What Happened At Hopkins: The Creation Of The Intersex Management Protocols, Alison Redick Jan 2005

What Happened At Hopkins: The Creation Of The Intersex Management Protocols, Alison Redick

Cardozo Journal of Equal Rights & Social Justice

The article examines the development of intersex management protocols at Johns Hopkins University, highlighting their significance as a pivotal shift in medical treatment and the conceptual understanding of sex and gender. It argues that these protocols, introduced by John Money and his team in 1955, moved away from a case-by-case approach to a standardized method, influenced by Money's theory of gender acquisition, which emphasized environmental factors over biological ones. The protocols aimed to enforce binary gender norms through practices like early surgical interventions, which the article critiques as flawed and harmful.

Radical Tweak-Relocating The Power To Assign Sex, Elizabeth Reilly Jan 2005

Radical Tweak-Relocating The Power To Assign Sex, Elizabeth Reilly

Cardozo Journal of Equal Rights & Social Justice

The article argues that the legal system's enforcement of binary sex classification perpetuates harm against intersex individuals by mandating sex assignment at birth and enabling non-consensual medical interventions. It proposes removing sex designation from birth certificates to allow individuals to self-identify their sex later in life, promoting autonomy and reducing harm.

Sharply Drawn Lines: An Examination Of Title Ix, Intersex, And Transgender, Emily Q. Shults Jan 2005

Sharply Drawn Lines: An Examination Of Title Ix, Intersex, And Transgender, Emily Q. Shults

Cardozo Journal of Equal Rights & Social Justice

The article advocates for a broader interpretation of Title IX to protect transgender and intersex individuals from discrimination in educational settings. It argues that the current legal framework's rigid binary understanding of sex and gender is outdated and harmful, and that discrimination based on gender identity and expression constitutes sex discrimination under Title IX. The author emphasizes the need for legal adaptation to recognize the fluidity of sex and gender.

Approaching Critical Mass: An Exploration Of The Role Of Intersex Allies In Creating Positive Education, Advocacy And Change, Moonhawk River Stone M.S.

Cardozo Journal of Equal Rights & Social Justice

The purpose of this article is to explore the role of allies working on behalf of intersex people. The article approaches this exploration from various perspectives that have informed the author's ally work with intersex issues for more than ten years. First, the author begins with the personal perspective and the way in which the author became an ally of intersex people. Second, the article discusses the perspective of psychological trauma, the tapestry of which is interwoven through all aspects of intersex history and experience. Third, the author delineates ally attitudes, behaviors, and tasks that are important when one is …

Finders-Keepers: A Bright-Line Rule Awarding Custody To Gestational Mothers In Cases Of Fertility Clinic Error, Josh Deutsch Jan 2005

Finders-Keepers: A Bright-Line Rule Awarding Custody To Gestational Mothers In Cases Of Fertility Clinic Error, Josh Deutsch

Cardozo Journal of Equal Rights & Social Justice

The note advocates for the adoption of a "gestational brightline rule" to resolve custody disputes arising from fertility clinic errors, arguing that this approach provides legal clarity, avoids emotional harm, and withstands constitutional scrutiny. It critiques the intent test for its inadequacy in such cases and proposes that the gestational mother should be awarded custody, with exceptions for cases involving felony or substance abuse by the birth mother. The rule is justified by the gestational mother's physiological and emotional connection to the child, as well as the need to prevent legal uncertainty and reduce litigation costs.

Do Prisoners Get A Better Deal? Comparing The Abortion Rights And Access Of Military Women Stationed Abroad To Those Of Women In Prison, Leah Ginsberg Jan 2005

Do Prisoners Get A Better Deal? Comparing The Abortion Rights And Access Of Military Women Stationed Abroad To Those Of Women In Prison, Leah Ginsberg

Cardozo Journal of Equal Rights & Social Justice

The note examines the systemic barriers faced by military women and incarcerated individuals in accessing abortion services, despite Supreme Court rulings that establish a woman's right to abortion. It highlights how statutory bans, restrictive policies, and logistical challenges disproportionately affect these groups, arguing that their unique circumstances—such as overseas deployment or incarceration—subject them to additional layers of legal and practical obstacles. The analysis underscores the need for legislative or executive action to address these inequities and ensure constitutional rights are upheld.

Intersex Education, Advocacy & The Law: The Struggle For Recognition And Protection, Erin Lloyd

Cardozo Journal of Equal Rights & Social Justice

The report addresses the lack of recognition and protection for intersex individuals, highlighting the controversial medical practices and legal challenges they face. It advocates for a shift from non-consensual surgeries to a more informed, rights-based approach, emphasizing the need for legal reforms and societal acceptance.

The Alchemy Of A Moral Discourse About The Biology Of Gender: Historical Sensitivity, Genetic Literacy, And The Will To Imagine A Different Equality, Doriane Lambelet Coleman Jan 2005

The Alchemy Of A Moral Discourse About The Biology Of Gender: Historical Sensitivity, Genetic Literacy, And The Will To Imagine A Different Equality, Doriane Lambelet Coleman

Cardozo Journal of Equal Rights & Social Justice

The article explores the intersection of biology, genetics, and gender, emphasizing the need for a cautious and informed approach when integrating scientific findings into legal and social policies. It highlights the historical misuse of science to justify discrimination and advocates for a nuanced understanding that balances genetic insights with ethical considerations. The author proposes moving beyond a one-size-fits-all model of equality to one that accommodates differences, ensuring equitable opportunities for all.

The Xxx-Files: Cal/Osha's Regulatory Response To Hiv In The Adult Film Industry, Christina Jordan

Cardozo Journal of Equal Rights & Social Justice

The note examines the challenges in regulating California's straight adult film industry following an HIV outbreak, highlighting tensions between the industry's resistance to regulation and CalOSHA's efforts to enforce workplace safety standards. It critiques the industry's reliance on self-regulation and explores the legal implications of determining whether performers are employees or independent contractors. The analysis underscores the potential public health consequences of inadequate oversight and the industry's threats to evade regulation by moving underground.

Home Alone: Children Of Incarcerated Mothers In New York City Under The Rockefeller Drug Laws, Aron M. Zimmerman Jan 2005

Home Alone: Children Of Incarcerated Mothers In New York City Under The Rockefeller Drug Laws, Aron M. Zimmerman

Cardozo Journal of Equal Rights & Social Justice

The Rockefeller Drug Laws of 1973, among the harshest in the nation, have failed to reduce drug trafficking or abuse and have instead led to unjust outcomes, disproportionately impacting racial minorities and women. These laws, which mandate draconian sentences based solely on drug type and quantity, tie judges' hands and prioritize incarceration over treatment, despite evidence that treatment is more cost-effective and reduces recidivism. Recent reforms offer some progress, but significant systemic changes are needed to address the laws' ongoing harm and restore judicial discretion in sentencing.

Supercritical Fluid Extraction Of Rice Bran With Adsorption On Rice Hull Ash, Paresh Manilal Patel Jan 2005

Supercritical Fluid Extraction Of Rice Bran With Adsorption On Rice Hull Ash, Paresh Manilal Patel

LSU Doctoral Dissertations

Rice bran oil was extracted using environmentally-friendly supercritical carbon dioxide at varying conditions. Experimental treatments included pressure (27.6, 41.4 and 55.2 MPa), temperature (40 and 60 oC) and flow rates (25, 45 and 65 g/min) of supercritical carbon dioxide. Extracts collected at different time intervals during 4-hour extraction runs in a 3-L extractor were analyzed for oil yield and antioxidants. Normal-phase HPLC was used for analyzing the extract for important antioxidant compounds of oryzanol, tocopherols, tocotrienols. Silica rich rice hull ash adsorbent was also incorporated in combined extraction-adsorption experiments under similar supercritical fluid conditions. Supercritical extraction yields of rice bran …

Boston's Settlement Housing: Social Reform In An Industrial City, Meg Streiff Jan 2005

Boston's Settlement Housing: Social Reform In An Industrial City, Meg Streiff

LSU Doctoral Dissertations

Between the Civil War and World War I, American cities underwent dramatic changes: they changed in shape, they changed in size, they changed in terms of who was there, and how those individuals were distributed through the city. The driving force behind these urban morphological changes was industrialization – and the emergence of industrial slums on the edges of expanding business districts. These industrial slums were widely believed to breed disease, crime, intemperance, and immorality – external costs that were being born by the entire society. Yet American society and American philanthropic institutions were not prepared to deal with the …

The Lived Experience Of New Graduate Baccalaureate-Prepared Registered Nurses Working In An Acute Care Hospital Setting, Jeannie Ricks Harper Jan 2005

The Lived Experience Of New Graduate Baccalaureate-Prepared Registered Nurses Working In An Acute Care Hospital Setting, Jeannie Ricks Harper

LSU Doctoral Dissertations

The purpose of this study was to explore the lived experience of new graduate baccalaureate prepared Registered Nurses (RNs) who work in an acute care hospital setting. The study was a phenomenological qualitative research design, with researcher-developed guiding questions to help direct the interviews. Participants had passed the National Council for Licensure Examination for Registered Nurses (NCLEX-RN), and had been practicing from three months to one year. Eight RNs participated in the study, with seven usable interviews. Results found that new graduate RNs experience multiple stressors as they acclimate to their new roles. The primary stressors that were identified by …

Feminism In Frances Trollope's Domestic Manners Of The Americans, The Vicar Of Wrexhill, The Life And Adventures Of Jonathan Jefferson Whitlaw And Jessie Phillips, Jessica S. Boulard Jan 2005

Feminism In Frances Trollope's Domestic Manners Of The Americans, The Vicar Of Wrexhill, The Life And Adventures Of Jonathan Jefferson Whitlaw And Jessie Phillips, Jessica S. Boulard

LSU Master's Theses

In The Domestic Manners of the Americans (1832), the travelogue that launched Trollope's career as a literary figure, she accounts the four years spent living in America with the majority of her children and without her husband. The Life and Adventures of Jonathan Jefferson Whitlaw (1836), published fifteen years before Uncle Tom's Cabin, is the first anti-slavery novel written in English. Other novels, like The Vicar of Wrexhill (1834) and Jessie Phillips (1844) discuss legal matters. A common thread connects much of Trollope's work. That thread is feminism, which places her in the company of (and somewhere in between) Mary …

Water Quality Modeling For Unconventional Bod, Trieu Van Le Jan 2005

Water Quality Modeling For Unconventional Bod, Trieu Van Le

LSU Master's Theses

Predictions of the dissolved oxygen (DO) concentration in a stream are sensitive to the choice of Biochemical Oxygen Demand (BOD) reaction model which frequently is assumed to be first order, although published BOD data sets from analyses of samples from rivers show that many are described best by second order or three-halves order BOD reaction. Two DO models for a stream are developed, one with a second order and the other with a three-halves order BOD reaction. The DO equations are solved using Laplace transform method which simplifies the mathematical solution of the model equations by avoiding difficult to evaluate …

Wealth And Deprivation In The Delta: A Landscape Of Subsidization, Jacqueline Warren Mills Jan 2005

Wealth And Deprivation In The Delta: A Landscape Of Subsidization, Jacqueline Warren Mills

LSU Doctoral Dissertations

The Mississippi Delta, as defined by the Delta Regional Authority (DRA), is an area of historical and present deprivation. Persistent poverty, lackluster economic development opportunities, and the associated ills of this environment exist alongside large-scale, subsidized agriculture. These federal subsidy payments are criticized for increasing the wealth of corporate enterprises rather than stabilizing the family farmer for whom they were created. This dissertation examines the geography of agristructure, subsidies, and socio-economic characteristics in the Delta with the purpose of identifying spatial relationships among these three variables. Drawing from the Goldschmidt Hypothesis, this research proposes that areas of large-scale agristructure will …
