Special Allocations And Preferential Distributions In Joint Ventures Involving Taxable And Tax Exempt Entities, Darryll K. Jones
Special Allocations And Preferential Distributions In Joint Ventures Involving Taxable And Tax Exempt Entities, Darryll K. Jones
Journal Publications
Joint ventures involving taxable and tax-exempt organizations, referred to in this article as "taxable-tax exempt joint ventures," engender conflict between the doctrinal requirements pertaining to tax exemption and the flexibility afforded joint ventures in Subchapter K.' The nonprofit partner must exercise ultimate governing control over the joint venture so that charitable goals take precedence over profit-seeking goals if the nonprofit's share of income is to remain tax exempt. On the other hand, a for-profit partner is entitled and indeed expected to pursue profit but its lack of control over the joint venture exposes the for-profit partner to greater risk of …
The Ultimate Best Interest Of The Child Enures From Parental Reinforcement: The Journey To Family Integrity, John C. Duncan Jr.
The Ultimate Best Interest Of The Child Enures From Parental Reinforcement: The Journey To Family Integrity, John C. Duncan Jr.
Journal Publications
Most Americans agree that we are in the midst of a dangerous decline in moral and religious values that threatens the very foundation of our society. The facts are clear: marriage as a social institution is threatened and child well-being is affected. Part II of this Article traces the best interest of the child doctrine. Part III examines what the legally recognized rights of parents have been in the past and shows how those rights have been threatened or altogether eradicated in the best interest of the child. Part IV evaluates the opposing positions of both parental rights advocates …

Four Questions On Critical Race Praxis: Lessons From Two Young Lives In Indian Country, Christine Zuni Cruz
Four Questions On Critical Race Praxis: Lessons From Two Young Lives In Indian Country, Christine Zuni Cruz
Faculty Scholarship
The Critical Race Lawyering Symposium in New York City brings me from Albuquerque, New Mexico. As I travel the day before the symposium, I reflect on the amount of time it will take. I leave Albuquerque at 8:23 a.m. and I am scheduled to arrive in New York City at 4:05 p.m., via Chicago. Given the two-hour time difference between the East Coast and the Rocky Mountain regions, I begin my day boarding the plane as the sun is rising in the morning sky and end it at my destination where the sun is setting. Even in this day and …

Lawyers, Justice And The Challenge Of Moral Pluralism, Katherine R. Kruse
Lawyers, Justice And The Challenge Of Moral Pluralism, Katherine R. Kruse
Scholarly Works
The debate over whether it serves or undermines the interests of justice for lawyers to temper the zeal of their advocacy based on considerations of morality or justice has largely been polarized between two camps: traditionalists and moralists. Traditionalists defend the amoral role of lawyers, arguing that lawyers should remain moral neutral in their representation of clients. Moralists propose alternative social justice lawyering models, which urge lawyers' morally engagement in their choice of clients, their interpretation of law, and their counseling of clients.
This article revisits the debate by recasting the question at its center. Instead of inquiring what a …

Effects Of An 8-Week Training Program On Performance In Female High School Volleyball Players, Richard Armstrong
Open Access Master's Theses
The purpose of this study was to determine the effects of an 8-week training program on performance measures in high school aged female volleyball players. Twenty-five female volleyball players from the Rhode Island Junior Rams volleyball club program (mean age 15.6 ± 1.15) completed the study. The subjects trained two nights per week for 8 weeks using different methods of resistance training techniques. The resistance training program involved a full body workout consisting of 2 sets of 10 exercises during each training session. Training sessions took place on court during normal practice times for the club teams using affordable and …

Cultural Values Among Mexican And Mexican-Americans Across Acculturation, Language, Generation, Age And Gender, Natalie K. Bellman
Open Access Master's Theses
The Latino population in the United States has been consistently growing over the past few years and it is estimated that it will only increase in greater numbers in the future (U.S. Census Bureau, 2002). Individuals of Mexican descent are the largest group amongst Latinos. Along with the growth of this population has come an ever-increasing need for the provision of high quality mental health services. One of the challenges often found by providers is the difference in culture between the provider and the client (Sharma & Kerl, 2001). The cultural values of familismo, personalismo, and machismo are …
Weight Loss And Health Outcome Differences Between African Americans And Caucasions Following Gastric Bypass Surgery, Wendy A. Anderson
Weight Loss And Health Outcome Differences Between African Americans And Caucasions Following Gastric Bypass Surgery, Wendy A. Anderson
Open Access Master's Theses
Background: Data suggest that African Americans lose less weight and show fewer improvements in cardiovascular diseases such as blood pressure following gastric bypass surgery (GBP).
Objective: The purpose of this study was to describe differences in weight loss between Caucasian and African American patients following GBP and to identify if these differences are related to dietary intake. This study also sought to identify differences in blood pressure and serum lipid levels between African Americans and Caucasians after GBP.
Methods and Subjects: This was a retrospective database review of a sample of 84 adult patients, 24 African American and 60 Caucasian …

Geospatial Identification Of Potential Environmental Justice Concerns: Providence, Rhode Island, Joshua L. Tootoo
Geospatial Identification Of Potential Environmental Justice Concerns: Providence, Rhode Island, Joshua L. Tootoo
Open Access Master's Theses
In the early 1990's social activists driven by a concern with the uneven impacts of toxic pollution drew the attention of federal policy makers, establishing an official discourse focused on the issue of environmental justice. The concerns of these activists were supported by a number of statistical and Geographic Information System (GIS)-based studies of demographic patterns and toxic sites (Foreman, 1998).
The concept of environmental justice is based on the premise that disadvantaged groups such as the poor and racial and ethnic minorities bear a disproportionate burden of the negative externalities associated with economic development, including toxic pollution exposure …

Abnormalities In The Ozark Hellbender, (Cryptobranchus Alleganiensis Bishopi) In Arkansas: A Comparison Between Two Rivers With A Historical Perspective, Waylon R. Hiler, Benjamin A. Wheeler, Stanley E. Trauth
Journal of the Arkansas Academy of Science
We documented abnormalities of Ozark hellbender (Cryptobranchus alleganiensis bishopi) populations in the Eleven Point River (Randolph County, Arkansas) and the Spring River (Fulton County, Arkansas) as part of ongoing monitoring efforts in this species. We found abnormalities in 90% (9 of 10) and 40% (36 of 97) of hellbenders in the Spring River and Eleven Point River, respectively, during the 2003-2004 field seasons. Most abnormalities found in Eleven Point hellbenders were generally less invasive and seemed to be more intrinsic to the species' natural history (i.e., vicissitudes of living), whereas those found in Spring River hellbenders were gross morphological aberrations. …
Mapping Of Ssdna Nicks Within Dsdna Genomes By Two-Dimensional Gel Electrophoresis, Wayne P. Wahls, K. Mark Dewall, Mari K. Davidson
Mapping Of Ssdna Nicks Within Dsdna Genomes By Two-Dimensional Gel Electrophoresis, Wayne P. Wahls, K. Mark Dewall, Mari K. Davidson
Journal of the Arkansas Academy of Science
DNA molecules within chromosomes undergo constant, dynamic changes yet maintain the integrity of the primary DNA sequence. DNA replication, adjustment of helical density, resolution of catenenes, repair of DNA damage, and homologous recombination each involve breakage and religation of the phosphate backbone of the double helix. Although the analysis of dsDNA breaks is facile, the analysis of ssDNA nicks is not. The principal impediment is that conventional, one-dimensional electrophoresis methods cannot readily detect ssDNA nicks in the context of dsDNA breaks. We therefore developed a two dimensional (native/denaturing) gel electrophoresis approach to map the positions of ssDNA nicks. Analysis of …

Misuse Of Myth: Conscious Adherence Or Authoritative Control Mechanism, Henry H. Averhart Jr.
Misuse Of Myth: Conscious Adherence Or Authoritative Control Mechanism, Henry H. Averhart Jr.
McNair Scholars Journal
Myths are significant in explaining the existential questions of life, but when they are adopted uncritically, they may generate more harm than good. Admittedly, there is no way out of myth; we are the mythical creature. We need, therefore, to become more aware of myth and more critical of the myths we already, if only unknowingly, have adopted. This research addresses common misconceptions of the definitions of myths, attempts to identify the conscious and unconscious use of myths in our daily lives, and ultimately introduces the concept of modified myth adoption. This is done by analyzing and synthesizing selected scholarly …
Attention Deficit Hyperactivity Disorder (Adhd) And Ethnicity: A Literature Review, Shanel M. Bryant
Attention Deficit Hyperactivity Disorder (Adhd) And Ethnicity: A Literature Review, Shanel M. Bryant
McNair Scholars Journal
Attention Deficit Hyperactivity Disorder (ADHD) is one of the most expensive mental disorders, costing U.S. citizens $77 billion every year (Reinberg, 2004). Although ADHD effects between 3-7% of U.S. children (American Psychiatric Association [APA], 2000), there are many misconceptions about the disorder and concerns have been raised regarding appropriate diagnosis and treatment in children, adolescents, and adults. In addition to these concerns, several authors have noted that there is a lack of research regarding ethnicity and ADHD. The limited research that has been done is confusing with some studies indicating that there is no difference in rates of ADHD diagnoses …

Adrift On A Sea Of Troubles: Cross-Border Art Loans And The Specter Of Ulterior Title, Norman Palmer
Adrift On A Sea Of Troubles: Cross-Border Art Loans And The Specter Of Ulterior Title, Norman Palmer
Vanderbilt Journal of Transnational Law
The purpose of this Article is to show how modern law responds to such challenge. In particular, it examines the means by which common law systems manage the return of unlawfully removed cultural objects to dispossessed parties, and the implications of those means for international loan agreements. Regard is paid to the remedies that may be available in the aftermath of a claim, and the "self-help" devices that are available to lenders and borrowers. Some of the measures examined are peculiar to cultural objects, but others are general. Some have no direct relation to law, but work on voluntary regulation. …
