Why Do Supreme Court Justices Succeed Or Fail - Harry Blackmun As An Example, Lawrence S. Wrightsman, Justin R. La Mort

Missouri Law Review

At present, 108 Justices have served on the United States Supreme Court. Some have clearly been successes as judges, while a few have clearly not, and a large number are cast into that middle, "satisfactory" or "average," category. The purpose of this paper is to propose, examine, and evaluate specific factors as determinants of judicial success, and then to consider Justice Harry Blackmun's place on a continuum of successes and failures. At a time when many are worried that the United States is experiencing a general decline in civic and political engagement, volunteering appears particularly strong among today’s young people. While volunteering is just one form of community involvement, research has shown that it is often connected to other forms of engagement, and, among youth, volunteering plays a valuable role in shaping how youth learn to interact with their community and develop the skills, values, and sense of empowerment necessary to become active citizens.

A Refutation Of Racial Differentials In The Juvenile Recidivism Rate Hypothesis, Jospeter M. Mbuba

African Journal of Criminology and Justice Studies

It has repeatedly been argued that race is an important predictor of juvenile recidivism, invariably with black offenders having significantly higher odds of recidivating than white offenders (DeComo, 1998; Strom, 2000; Benda, 2001; Langan & Levin, 2002; Harms, 2003; Pope and Snyder, 2003; Puzzanchera, 2003; Stahl, 2003). This study refutes that assertion. Using data from the Department of Public Safety and Corrections in the state of Louisiana, a total of 2,810 juvenile offenders released in the 1999/2000 fiscal year were examined and a socio-demographic profile of those who were returned into the correctional system one year post release was established. …

Brave New School: A Constitutional Argument Against State-Mandated Mental Health Assessments In Public Schools, Jennifer H. Gelman

Northern Illinois University Law Review

This comment examines the constitutionality of emotional health assessments in public schools. Despite the Supreme Court's recognition nearly a century ago that parents have a right to control the education of their children, American courts have grown increasingly hostile to parental interests in conflicts between parent and school. The author explores the possibility that the Court's reaffirmation of parental rights in Troxel v. Granville (2003) could be invoked in certain cases to reverse that trend. It is argued, in particular, that parental objections to school involvement in emotional health determinations ought to merit some form of heightened scrutiny.

The problem addressed in this paper is to find out if the application of missional principles in the Episcopal Diocese of Oregon can revitalize this diocese, direct the diocese to missional ends, and provide applications for similar situations in other dioceses. This investigation assumes that the existing infrastructure of the diocese has intrinsic value for mission if it can become focused on God's mission as its primary end. OBJECTIVE: To assess the frequency of Klebsiella pneumoniae (K. pneumoniae) recovery from clinical specimens from hospital and community patients, their antibiotic profile, the extent of extended-spectrum beta lactamase (ESBL) production among such isolates, and the impact on patient management. METHODS: The study recovered 1,118 K. pneumoniae strains from various clinical specimens from hospital and community patients, from 1995 to 2004, at the Eric Williams Medical Sciences Complex. All 1,118 isolates underwent testing for multi-antibiotic resistance, of which 480 that fulfilled the criteria for possible ESBL production underwent further examination, according to guideline recommendations of the National Committee for Clinical Laboratory …

OBJECTIVE: This study focuses on the genetic aspect of beta-thalassemia among 88 at risk couples from the West Bank and Gaza, and the attitude of these couples toward prenatal diagnosis and its outcome as a preventive method. METHODS: We tested 130 prenatal samples for beta-thalassemia during the period from January 1999 to July 2005. We performed prenatal diagnosis in these cases using the amplification refractory mutation system, as well as beta-globin gene sequencing as a conformational method. AIM:

To investigate the prevalence of giardiasis in patients with dyspeptic symptoms.

METHODS:

Clinical records of consecutive patients who attended Gastroenterology Department at Aga Khan University Hospital from January 2000 to June 2003 and had esophagogastroduodenoscopy (EGD) with duodenal biopsies and international classification of diseases 9th revision with clinical modifications (ICD-9-CM) coded with giardiasis were studied.

RESULTS:

Two hundred and twenty patients fulfilled the above criteria. There were 44% (96/220) patients who were giardiasis positive, 72% (69/96) of them were males and 28% (27/96) of them were females. There were 65% (81/124) males and 35% (43/124) females who were giardiasis …

This article argues that Article I courts can use equitable principles to provide individuals who have been victimized by corrupt behavior of government attorneys with a remedy. Article III courts have struggled to define the powers of Article I courts in a way that does not do violence to the petition clause, the appropriations clause, or the takings clause, sometimes concluding that petitioners were entitled to no relief when the government had violated some right of the petitioners. How We Got Where We Are: A Look At Informed Consent In Colorado--Past, Present, And Future, R. Jason Richards

This article examines the historical development of the doctrine of informed consent in this country, paying specific attention to its evolution in Colorado. In doing so, the author examines the two theories of patient disclosure that have emerged over time-the "professional standard" and the "reasonable patient standard." The article analyzes the legal and practical justifications of each approach in light of the contemporary doctor/patient relationship and concludes that the best way to protect patient autonomy rests with in- formed decision-making, which can only be accomplished by adopting the reasonable patient standard of disclosure in Colorado.

The Federal Common Law Of Foreign Relations, Joel M.L. Huotari

This comment asserts that mere foreign policy implications should not be enough to establish federal jurisdiction over the litigation of an otherwise exclusively state law claim, as some circuits have allowed. The Second, Fifth and Eleventh Circuits have allowed such state law claims to be removed to the federal courts. The Ninth Circuit, however, rejects the proposal that the federal courts are somehow better equipped to hear cases which implicate foreign policy concerns. Questions of foreign policy are generally not the subject matter of the judicial branch, but of the legislative and executive branches. Members of Congress and of the …
