And My Best Friend, My Doctor, Won't Even Say What It Is I'Ve Got: The Role And Significance Of Counsel In Right To Refuse Treatment Cases, Michael L. Perlin

Articles & Chapters

For the past three decades, scholars have carefully considered the scope of the right of involuntarily committed psychiatric patients to refuse the administration of medication from a rich array of perspectives, including, but not limited to, clinical perspectives, civil libertarian perspectives, philosophical perspectives, and political perspectives. Yet, virtually all of this - remarkably - passes over what I believe is the single most important issue in real life. This issue is the most relevant to the actual (as opposed to paper) existence of theright and the actual (as opposed to paper) implementation of that right: the availability and adequacy ofcounsel …

Privacy And The Criminal Arrestee Or Suspect: In Search Of A Right, In Need Of A Rule, Sadiq Reza Jan 2005

Privacy And The Criminal Arrestee Or Suspect: In Search Of A Right, In Need Of A Rule, Sadiq Reza

Articles & Chapters

Criminal accusation stigmatizes. Merely having been accused of a crime lasts in the public eye, damaging one's reputation and threatening current and future employment, relationships, social status, and more. But vast numbers of criminal cases are dismissed soon after arrest, and countless accusations are unfounded orunprovable. Nevertheless, police officers and prosecutors routinely name criminal accusees to the public upon arrest or suspicion, with no obligation to publicize a defendant's exoneration, or the dismissal of his case, or a decision not to file charges against him at all. Other individuals caught up in the criminal process enjoy protections against the public …

The Supreme Court, Democracy And Institutional Reform Litigation, Ross Sandler, David Schoenbrod Jan 2005

The Supreme Court, Democracy And Institutional Reform Litigation, Ross Sandler, David Schoenbrod

Articles & Chapters

In an unexpected portion of its unanimous opinion in Frew v. Hawkins, 540 U.S. 431 (2004), the SupremeCourt broke new ground on an important question involving consent decrees. The case began when Texas state officials invoked the Eleventh Amendment in their resistance to a federal Medicaid consent decree. TheCourt quickly disposed of that argument, but Justice Anthony Kennedy, writing for the unanimous Court, took the opportunity to forcefully state that consent decrees that intrude on the policy making prerogatives of state and local officials more than is necessary to protect rights undercut the effective functioning of elected state and local governments. …

The Impact Of International Human Rights Developments On Sexual Minority Rights, Arthur S. Leonard Jan 2005

The Impact Of International Human Rights Developments On Sexual Minority Rights, Arthur S. Leonard

Articles & Chapters

The Supreme Court's decision in Lawrence v. Texas (2003) marked the first time that tribunal took notice of how foreign and international courts were dealing with the civil rights claims of lesbians and gay men as part of its discussion of American constitutional law. If this evinces a new openness by the Court to looking at such external sources in gay rights cases, what would it find on the major legal issues now facing the LGBT community in the United States? This article summarizes developments abroad on legal recognition of same-sex partners (including for purposes of immigration status) and military …

Biochemical And Molecular Nutrition Blocks As Dietary Supplements In Llamas (Lama Glama) In The Last Third Of The Gestation Period Of The Ceac, Janette Illanes Callejas

Theses and Dissertations

The present work consisted in the use of biochemical and molecular nutrition blocks (BMN) in llamas during the last third of the gestation period, at the Agricultural Experiment Center of Condori (CEAC), located 49 km north of the city of Oruro, and 12 km north of the Caracollo population, in the province of Cercado. For this research work, we used 20 pregnant llamas in the last third of their gestation period, between the ages of 2 and 3 years old, 10 of which belonged to the Khara breed, and 10 to the Thampulli breed. Two corrals of 7 x 7 …

The Church Of Jesus Christ Of Latter-Day Saints In National Periodicals, 1982-1990, Matthew E. Morrison Jan 2005

The Church Of Jesus Christ Of Latter-Day Saints In National Periodicals, 1982-1990, Matthew E. Morrison

Theses and Dissertations

The Church of Jesus Christ of Latter-day Saints has continued to receive exposure in national periodicals. This thesis will explore that image from 1982 to 1990. During those years, the church continued to grow in membership and expand its existing programs.

National periodicals can assist in assessing the public image of the Church because they help "mould public attitudes by presenting facts and views on issues in exactly the same way at the same time throughout the entire country." In this manner, they help to form the public opinion about the Church. They also reflect existing opinions because magazine publishers …

A Legal Remedy For Homophobia: Finding A Cure In The International Right To Health, Michael Boucai Jan 2005

A Legal Remedy For Homophobia: Finding A Cure In The International Right To Health, Michael Boucai

Journal Articles

This article argues that the international right to health obligates governments to combat homophobia. Part One presents the powerful evidence that stigma, prejudice, and violence directed toward lesbian and gay people drastically endanger their physical and mental well-being. Part Two defends an expansive interpretation of the international right to health. Applying this interpretation, Part Three proposes that gay men and lesbians are entitled to demand that their governments to eliminate all public and much private discrimination against gay men and lesbians, and requires them to combat homophobia through education and other positive efforts. Acknowledging that this obligation is unlikely to …

Platelet endothelial cell adhesion molecule-1 (PECAM-1) is a cell surface glycoprotein receptor expressed on a range of blood cells including platelets, and is also on vascular endothelial cells. PECAM-1 possesses adhesive and signalling properties, the latter being mediated by an Immunoreceptor Tyrosine-based Inhibitory Motif present on the cytoplasmic tail of the protein. Recent studies in vitro have demonstrated that PECAM-1 signalling inhibits the aggregation of platelets. In the present study we have utilised PECAM-1 deficient mice and radiation chimeras to investigate the function of this receptor in the regulation of thrombus formation. Using intravital microscopy and laser induced injury to …

Network-Centric First Responder Architecture With Swarming Robots Entity, Lakshmanan Meyyappan, Cihan H. Dagli Jan 2005

Network-Centric First Responder Architecture With Swarming Robots Entity, Lakshmanan Meyyappan, Cihan H. Dagli

Engineering Management and Systems Engineering Faculty Research & Creative Works

This paper proposes a new network centric architecture that can be used by first responders to effectively respond to crisis situations. The powerful network-centric concept originally developed for and mainly used in the military environment, can be effectively used for civilian security and emergency response missions. This paper also proposes the use of a swarm of intelligent robots as a part of the network-centric architecture to aid the first responders. The swarm of robots works in tandem with the first responders and provides them with the necessary information on a real time basis. The proposed network centric architecture with a …
