Construction Law, K. Brett Marston, J. Barrett Lucy

University of Richmond Law Review

Since the last survey of this topic published in the fall of 2000, construction law in Virginia has continued to evolve in an array of areas involving issues such as claims on surety bonds, claims against public entities, construction-related products like Exterior Insulation Finishing Systems ("EIFS"), and mechanic's liens. These changes have implicated and better defined legal principles including the "no damage for delay" clause on public contracts, requirements for privity in breach of warranty claims, and implied indemnification. The significant issues in construction law have arisen both in a number of significant judicial decisions, mostly from the Supreme Court …

Labor And Employment Law, W. David Paxton, Gregory R. Hunt Nov 2005

Labor And Employment Law, W. David Paxton, Gregory R. Hunt

University of Richmond Law Review

It was a relatively quiet year in the Virginia labor and employment law arena, with no real groundbreaking cases or legislative enactments. There were developments in case law and legislative changes, but these were more subtle this year than in years past, and for the most part, the courts confirmed, affirmed, or clarified the existing state of the law. This article discusses cases and legislative activity of note in the Virginia labor and employment law arena during the past year. Part II addresses recent cases considering employment agreements under Virginia law. Part III considers cases in the continually evolving area …

Wills, Trusts, And Estates, J. Rodney Johnson

University of Richmond Law Review

The General Assembly enacted legislation dealing with wills, trusts, and estates that added or amended a number of sections of the Virginia Code in its 2005 Session. In addition, there were two opinions from the Supreme Court of Virginia that presented issues of interest to the general practitioner as well as to the specialist in wills, trusts, and estates during the period covered by this review. This article reports on all of these legislative and judicial developments.

Effects Of Gramicidin-A On The Adsorption Of Phospholipids To The Air–Water Interface, Samares C. Biswas, Shankar B. Rananavare, Stephen B. Hall Nov 2005

Effects Of Gramicidin-A On The Adsorption Of Phospholipids To The Air–Water Interface, Samares C. Biswas, Shankar B. Rananavare, Stephen B. Hall

Chemistry Faculty Publications and Presentations

Prior studies suggest that the hydrophobic surfactant proteins, SP-B and SP-C, promote adsorption of the lipids in pulmonary surfactant to an air–water interface by stabilizing a negatively curved rate-limiting structure that is intermediate between bilayer vesicles and the surface film. This model predicts that other peptides capable of stabilizing negative curvature should also promote lipid adsorption. Previous reports have shown that under appropriate conditions, gramicidin-A (GrA) induces dioleoyl phosphatidylcholine (DOPC), but not dimyristoyl phosphatidylcholine (DMPC), to form the negatively curved hexagonal-II (HII) phase. The studies reported here determined if GrA would produce the same effects on adsorption of DMPC and …

The C-C chemokine receptor 5, 32 base-pair deletion (CCR5-Δ32) allele confers strong resistance to infection by the AIDS virus HIV. Previous studies have suggested that CCR5-Δ32 arose within the past 1,000 y and rose to its present high frequency (5%–14%) in Europe as a result of strong positive selection, perhaps by such selective agents as the bubonic plague or smallpox during the Middle Ages. This hypothesis was based on several lines of evidence, including the absence of the allele outside of Europe and long-range linkage disequilibrium at the locus. We reevaluated this evidence with the benefit …

Dural Metastases Presenting As An Extradural Hematoma: A Rare Presentation, Muhammad Shahzad Shamim, Muhammad Ehsan Bari, S. Ather Enam

Department of Surgery Docs

Abstract

We report a case of an elderly man who presented with hemiparesis and plain CT scan findings highly suggestive of an extradural hematoma as the underlying cause. This patient was later found to have dural metastases secondary to bronchogenic carcinoma. Dural metastases are rare, usually presenting as dural mass, but may also present as chronic subdural or extradural hematoma on non contrast CT scan, leading to an erroneous diagnosis in the unsuspecting.

An Introductory Essay: Are We In “The Age Of Resistance” In A Post-9/11 World?, J. P. Linstroth

Peace and Conflict Studies

This introductory article to the Special Issue of Peace and Conflict Studies asks, “are we in the ‘Age of Resistance’ in a post-9/11 world?” It is argued the concept of “resistance” may be framed in a broad theoretical context to include multiple and contested meanings by social and political actors as well as by scholars and through intellectual debate. The article questions recent ideas prevalent in fauxpolitical science studies which promote a clash of civilizations, essentialize histories, support anachronistic Orientalist-approaches, and bolster foreign policy initiatives by removing the human element. The contention is for researchers and theorists to concentrate on …

Uncertainty And Informed Choice: Unmasking Daubert, Margaret A. Berger, Aaron D. Twerski

Michigan Law Review

This Article will first examine why it is that plaintiffs have been unable to prove causation under the Daubert guidelines in toxic tort litigation. Second, it will look at the two existing models for informed choice litigation medical malpractice and products liability-and demonstrate why neither of these models gives toxic tort plaintiffs a fair opportunity to recover for the deprivation of patient autonomy against drug manufacturers who have breached their duty to warn of known or knowable risks. Finally, this Article will explore the elements of a causation-free informed choice cause of action. It will suggest the appropriate standard for …

The Availability Heuristic, Intuitive Cost-Benefit Analysis, And Climate Change, Cass R. Sunstein Nov 2005

The Availability Heuristic, Intuitive Cost-Benefit Analysis, And Climate Change, Cass R. Sunstein

Coase-Sandor Institute for Law & Economics Research Paper Series

Because risks are on all sides of social situations, it is not possible to be "precautionary" in general. The availability heuristic ensures that some risks stand out as particularly salient, whatever their actual magnitude. Taken together with intuitive cost-benefit balancing, the availability heuristic helps to explain differences across groups, cultures, and even nations in the assessment of precautions to reduce the risks associated with climate change. There are complex links among availability, social processes for the spreading of information, and predispositions. If the United States is to take a stronger stand against climate change, it is likely to be a …

Attention Felons: Evaluating Project Safe Neighborhood In Chicago, Andrew V. Papachristos, Tracey L. Meares, Jeffrey Fagan

Coase-Sandor Institute for Law & Economics Research Paper Series

This research uses a quasi-experimental design to evaluate the impact of Project Safe Neighborhood (PSN) initiatives on neighborhood level crime rates in Chicago. Four interventions are analyzed: (1) increased federal prosecutions for convicted felons carrying or using guns, (2) the length of sentences associated with federal prosecutions, (3) supply-side firearm policing activities, and (4) social marketing of deterrence and social norms messages through justice-style offender notification meetings. Using an individual growth curve models and propensity scores to adjust for non-random group assignment, our findings suggest that several PSN interventions are associated with greater declines of homicide in the treatment neighborhoods …

Beyond Marbury: The Executive's Poer To Say What The Law Is, Cass R. Sunstein Nov 2005

Beyond Marbury: The Executive's Poer To Say What The Law Is, Cass R. Sunstein

Coase-Sandor Institute for Law & Economics Research Paper Series

Under Marbury v. Madison, it is "emphatically the province and duty of the judicial department to say what the law is." But as a matter of actual practice, statements about "what the law is" are often made by the executive department, not the judiciary. In the last quarter-century, the Supreme Court has legitimated the executive's power of interpretation, above all in Chevron v. Natural Resources Defense Council, the most-cited case in modern public law. Chevron reflects a salutary appreciation of the fact that the executive is in the best position to make the judgments of policy and principle on which …

Regional Cooperation In Mine Action: The Case Of South-Eastern Europe, Gichd Nov 2005

Regional Cooperation In Mine Action: The Case Of South-Eastern Europe, Gichd

Global CWD Repository

Mine action has tended to develop on a national basis. However, the experience of South-Eastern Europe has shown that a broader, regional approach can bring greater effectiveness and efficiency to mine action projects and programmes.

The main achievements of this regional approach have been to lower costs for demining (especially through international competitive bidding) while seeking to promote a high quality of work, in particular through the quality management processes of the International Trust Fund for Demining and Mine Victims Assistance (ITF). The ITF also believes that its work has improved donor strategies for the region as well as priority …

Macro Promises Of Microcredit: A Case Of A Local Esusu In Rural Ghana, Carolette Norwood Nov 2005

Macro Promises Of Microcredit: A Case Of A Local Esusu In Rural Ghana, Carolette Norwood

Journal of International Women's Studies

Microcredit’s three big promises are one, to reduce poverty; two, to empower women; and three, to enhance family planning knowledge, attitudes and practices. Using a mixed-method approach, this study examines 204 women members and non-members of local eSusus in rural Ghana. Quantitative chi square analysis indicates no associations between membership in an eSusu and relative wealth; women’s autonomy family planning practices, knowledge or use and reproductive control. Meanwhile, the qualitative data shows that women members believe that eSusu are extremely useful for acquiring working capital to be reinvested in their small market ventures, and are helpful with school fee and …

The Role Of Size And Defensive Compounds In Mate Choice By Nyssodesmus Python (Polydesmida: Platyrhacidae), November 2005, Mercedes Burns

Monteverde Institute: Tropical Ecology and Conservation

Large mates are preferred in a variety of species, presumably because larger size typically confers greater fitness. In chemically protected species, mates may prefer more toxic partners for the same reason. The common forest millipede Nyssodesmus python displays sexual dimorphism in body size and also produces a defensive compound containing hydrogen cyanide, making it an organism well suited to an experiment on mate preferences highlighting both size and presence of defense compounds. Here, 32 mate choice experiments showed a statistically significant preference between both sexes for larger mates; however, preference for mates with differing hydrogen cyanide ranks (based on a …

Database Of The Macrofungi Of The Monteverde Reserve, November 2005, Corey Rogers Nov 2005

Database Of The Macrofungi Of The Monteverde Reserve, November 2005, Corey Rogers

Monteverde Institute: Tropical Ecology and Conservation

Fungi serve important roles in natural systems and have strong economic and social consequences for human populations. A database of the macrofungi of the Monteverde Reserve was created to ease identification and facilitate research on local macrofungi. The database includes 30 species, with 18 families and 22 genera represented. The database was organized in a system of nested folders, providing both morphological and taxonomic keys. Information files were created for each species, including digital photographs of specimens and spore prints (when applicable), and taxonomic, microhabitat, growth, and morphological data. This database provides a structure for future cataloguing and identification, with …
