). While the effect of cathodic Econt was insignificant, Zr-2 exhibited enhanced cracking susceptibility when tested under an anodic Econt. The localized corrosion study using cyclic polarization indicates that the critical potentials became more active with increasing temperature. Secondary cracks were noted in …

Effects Of Attentional Focus On Kinematics And Muscle Activation Patterns As A Function Of Expertise, Tiffany L Zachry Jan 2005

Effects Of Attentional Focus On Kinematics And Muscle Activation Patterns As A Function Of Expertise, Tiffany L Zachry

UNLV Retrospective Theses & Dissertations

It has been demonstrated that for motor tasks, an external focus of attention can yield better results than an internal focus of attention. To be more specific, focusing on the effect of the movements seems to be more beneficial to performance and learning than focusing on the movements themselves (for a review, see Wulf & Prinz, 2001). To explain this phenomenon, Wulf, McNevin, and Shea (2001) proposed that an internal focus of attention is less effective because concentrating on the movements interferes with the motor system's attempt to naturally self-organize, the "constrained-action hypothesis." The purpose of this study was to …

Criminogenic Needs And Treatment Considerations For Inmates With Dual Diagnoses, Jennee Evans Dickens Jan 2005

Criminogenic Needs And Treatment Considerations For Inmates With Dual Diagnoses, Jennee Evans Dickens

UNLV Retrospective Theses & Dissertations

Individuals with both a mental illness and substance use disorder (i.e., dual diagnoses) are over represented and underserved in state prisons. Without treatment, inmates with dual diagnoses (DD) are at an increased risk for a variety of negative outcomes, including re-incarceration. Unfortunately, few prison-based treatment programs are designed to meet the special needs of these inmates, and none are empirically supported. Various researchers have stressed the importance of incorporating criminogenic needs into treatment programs to reduce recidivism. The criminogenic needs of inmates with DD have gone largely unstudied. Utilizing a bottom-up approach, the present study offered a first look at …

A Problem-Definition Approach To Stakeholder Interests: A Case Study Of The Zion Lodge Landscape, Zion National Park, Utah, Susan Bahnick Jones

UNLV Retrospective Theses & Dissertations

Environmental decision making seems predisposed to conflict and impasses because it involves complex technical issues and attracts multiple stakeholders. Overcoming an impasse requires a look beyond entrenched positions to identify, clarify, and communicate stakeholders' underlying interests. Problem-definition theory offers one way to clarify those interests. It integrates stakeholder perspectives on problem causes, evidence, harms to affected populations, and solutions; This study proposed an analytic framework for clarifying stakeholders' interests and tested it at Zion National Park. Stakeholders participated in semi-structured research interviews about their ideas for creating a sustainable landscape for the Zion Lodge area. The proposed framework helped stakeholders' …

Between the years of 1870, when construction of the fort began, and 1923, when the fort became a national monument, there existed a fascinating convergence of cultures and ideals that defined as a whole the dynamics of the American West; The body …

Analysis Of Fatty Acids In Soil And Sediments, Deepika P Panawennage Jan 2005

Analysis Of Fatty Acids In Soil And Sediments, Deepika P Panawennage

UNLV Retrospective Theses & Dissertations

Fatty acids are one of the most important classes of naturally occurring organic compounds. Various organisms have distinctive fatty acid profiles. Therefore analyzing fatty acids present in soil and sediments can provide important information on sources of origin of the organic matter; Analysis of fatty acids by gas chromatography requires derivatization to produce a derivative volatile enough for gas chromatography followed by mass spectrometric (GC/MS) analysis. In this work conventional acid catalyzed derivatization methods and tetramethylammonium hydroxide (TMAH) chemopyrolysis methods were examined and compared. Results obtained for Lake Mead sediments show the variation of fatty acids profile with depth, which …

Charm City, Victoria Elizabeth Plasse Jan 2005

Charm City, Victoria Elizabeth Plasse

UNLV Retrospective Theses & Dissertations

Charm City is under construction. It is a space occupied with mutability, free will and perception through physical evidence. This is the ephemeral renovation project of the individual. It is a poetic city trying to articulate what it is to have the rhythms of history and new philosophy manifest into the real. Motion is central to the city and central to the empty space the city has yet to define or occupy. Could Charm City exist outside of America---yes---but the words and sounds would be different. Central to America is motion and central to motion is a guttural voice: an …
