Non-Adversarial Case Resolution, Donald N. Duquette Jan 2005

Non-Adversarial Case Resolution, Donald N. Duquette

Book Chapters

Professionals who work with children and parents have become increasingly dissatisfied with the customary reliance on the traditional adversarial system in resolving family-related disputes, including cases involving children's protection, placement, and permanent care. The power struggle in contested cases and hearings relating to child welfare may foster hostility among the parties and dissipate money, energy, and attention that could otherwise be used to solve problems cooperatively. Parties may become polarized, open communication may be discouraged, and there may be little investment in information sharing and joint problem solving. Children may suffer when adversarial tensions escalate and ameliorative services are delayed.

Gender And Globalization, Christine M. Chinkin Jan 2005

Gender And Globalization, Christine M. Chinkin

Book Chapters

Christine Chinkin examines the impact of globalization on the public/private dichotomy and the status of women. She begins by tracing how traditional power structures, organized around the public/private division, lead to the subordination of women. The weakening of the nation-state at the end of the twentieth century offers a potential challenge to this gender hierarchy, but the emergence of economic forces associated with globalization and the transition to free market economies in the countries of the former Soviet bloc threaten women's struggle for equality.

Making Place At The Table: Reconceptualizing The Role Of The Custody Evaluator In Child Custody Disputes, Mary Kay Kisthardt, Barbara Glesner Fines Jan 2005

Making Place At The Table: Reconceptualizing The Role Of The Custody Evaluator In Child Custody Disputes, Mary Kay Kisthardt, Barbara Glesner Fines

Faculty Works

This article is based on the premise that custody evaluations cannot and should not be a substitute for the socio-legal judgment of the best interests of the child. Recognizing that clinical humility and judicial vigilance may not be sufficient to restrain the misuse of psychological evaluation, the authors offer three structural changes that would provide a more appropriate use of the skills and talents custody evaluators bring to legal decisions: using custody evaluators in the less adversarial setting of preparing parenting plans; revising the procedures by which custody evaluations are elicited in litigation; and, adopting the approximation standard for child …

Neotrusteeship In Afghanistan, Melanie Kawano Jan 2005

Neotrusteeship In Afghanistan, Melanie Kawano

Human Rights & Human Welfare

Afghanistan is currently under the tentative rule of an international administration, or neotrusteeship, thereby restricting its national sovereignty. However, self-determination and nonintervention have never been persistent features of Afghanistan. Foreign interventions, invasions and great power showdowns on its territory have made a truly autonomous Afghan state a shortlived phenomenon. The outcome at each stage of Afghan history has been an unstable state that seems to invite even more external involvement.

State-Building In Afghanistan, Melanie Kawano, Amy Mcguire Jan 2005

State-Building In Afghanistan, Melanie Kawano, Amy Mcguire

Human Rights & Human Welfare

Since the U.S. intervention in Afghanistan in late 2001, Afghan citizens and members of the global community have been grappling with the question of how to build a state that can fill the void created by decades of conflict and violence. However, the concept of “state-building” is complex. The term describes both an internal process and international assistance; it requires short-term action as well as a long-term vision. While no precise formula for state-building exists, there are historical precedents and “models” of state-building expressed by great powers and multilaterals. In reality, however, these are based on best guesses that fail …

Sudan, Alexandra Nichols Jan 2005

Sudan, Alexandra Nichols

Human Rights & Human Welfare

Since independence Sudan has found itself almost constantly embroiled in civil conflict within its own borders. Throughout the 1990’s, Sudan was widely known to sponsor terrorism, having such as including Osama bin Laden from 1991-1996. American sanctions have been in place in Sudan since 1997, the last American ambassador was removed in 1998, and Sudan has been on the U.S. State Departments list of sponsored terrorists since 1993.
