Afterword - Outsider Citizenships And Multidimensional Borders: The Power And Danger Of Not Belonging, Pedro A. Malavet

UF Law Faculty Publications

In this closing for the LatCrit VIII symposium, I adopt a collective view of the articles, and attempt to develop how the themes discussed in them fit within LatCrit scholarship. I will then interrogate the future of our enterprise by discussing the danger of succumbing to the seduction of the real or perceived need "to reinvent the wheel," or at least to clothe ideas in overly-developed language. Last, the Conclusion discusses how LatCrit scholarship is both promoted and challenged by the articles published here. I further include some suggested institutional responses to the opportunities for mentoring and nurturing that I …

Beet Poleroviruses: Close Friends Or Distant Relatives?, Mark Stevens, Benjamin Freeman, Hsing-Yeh Liu, Ethienne Herrbach, Olivier Lemaire

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

Taxonomy: There are three members of the genus Polerovirus (family Luteoviridae ) that induce yellowing of sugar beet: Beet mild yellowing virus (BMYV), Beet chlorosis virus (BChV) and Beet western yellows virus -USA (BWYV-USA, Fig. 1). Non-beetinfecting isolates of BWYV found particularly within Europe have now been re-named Turnip yellows virus (TuYV). Species-specific antibodies are unavailable, but the viruses can be distinguished by RT-PCR using primers specifically designed to the 5 ′ end of their respective genomes. Physical properties: The isometric virus particles are approximately 26 nm in diameter and the genome consists of a single strand of positive sense …

Black Protectionism As A Civil Rights Strategy, Katheryn Russell-Brown Jan 2005

Black Protectionism As A Civil Rights Strategy, Katheryn Russell-Brown

UF Law Faculty Publications

This Article has identified and outlined the parameters of Black protectionism, a practice used by African-Americans to protect prominent community members who have been charged with criminal or unethical activity. This practice took root during slavery-during a time when a false or minor charge against one African-American could result in death or great bodily harm to him and scores of other African-Americans. History has cultivated a culture of Black mistrust of Whites in particular and mainstream society in general. This suspicion is reinforced with the continued disparate treatment of African-Americans within the criminal justice system. History and contemporary conditions explain …

Law Is Not Enough, Berta E. Hernández-Truyol Jan 2005

Law Is Not Enough, Berta E. Hernández-Truyol

UF Law Faculty Publications

In 1995, the United Nations reported “in no society today do women enjoy the same opportunities as men.” The condition and status of women worldwide was one of social, political, educational, legal, and economic inequality. Ten years later, women's economic disparities persist. In Gender Injustice: An International Comparative Analysis of Equality in Employment, Dr. Anne-Marie Mooney Cotter focuses on women's global inequality in employment. The book's in-depth examination of women's second-class, subordinated status in the workplace around the world provides invaluable insights into the complexities of gender inequality.

Assessing Recharge And Discharge Across The Prairie Pothole Landscape: Application Of Spatial Hydrological Data And Statistical Analysis In A Groundwater Flow Model, Christopher D. Laveau Jan 2005

Assessing Recharge And Discharge Across The Prairie Pothole Landscape: Application Of Spatial Hydrological Data And Statistical Analysis In A Groundwater Flow Model, Christopher D. Laveau

Theses and Dissertations

Quantifying the spatial and temporal dynamics between groundwater recharge, discharge, and wetlands is a necessary step to develop effective water management strategies. Wetlands in the northern Great Plains play a role in flood control, water supply, and regional ecology. The water budget of a wetland in the northern prairies is often an unequal balance between moisture input and output in which the permanence of a wetland depends on its groundwater budget. Identifying and quantifying groundwater recharge and discharge zones has applications in predicting the spatial and temporal distribution of wetlands.

The current work involved the application of a groundwater model …

Regional Stratigraphy Of The Newcastle Formation (Lower Cretaceous) In Eastern Montana And Western North Dakota, Adam J. Ulishney Jan 2005

Regional Stratigraphy Of The Newcastle Formation (Lower Cretaceous) In Eastern Montana And Western North Dakota, Adam J. Ulishney

Theses and Dissertations

The Newcastle Formation (Lower Cretaceous) consists of sandstone with interbedded shale, siltstone, and mudstone facies. This work shows that the regional stratigraphy of the unit is detailed enough for the interpretation of its depositional history and environments in eastern Montana. This work also illustrates the possible lowstand position of the Western Interior Seaway along with probable source areas providing sediments into the study area.

A total of 3446 geophysical wireline logs were used to determine formation tops of the Greenhorn, Mowry, Newcastle, Skull Creek, and Inyan Kara Formations. The log character of the Newcastle Formation was also described for all …

Race, Nation-Building And Legal Transculturation During The Haitian Unification Period (1822-1844): Towards A Dominican Perspective, Charles R. Venator Santiago Jan 2005

Race, Nation-Building And Legal Transculturation During The Haitian Unification Period (1822-1844): Towards A Dominican Perspective, Charles R. Venator Santiago

Cleveland State Law Review

This paper offers some preliminary reflections on the relationship between law, race, and nation building during the Haitian unification period. My contention is that, while the Haitian occupation can be described as a domination of Santo Domingo, it is also possible to discern some important ways in which Dominicans benefited from this relationship. More importantly, I suggest that there are some important moments where Dominicans participate in the Haitian nation building process. This paper also draws on a critical reading of Fernando Ortiz's notion of legal transculturation as articulated in his book, Cuban Counterpoint, to reflect on the multiple clashes …

Cities In (White) Flight: Space, Difference And Complexity In Latcrit Theory, Keith Aoki Jan 2005

Cities In (White) Flight: Space, Difference And Complexity In Latcrit Theory, Keith Aoki

Cleveland State Law Review

This essay introduces three articles by Reggie Oh, Aaron Monty and Julian Webb that share themes related to the idea of decentralization and decentering. This essay obliquely approached the three LatCrit pieces by first evoking James Blish's science fictional vision of "Cities in Flight" - cities enabled by anti-aging and antigravitation technology to depart from the face of the Earth and roam interstellar space, a picture of radical physical decentralization. The essay then moved on to consider three justifications and visions of decentralization from Robert Nozick, Frank Michelman and Iris Young articulating libertarian, deliberative communitarian and arguably, postmodern approaches to …

A Multi Commodity Recyclables Collection Model Using Partitioned Vehicles, Natali Mohanty Jan 2005

A Multi Commodity Recyclables Collection Model Using Partitioned Vehicles, Natali Mohanty

Open Access Dissertations

This study identifies fundamental problems in the operation of recyclables collection services and develops a model for optimizing the associated logistics operations. Based on an analysis of data of types of materials and volumes collected from a collaborating recycling services company which uses partitioned vehicles, it is clear that operation and transportation costs, and collection volumes are the dominant factors that determine profitability in the commercial recycling business. Although recycling operations and distribution (forward) operations share many characteristics, decisions related to fleet configuration and operation for the former are significantly more complicated because of the wide dispersal of similar materials …

Un/Becoming Digital: The Ontology Of Technological Determinism And Its Implications For Art Education, Alison Colman Jan 2005

Un/Becoming Digital: The Ontology Of Technological Determinism And Its Implications For Art Education, Alison Colman

Journal of Social Theory in Art Education

Artists have been experimenting with analog and digital technologies since the 1960's; early examples include Billy Khiver's Experiments in Art and Technology (E.A.T.) and Nam June Paik (1966). While countless artists have since made highly innovative use of new media such as the computer, artificial intelligence (AD, biotech, the Internet and the World Wide Web, LED, motion capture, gesture tracking, CPS, open source, and robotics, artist/ theorists such as Penny (1995), Lovejoy (1997), Weibel (1996; 2001) and Wilson (2002) have cautioned against appropriating deterministic engineering models underlying such technologies.(l)These models, predominant in commercial industry, government and the military, embrace efficiency, …

Stranger Within, Anniina Suominen Jan 2005

Stranger Within, Anniina Suominen

Journal of Social Theory in Art Education

I base my teaching philosophy on the continuous self-directed learning of an individual. My goal is to help my students to learn to problematize their perception, their ways of thinking, their understanding of themselves, and their satisfaction with achieved learning goals. I support my students in their journeys of becoming critical searchers and inquirers of knowledge, visuality, and perceived reality. Although it is apparent they have learned to question authority and pre-given role and behavior models, I watch them searching for shortcuts for the answers within the complex structure of too many potential solutions.

(Un)Becoming Queer/(Un)Becoming Lgbtic, Kimberly Cosier, Laurel Lampela, Susan Marie De La Garnica, James Sanders, Deborah L. Smith-Shank, Mindi Rhodes, Jessie Whitehead

Journal of Social Theory in Art Education

This article is one result of an ongoing dialogue among a number of members of the LGBTIC/Queer Caucus. The dialogue has taken place primarily through a torrent of e-mails, but also through a number of emotionally charged telephone calls. It began as a friendly, (perhaps naively) simple idea -to turn members' viewpoints about changing the name of our caucus, from "Lesbian, Gay, Bisexual and Transgendered Issues Caucus" to "Queer Issues Caucus" into an article. What began with good will and a fervent hope for understanding, at times turned into vitriol and contention -volleys of world views, personal identities, and philosophies. …

Strangers To The Land: The German Presence In Nineteenth-Century Arkansas, Shirley Sticht Schuette Jan 2005

Strangers To The Land: The German Presence In Nineteenth-Century Arkansas, Shirley Sticht Schuette

Theses and Dissertations

This study traces the presence of German immigrants in Arkansas from 1820 through 1900 with particular attention to examples of chain migration. It explores stories of German settlers from three points of view: the political, social and cultural situations that motivated emigration; the immigrant communities established in Arkansas, and continuing connections between the New World and the Old. It locates the immigrants in Arkansas as a frontier state and a Southern state, including their experiences during the Civil War. Using letters and diaries, in addition to census records, the study looks at how the immigrants experienced the strangeness of their …

The Impact Of Non-Stationarities In The Climate System On The Definition Of "A Normal Wind Year": A Case Study From The Baltic, S C. Pryor, R J. Barthelmie, Justin T. Schoof Jan 2005

The Impact Of Non-Stationarities In The Climate System On The Definition Of "A Normal Wind Year": A Case Study From The Baltic, S C. Pryor, R J. Barthelmie, Justin T. Schoof

Publications

Wind speeds over the Baltic significantly increased over the second half of the 20th century (C20th), with the majority of the increase being focused on the upper quartile of the wind speed distribution and in the southwest of the region. These changes have potentially profound implications for the wind energy resource. For example, based on the National Centers for Environmental Prediction–National Center for Atmospheric Research (NCEP–NCAR) reanalysis data it is shown that, owing to this non-stationarity, using the normalization period of 1987–98 to determine the wind resource (as in the Danish wind index) leads to overestimation of the wind energy …

Establishing An Online Community Of Practice For Instructors Of English As A Foreign Language, Christopher M. Johnson Jan 2005

Establishing An Online Community Of Practice For Instructors Of English As A Foreign Language, Christopher M. Johnson

CCAC Theses and Dissertations

Communities of practice are entities that emerge for the purposes of learning and advancement of knowledge in a particular area. They emerge under all circumstances, even adverse situations. Because they can spawn great innovation and knowledge advancement, organizations need to cultivate and establish environments that allow them to develop. Currently, communities of practice have moved into the online world, in which their members use computer mediated communication to collaborate with each other.

In January, 2002, a virtual community was formed to enable teachers of English as a Foreign Language to collaborate on learning and applying various computing technologies in language …

Richmond, Virginia's Every Monday Club, 1889-1919, Maureen Elizabeth Salmon

Master's Theses

This thesis examines the formation and growth of the Every Monday Club, a woman's literary club in Richmond, Virginia in the late nineteenth and early twentieth century. Since the group has never been researched before, most of the study concentrates on untouched archives. The study uses the extensive Every Monday Club papers which include club meeting minutes, letters, papers, pictures, yearbooks, and newspaper clippings. This information is also supplemented with obituaries, census, and other primary data. The records disclose issues of class, race and education.

The Vascular Flora Of Powhatan County, Virginia, Michael Austin Terry Jan 2005

The Vascular Flora Of Powhatan County, Virginia, Michael Austin Terry

Master's Theses

The project was undertaken with three main goals in mind: to provide as current and complete an account as possible of the flora of Powhatan County in the form of an annotated checklist; to integrate the information obtained from the inventory into phytogeographical and ecological generalizations currently being developed for the state of Virginia; and, to report any significant or anomalous discoveries. There is no previous county-wide inventory of plant diversity for Powhatan County. However, Corcoran (1981) published a list of plants from the Jones and Mill Creek watershed located in the Fine Creek Mills area of northeastern Powhatan.

Winners And Losers In The Globalization Of Legal Services: Offshoring The Market For Foreign Lawyers, Carole Silver Jan 2005

Winners And Losers In The Globalization Of Legal Services: Offshoring The Market For Foreign Lawyers, Carole Silver

Articles by Maurer Faculty

This article takes an empirical approach to the issue of how the U.S. legal services market is responding to globalization. It begins by considering the ways in which the domestic legal services market has internationalized by focusing on changes in legal education and examines the disconnection between U.S. legal education and practice opportunities in the U.S. The article proceeds to consider the ways in which U.S. law firms have become global organizations by offshoring their international identities, through the staffing of their non-U.S. offices with non-U.S. lawyers. Based on a database of more than 5,000 lawyers working in the offshore …

The Significance Of National Wildlife Refuges In The Development Of U.S. Conservation Policy, Robert L. Fischman Jan 2005

The Significance Of National Wildlife Refuges In The Development Of U.S. Conservation Policy, Robert L. Fischman

Articles by Maurer Faculty

A retrospective of National Wildlife Refuge System conservation shows a promising trajectory. The system has overcome persistent neglect to contribute to conservation policy. Haltingly, it has kept pace with conservation science to remain the chief American contribution to large-scale wildlife protection. Early on, it pioneered the use of habitat acquisition to protect imperiled species. More recently, it has begun to implement the cutting-edge ecological mandate to maintain biological integrity, diversity, and environmental health. Perhaps the most meaningful feature of the history of the refuge system is how closely it mirrors the development of conservation policy in the twentieth century.

Liberation Theology Of Disability And The Option For The Poor, Scot Danforth Jan 2005

Liberation Theology Of Disability And The Option For The Poor, Scot Danforth

Education Faculty Articles and Research

A liberation theology of disability provides a spiritual discourse that unites a critical analysis of the economic dimensions of disability oppression with an appreciation for the lived experience of disabled persons. This paper builds from prior liberation theology scholarship and the Catholic theological concept called the preferential option for the poor to articulate a liberation theology of disability marked by critical social analysis, humility, hope, and love.
