Bone Dispersion, Weathering, And Scavenging Of Cattle Bones, Melinda Potmesil
Bone Dispersion, Weathering, And Scavenging Of Cattle Bones, Melinda Potmesil
Nebraska Anthropologist
In this research project, the goal was to study the pattern of disbursement of cattle bones from the site of death, observe any signs of scavenger marks and categorize the degree of weathering on the bones. In order to have a comparative data set, three sites with different characteristics were chosen. The three sites were chosen because of the ability to date the death of each cow, the length of time between each death, and the different locations, which each animal died The oldest site was a one-year-old yearling heifer which died in May of 1992. The next site was …
The Effects Of Roads And Culverts On Stream And Stream-Side Salamander Communities In Eastern West Virginia., Ryan Lee Ward
The Effects Of Roads And Culverts On Stream And Stream-Side Salamander Communities In Eastern West Virginia., Ryan Lee Ward
Graduate Theses, Dissertations, and Problem Reports (ETD)
Roads and culverts have many effects on stream salamanders. We examined 120 culvert crossings in the Shavers Fork and Dry Fork watersheds in eastern West Virginia. Complete barriers to salamander passage occurred at 55.0% of the sites visited and partial barriers at 34.2%. Analyses showed that 20.6% of the total stream length in the Dry Fork watershed and 18.4% in the Shavers Fork watershed were isolated by barriers. We conducted salamander sampling at 16 streams and used Akaikeís Information Criterion to select the best a priori models explaining salamander diversity, richness, and abundance. Roads benefited disturbance tolerant species while negatively …
The Case For Sidney Rigdon As Author Of The Lectures On Faith, Noel B. Reynolds
The Case For Sidney Rigdon As Author Of The Lectures On Faith, Noel B. Reynolds
Faculty Publications
Twentieth century attempts to include the "Lectures on Faith" in the writings of Joseph Smith, Jr., provoked this comprehensive survey of historical evidence and carefully designed authorship testing of the text. Every credible approach reaches the same conclusion. Sidney Rigdon wrote the Lectures on Faith, likely without help from Joseph Smith or any others. These Lectures are characterized by both teachings and language that Rigdon may have retained from his recent discipleship with Alexander Campbell. The published Lectures follow both the form and content of lectures given and then published by frontier phenomenon Charles Finney. The decision to insert these …

Aboriginal Title And Extinguishment Not So "Clear And Plain": A Comparison Of The Current Maori And Haida Experiences, Jacqueline F. Pruner
Washington International Law Journal
As the end of the United Nations General Assembly's International Decade of the World's Indigenous Peoples (1995-2004) approaches, indigenous peoples worldwide are proactively seeking an unprecedented reclamation of aboriginal rights lost since European colonization. One of the most all-encompassing rights that is asserted by indigenous peoples is the right of "indigenous title," a legal term of art that is both difficult to define and challenging to recognize. Notwithstanding domestic opposition from their respective provincial or national legislatures, both the Haida of Canada and the Maori of New Zealand are currently pursuing recognition of this indigenous right through their respective judiciaries. …
Treading Deep Waters: Substantive Law Issues In Tuvalu's Threat To Sue The United States In The International Court Of Justice, Rebecca Elizabeth Jacobs
Treading Deep Waters: Substantive Law Issues In Tuvalu's Threat To Sue The United States In The International Court Of Justice, Rebecca Elizabeth Jacobs
Washington International Law Journal
In 2002, in response to the United States' refusal to ratify the Kyoto Protocol, the Pacific island nation of Tuvalu, vulnerable to submersion due to the rising sea level, threatened to bring a lawsuit against the United States in the International Court of Justice for damages to its island. Outside of various jurisdictional issues that may preempt the suit, Tuvalu's suit will likely have a number of substantive law problems. Tuvalu must show not only that the United States is unlawfully causing the island damage, but also that it has a right to future damages that have yet to occur. …
A Securities Regulator Looks At Onvergence, Donald T. Nicolaisen
A Securities Regulator Looks At Onvergence, Donald T. Nicolaisen
Northwestern Journal of International Law & Business
For many years there has been a dedicated group of practitioners, standard setters, business leaders and others from around the world who have worked to establish a single set of globally accepted accounting standards for the benefit of the capital markets. These people clearly had their hearts in the right place but, absent a binding mandate to apply the standards, it seemed largely a labor of love. Now I expect those pioneering initiatives and the many years of effort to pay off because in 2005 a large number of companies are joining what up to now has been a limited …

Bridging The Gap In The Hopes Of Ending Female Genital Cutting, Kirsten Bowman
Bridging The Gap In The Hopes Of Ending Female Genital Cutting, Kirsten Bowman
Santa Clara Journal of International Law
The practice of female genital cutting (FGC) has been criticized and debated within the international legal community for years. However, the argument between cultural relativism and universalism drowns out the important issues regarding the practice and its effects on women and girls. Within this debate the UN plays an integral role and this comment seeks to analyze that role. The author explains the practice of FGC, its effects, and its current legal standing globally. She then seeks to analyze western attempts to end the practice of FGC and the role that both universalists and cultural relativists play in that effort. …

Transnational Common Laws, H. Patrick Glenn
Transnational Common Laws, H. Patrick Glenn
Fordham International Law Journal
Today, the notion of transnational, or sometimes transsystemic, law has progressed well beyond Jessup's concept. It now includes the international law that Jessup generally dealt with – the (often) national law regulating actions or events that transcend national frontiers – but also now clearly extends to law that is transnational in origin, as opposed to application. The new transnational law can thus be applied to purely internal, and not only international, cases, and its transnational character is derived from the extra-national character of its source or sources. It is often seen in the form of “general principles of law,” which …

A Further Consideration Of Galdosian Cultural Nicknames: Mythological, Legendary, And Historical Personages, Vernon A. Chamberlin
Decimonónica
Galdós’s use of nicknames has been addressed both directly and indirectly in various studies,1 but much remains to be noted about how historical, legendary, and mythological personages served as source material for sobriquets to designate Galdosian characters. So important were these nicknames to Galdós’s artistry that he would sometimes change the apodo in the Alpha manuscript to a different one in the final printed version. Moreover, the history-based nicknames, which do so much to enliven Galdós’s novels and Episodios are a feature in common with other nineteenth-century novelists, most notably Alas, Pereda, and Pardo Bazán.

Highly Streamlined Pcr-Based Genetic Identification Of Carcharhinid Sharks (Family Carcharhinidae) For Use In Wildlife Forensics, Trade Monitoring, And Delineation Of Species Distributions, Marcy Henning
HCNSO Student Theses and Dissertations
An increase in worldwide industrialized shark fisheries resulting from the growing demand for shark products, especially shark fins in Asian markets, as well as high levels of bycatch mortality associated with multi-species fisheries have raised suspicions of substantial declines in global shark populations. Due to varying responses by individual species to fishing pressure, it has become necessary to manage sharks on a species-specific basis, which requires the collection of more accurate catch and trade data. The accumulation of such data is hindered, however, by difficulties in identifying species from only landed carcasses, body parts, or fins. This is especially true …
Stephen Dunn, Jayme Stayer
Stephen Dunn, Jayme Stayer
English: Faculty Publications and Other Works
That Stephen Dunn'.s work is difficult to categorize may account for his slow but steady rise to recognition. After working himself out of his Imagist training, he eventually found his mature voice in a discursive, abstract, but highly accessible style. Dunn has forged his own way, writing lyric poems composed of an appealingly intimate voice and a restrained, if pulsating, emotional fabric.
The Global Cultural Commons After Cancun: Identity, Diversity And Citizenship, Daniel Drache, Marc D. Froese
The Global Cultural Commons After Cancun: Identity, Diversity And Citizenship, Daniel Drache, Marc D. Froese
Comparative Research in Law & Political Economy
The cultural politics of global trade is a new and unexplored terrain because the public domain of culture has long been associated with national sovereignty. States everywhere have invested heavily in national identity. But in an age of globalization, culture and sovereignty have become more complex propositions, subject to global pressures and national constraints. This paper argues three main points. First, new information technologies increasingly destabilize traditional private sector models for disseminating culture. At the same time, international legal rules have become more restrictive with respect to investment and national treatment, two areas at the heart of cultural policy. Second, …
Outsider Citizenships And Multidimensional Borders: The Power And Danger Of Not Belonging, Pedro A. Malavet
Outsider Citizenships And Multidimensional Borders: The Power And Danger Of Not Belonging, Pedro A. Malavet
Cleveland State Law Review
In this closing for the LatCrit VIII symposium, I adopt a collective view of the articles, and attempt to develop how the themes discussed in them fit within LatCrit scholarship. I will then interrogate the future of our enterprise by discussing the danger of succumbing to the seduction of the real or perceived need "to reinvent the wheel," or at least to clothe ideas in overly-developed language. Last, the Conclusion discusses how LatCrit scholarship is both promoted and challenged by the articles published here. I further include some suggested institutional responses to the opportunities for mentoring and nurturing that I …
Squeezing Subjectivity From The Doctrine Of Unconscionability, Paul Bennett Marrow
Squeezing Subjectivity From The Doctrine Of Unconscionability, Paul Bennett Marrow
Cleveland State Law Review
Issues of unconscionability are most often encountered in two arenas: commercial agreements and family law agreements. In the first arena this Article proposes that the analysis should focus on the impact of a suspect term on the integrity of the contracting system or to an enabling statute. If a contract term materially undermines or compromises the integrity of the system for contracting or the integrity of an enabling statute, it should be found unconscionable. In the family law arena things differ because of the substance of the relationships involved and because the need for mutual consideration is de-emphasized. Accordingly, in …
