Book Review: "The Birth Of Surrogacy In Israel", Stacey A. Tovino Jan 2005

Book Review: "The Birth Of Surrogacy In Israel", Stacey A. Tovino

Scholarly Works

Instead of analyzing Israel’s Surrogate Motherhood Agreements Act from a purely legal or theoretical perspective, D. Kelly Weisberg weaves individuals, events, and other factors into a fascinating story about the Israeli legislative process. A case in point: Weisberg begins by exploring the private lives of Rachel and Benjamin, the biological parents of twin babies carried by Sarah, the first surrogate moth to carry a baby under Israel’s surrogacy law. Weisberg also explores the story of Naomi and Dan, the biological parents of a baby boy carried by Hanna, the second surrogate mother to carry a baby under the legislation. Readers …

Book Review: "Introduction To Jewish And Catholic Bioethics: A Comparative Analysis", Stacey A. Tovino Jan 2005

Book Review: "Introduction To Jewish And Catholic Bioethics: A Comparative Analysis", Stacey A. Tovino

Scholarly Works

Aaron Mackler’s agenda is to provide an orientation to ethical reasoning in the Roman Catholic and Jewish traditions, explore Roman Catholic and Jewish deliberations in five areas of bioethics, and identify and examine the traditions’ divergent and convergent methodologies. Mackler’s spirit is to learn more about his own religious traditions by studying the traditions of others. Accomplishing his agenda while remaining true to his spirit, Mackler shows just how much Jewish and Catholic thinkers can learn from one another.

A Comparative Study Of United States And Japanese Laws On Collaborative Inventions, And The Impact Of Those Laws On Technology Transfers, Mary Lafrance

Scholarly Works

This research examines United States and Japanese laws regarding patent rights in collaborative inventions, and inquires whether these laws may impede technology transfers by creating uncertainty regarding the ownership, validity, or enforceability of the resulting patents, or by imposing undue obstacles to the licensing or assignment of such patents.  Where the laws of the two countries differ, this paper compares the merits of each approach and also assesses whether the differing approaches could be troublesome for cross-border transactions.

One of the most significant differences between United States and Japanese law regarding joint inventions is in the requirement of consent for …

The Life And Work Of Nick Fofonoff, T. J. Mcdougall, R. W. Schmitt, G. Veronis, F. Webster

Journal of Marine Research

Nicholas Paul Fofonoff was born August 18, 1929, and raised on a small farm near Queenstown in Alberta, Canada. His parents spoke only Russian at home, so Nick did not learn English until he attended the two-room school that served the first six grades for the town of 200. He was the second born of four, the prince among three sisters. The small school meant he was exposed to several grades at a time and could advance quickly. He also learned many practical skills on the farm from a clever father and the necessity to be self-sufficient. It was a …

Rediscovering Williston, Mark L. Movsesian Jan 2005

Rediscovering Williston, Mark L. Movsesian

Washington and Lee Law Review

This Article is an intellectual history of classical contracts scholar Samuel Williston. Professor Movsesian argues that the conventional account of Williston's jurisprudence presents an incomplete and distorted picture. While much of Williston 's work can strike a contemporary reader as arid and conceptual, there are strong elements of pragmatism as well. Williston insists that doctrine be justified in terms of real-world consequences, maintains that rules can have only presumptive force, and offers institutional explanations for judicial restraint. As a result, his scholarship shares more in common with today's new formalism than commonly supposed. Even the undertheorized quality of Williston 's …

The City of Cleveland plans to create a long-term vision for industrial and commercial land reuse in order to better serve the business and neighborhood interests of its citizens. The implementation of an industrial land bank is one critical way in which to fulfill this goal. This study aimed to develop a strategy to aid the city in the operation and management of rehabilitating commercial and industrial properties for reuse. The objectives of the project were to: * Incorporate a strategy understood by senior managers at the city that identifies a broad economic redevelopment vision, especially for brownfields. * Include …

A Report To The Urban League Of Greater Cleveland: An Assessment Of Business Support Services Available To Existing And Start-Up Small Businesses In The City Of Cleveland, Stuart Mendel

All Maxine Goodman Levin School of Urban Affairs Publications

Developing small businesses is a way to concentrate wealth, employ city residents, improve neighborhood amenities, and provide entrepreneurial role models in urban neighborhood communities currently bereft of such. In a city where well over half of the resident population belong to groupings of people traditionally in the minority, and whose ranking is high in terms of concentrated poverty, nurturing existing and new small minority business enterprises makes good policy sense and offers a systematic intervention strategy to alleviate poverty. This report has been completed to help leadership organizations such as the Urban League of Greater Cleveland and policy-makers such as …

Interpreting Reality: ‘Los Olvidados’ And The Documentary Mode, Julie Jones Jan 2005

Interpreting Reality: ‘Los Olvidados’ And The Documentary Mode, Julie Jones

Foreign Languages Faculty Publications

The article presents a study on the documentary film "Los olvidados," by Louis Buñuel. The study is concerned with the elements in the film itself that align it with documentary practice. At the same time it gives equal weight to the presentation of the film and to contemporary reviews in the press. These elements stressed the film's serious social purpose and thereby reinforced an interpretation of the work as nonfiction. The author informs that this study is not concerned with any final classification of the film. It is concerned with an examination of those elements that make this documentary reading …

The Transition From Church Growth To Church Health, Philip Walker Jan 2005

The Transition From Church Growth To Church Health, Philip Walker

Journal of the American Society for Church Growth

When I have taught Church Growth principles I have found it helpful to look at Acts 2:41-47 and the variety of growth types indicated in these verses. You will find: Growing up in verse 42, individuals growing into a mature relationship with God; Growing together in verse 44, in great generosity and spiritual gifts; Growing out in verse 47a, into the community; Growing more in verse 47b, as the numbers increase. The problem has been that Church Growth thinking has been caricatured as relating only to the last of these, although a careful reading of the Church Growth books shows …

The Mother Church And Church Planting, J. D. Payne Jan 2005

The Mother Church And Church Planting, J. D. Payne

Journal of the American Society for Church Growth

In this article, I will address several issues related to a much neglected area of church planting. First, I will discuss three reasons why churches are not involved in church planting. Second, I will address this problem in light of the Scriptures and missiology. Third, I will list and respond to the most common objections to becoming a mother church. Fourth, I will discuss several ways in which established churches can become involved in church planting. Finally, I will address the significance of church leadership in the churches planting churches process.

Meanings In The Lives Of Older Adults: In Their Own Voices, Isabel A. Trombetti Jan 2005

Meanings In The Lives Of Older Adults: In Their Own Voices, Isabel A. Trombetti

Open Access Dissertations

This dissertation attempts to advance our understanding of how we as human beings perceive, judge, and evaluate our lives, particularly in the last stage of the life cycle. The primary goal was to counterbalance the predominantly quantitative approach to meaning in life with a qualitative approach by interviewing 21 older adults as they reflected on and attempted to find purpose and value in the totality of their experiences. This goal was explicit on the point of wanting older adults, those ideally positioned in the lifespan to inform us about meaning in life, to speak without the restriction associated with response …

The Market Attitudes Inventory: The Development And Testing Of Reliability And Validity, Noreen Lephardt, Charles Breeden Jan 2005

The Market Attitudes Inventory: The Development And Testing Of Reliability And Validity, Noreen Lephardt, Charles Breeden

Economics Faculty Research and Publications

In this article we report the development of a 22-statement survey that measures attitudes towards the market system. We report on the testing of the Market Attitude Inventory (MAI) for reliability and validity. Mean scores on the instrument are reported for a random sample of Midwest high school social studies teachers. We conclude that the MAI is a valid and reliable instrument. The MAI has applications in research, educational outcome assessment, and teaching pedagogy for the measurement and evaluation of attitudes and values towards the workings of the market system in the US.

A Descriptive Study Of Beta2-Agonist Use In Asthma Patients Based On A Nationally Representative Sample, James Melfi Jan 2005

A Descriptive Study Of Beta2-Agonist Use In Asthma Patients Based On A Nationally Representative Sample, James Melfi

Open Access Dissertations

Study. Prescribing patterns found in asthma patients compared to those patterns delineated in non-asthma patients. Background. Asthma is a chronic inflammatory disease of the airways characterized by inflammation as well as airway constriction. NIH guidelines recommend treatment of moderate to severe asthma with both preventive anti-inflammatory medication (inhaled corticosteroids) as well as a bronchodilator (beta 2 agonist) for quick relief of episodic symptoms (i.e., rescue medication). However, inhaled beta2-agonists are recommended for use in all types and classifications of asthma to provide prompt relief of airflow obstruction. The purpose of this study is to describe the pattern of prescribing inhaled …

Attention-Deficit/Hyperactivity Disorder: A Survey Of Assessment Practices By School Psychologists, Teresa L. Miller

Open Access Dissertations

This research was conducted to survey the assessment and diagnostic practices of school psychologists who assess individuals referred for Attention-Deficit/Hyperactivity Disorder (ADHD). Results showed that a substantial number of school psychologists routinely provide ADHD assessments despite concerns about the quality of the psychological instruments available to them or a lack of an agreed-upon gold standard for ADHD assessment. Participants reported that ADHD-related referrals were accurate approximately 65% of the time, and teachers were rated as both the most common and accurate of all referral sources. Most of the school psychologists used the Wechsler Intelligence Scale for Children, the Behavior Assessment …
