From gruesome self-experimentation to exhausting theoretical calculations, stories abound of scientists willfully surrendering health, well-being, and personal interests for the sake of their work. What accounts for the prevalence of this coupling of knowledge and pain-and for the peculiar assumption that science requires such suffering? In this lucid and absorbing history, Rebecca M. Over the past decade, many military affairs analysts have touted the advent of a "revolution in military affairs." Although generally framed in the context of those technological advances that make possible four-dimensional, network- centric warfare, it is the dramatic "civilianization" of conflict that may prove normatively more revolutionary. In no conflict has the civilian footprint supporting military operations been larger than in Iraq. This paper begins by examining civilian employee and private contractor involvement in Operation Iraqi Freedom ("OIF") as a case study in the contemporary nature of such participation. Effect Of Social Status Of Dairy Heifers On Expression Of Estrus And Subsequent Fertility, Dawn A. Elkins, Rick W. Rorie
Discovery, The Student Journal of Dale Bumpers College of Agricultural, Food and Life Sciences
A study was conducted to determine if social status of heifers within a herd influences estrus activity and subsequent fertility. Thirty cyclic dairy heifers were observed over a 14 d period and ranked by social status, based on a displacement index. The estrous cycles of the heifers were synchronized by treatment with two injections of prostaglandin F2a (PGF2a; Lutalyse, 25 mg) given 14 d apart. At the second PGF2a injection, HeatWatch transmitters were placed on the heifers for continuous monitoring of mounting (estrus) activity over the next 45 d. Linkage Of Free Trade And Social Regulation: Moving Beyond The Entropic Dilemma, Sungjoon Cho

In the discussion that follows, Section I begins by exploring the genesis of linkage. Although its relative emphasis may be a recent development, linkage is not itself a new phenomenon, but a long-contemplated topic in the history of international trade. Section II surveys and categorizes the contemporary linkage debate from three aspects: motivation (why to link), desirability (whether to link), and issue areas (what to link). It then critiques the existing literature, arguing that representative works are either too hypothetical, unempirical, or narrowly focused on particular regulatory topics. Against the backdrop of this critique, Section III shifts the focus of …

On July 11, 2003, the African Union ("AU") adopted a "Protocol on the Rights of Women in Africa" ("Protocol"), which established a woman's right to have an abortion in cases of rape or incest or to preserve the health of the mother. Perhaps surprisingly, this Protocol is the first explicit mention of abortion rights in international law. For a variety of reasons, many international organizations have carefully avoided taking positions on positive abortion rights. Complicating the issue are the laws of some nations that affect, at least indirectly, the ability of other nations to create their own policies and develop …

Making Research A Requirement Of Treatment: Why We Should Sometimes Let Doctors Pressure Patients To Participate In Research, David Orentlicher

In this article, Professor David Orentlicher argues that when a patient could be offered one of multiple established treatments, doctors should be able to offer treatment only if the patient agrees to participate in research aimed at determining which of the treatments is most effective. Making treatment conditional on research participation will help researchers complete badly needed studies.

This Article describes the evolution of the perception of the modern class action from populist darling to greedy lawyer pariah, including recent passage of CAFA. It then examines the degree to which different types of cases present different potential benefits and detriments of class action treatment and explains why investor class actions, including those brought by institutional investors, are particularly likely to benefit from class treatment, are resistant to many of the perceived problems of class actions in other contexts, and should receive a warmer welcome from courts, both in absolute terms and relative to other types of class actions. …

Literature has had a long relationship with medicine through literary images of disease, literary images of physicians and other healers, works of literature by physician-writers, and the use of literature as a method of active or passive healing. Literature also has had a long relationship with the law through literary images of various legal processes, lawyers, and judges, works for literature by lawyer-writers, and the use of literature as therapy. At last count, eighty-four law schools in the United States and Canada reported offering some variations of a “law and literature” course and recent scholarship demonstrates that literature increasingly is …

Creeping Mandatory Arbitration: Is It Just?, Jean R. Sternlight

This Article examines the phenomenon of mandatory binding arbitration, imposed on consumers and employees, and considers whether this type of dispute resolution serves or instead undermines justice. It is fairly easy to attack binding arbitration as unfair, for example pointing to the fact that it undermines rights to jury trial and to proceed in class actions. However, this Article seeks to examine the phenomenon of mandatory binding arbitration from a broader perspective, recognizing that it is inappropriate to assume that justice requires our existing system of litigation, with its class actions and jury trial.
