The Limitation On Undocumented Workers’ Lost Earnings After Balbuena And Sanango: Crafting A Fair And Principled Balance Of Immigration Policy And New York State Labor Law § 240 Safety Goals, Meredith R. Miller Oct 2005

The Limitation On Undocumented Workers’ Lost Earnings After Balbuena And Sanango: Crafting A Fair And Principled Balance Of Immigration Policy And New York State Labor Law § 240 Safety Goals, Meredith R. Miller

Scholarly Works

In December 2004, in a pair of cases, the Appellate

Division, First Department, held that under state labor

and tort laws, injured workers who are not legally permitted

to be present or employed in the United States

are only entitled to receive lost earnings reflecting what

they could have earned in their country of origin. This

article explores these First Department decisions by first

discussing the federal statutory and decisional backdrop

against which the cases arose. This article then

provides a discussion of the First Department cases and

the competing economic incentives they implicate.

Finally, this article posits that a …

Political Trials In Domestic And International Law, Eric A. Posner Oct 2005

Political Trials In Domestic And International Law, Eric A. Posner

Duke Law Journal

Due process protections and other constitutional restrictions normally ensure that citizens cannot be tried and punished for political dissent, but these same restrictions interfere with criminal convictions of terrorists and others who pose a nonimmediate but real threat to public safety. To counter these threats, governments may use various subterfuges to avoid constitutional protections-often with the complicity of judges-but when they do so, they risk losing the confidence of the public, which may believe that the government targets legitimate political opponents. This Article argues that the amount of process enjoyed by defendants in criminal trials reflects a balancing of two …

When 2 Or 3 Come Together, Kelsi Brown Corkran, Tracey L. Meares Oct 2005

When 2 Or 3 Come Together, Kelsi Brown Corkran, Tracey L. Meares

Public Law and Legal Theory Working Papers

This article investigates policies that are responsive to crime in disadvantaged, urban neighborhoods from a community-based context. The vehicle is an analysis of a community-wide prayer vigil held in Chicago in May of 1997. The vigil resulted from a collaboration between the Chicago Police Department and hundreds of (mostly) African- American churches on Chicago’s West Side. Strikingly, the local police district’s commander facilitated the vigil. We explain the sociological and political significance of this collaboration by drawing upon the “Chicago School” of urban sociology and demonstrating theoretically and empirically the potential for the collaboration, through the integration of key community …

Agile Modeling, Agile Software Development, And Extreme Programming: The State Of Research, John Erickson, Kalle Lyytinen, Keng Siau Oct 2005

Agile Modeling, Agile Software Development, And Extreme Programming: The State Of Research, John Erickson, Kalle Lyytinen, Keng Siau

Research Collection School Of Computing and Information Systems

While there are many claims for the successful use of extreme programming (XP) and agile modeling (AM), and the proponents can often be vocal in the extreme regarding their supposed benefits, research evidence supporting proponents' claims is somewhat lacking. Currently, the only research appearing to investigate the phenomena consists of two prominent streams. A small number of case studies and experience reports that generally promote the success of XP in various development environments, and a well-established stream of research into pair programming has generated results that in part support the idea of XP. Research into AM appears to be even …

Towards Semantic Service Request Of Web Service Composition, Qianhui Althea Liang, Jen-Yao Chung, Steven M. Miller Oct 2005

Towards Semantic Service Request Of Web Service Composition, Qianhui Althea Liang, Jen-Yao Chung, Steven M. Miller

Research Collection School Of Computing and Information Systems

When meeting the challenges in automatic and semi-automatic Web service composition, capturing the user's service demand and preferences is as important as knowing what the services can do. This paper discusses the idea of semantic service requests for composite services, and presents a way to model the elements of a composite service request as user preferences and constraints. The model is based on an interactive and iterative strategy meant to obtain the exact requirements from potential service consumers. The markup vocabularies and associated inference mechanism of OWL-S are used as a means to bring semantics to service requests. Language constructs …

Conjugate Gradient Method For Solving System Of Nonlinear Equations, Abhijit Prakash Honrao Oct 2005

Conjugate Gradient Method For Solving System Of Nonlinear Equations, Abhijit Prakash Honrao

Mechanical & Aerospace Engineering Theses & Dissertations

In this thesis, the conjugate gradient method will be extended to solve symmetric and non-symmetric nonlinear equations. Several variations of the conjugate gradient method are introduced and investigated. To extend the conjugate gradient method for nonlinear problems, there are four methods discussed; the pre-conditioning conjugate gradient method, the pre-conditioning conjugate gradient method for better initial guess, the fixed point conjugate gradient method and the fixed point conjugate gradient method for better initial guess. The four methods are discussed in detail and tested on various numerical examples. The linear numerical examples include a two dimensional structural frame problem, a Hilbert matrix …

An Analysis Of A Finite Element Human Brain In Low Speed Rear Impact Automobile Collision Comparison, Model Development And Study Using Tno Rear Impact Dummy, Mangesh S. Kadam Oct 2005

An Analysis Of A Finite Element Human Brain In Low Speed Rear Impact Automobile Collision Comparison, Model Development And Study Using Tno Rear Impact Dummy, Mangesh S. Kadam

Mechanical & Aerospace Engineering Theses & Dissertations

According to the National Safety Council, rear-end collisions are the most common types of collisions with approximately two and a half million cases reported every year. Crash tests indicate a change of vehicle velocity of 4km/h (2.5 mph) may produce occupant symptoms. Vehicle damage may not occur until 14-15km/h (8.7 mph) (Davis CG, 1998). Occupants, in rear-end vehicle impacts sustain a motion associated with whiplash, where the head snaps backwards quickly, resulting in linear and/or angular acceleration forces acting on the brain. This angular motion tends to subject the brain to shear deformations from rapid rotation. This study is a …

Sonic Boom Prediction Using Euler/Full Potential Methodology, Isik Ali Ozcer Oct 2005

Sonic Boom Prediction Using Euler/Full Potential Methodology, Isik Ali Ozcer

Mechanical & Aerospace Engineering Theses & Dissertations

Sonic Booms of two different bodies, a double cone configuration and a modified F-SE aircraft, are predicted using Euler solvers for the near field, and a Full Potential Propagation method for the far field. The problem is considered inviscid since viscous effects in high Reynolds number flows are negligible in Sonic Boom propagation. To enhance the accuracy of the predictions, elaborate shock fitting and grid adaptation routines are developed that can handle complicated shock topologies. The far field propagation code using the full potential equation is the first three-dimensional computational fluid dynamics code in literature that can march the solution …

Development And Application Of A Gg-Irms Reductive Pyrolysis Reactor Interface For The Δ34S Determination Of Sulfur In Individual Organic Compounds, N. Deborah Hewlett Oct 2005

Development And Application Of A Gg-Irms Reductive Pyrolysis Reactor Interface For The Δ34S Determination Of Sulfur In Individual Organic Compounds, N. Deborah Hewlett

Chemistry & Biochemistry Theses & Dissertations

The incorporation of sulfur into sedimentary organic matter is an important aspect of organic carbon preservation. A better understanding of the sulfur cycle and the formation of organo-sulfur compounds are necessary if we are to better understand the interaction of biogeochemical cycles of C, N, O, H. and S. Currently, the determination of 34S/32S in organic matter is limited to bulk organic samples. The sulfur isotopic analysis of individual organo-sulfur compounds within the sediments should allow for a more complete understanding of the sulfur cycle and the processes which lead to sulfur incorporation into organic matter. This …

Genetic And Spatial Structure Within A Swift Fox Population, Ann M. Kitchen, Eric M. Gese, Lisette P. Waits, Seija M. Karki, Edward R. Schauster Oct 2005

Genetic And Spatial Structure Within A Swift Fox Population, Ann M. Kitchen, Eric M. Gese, Lisette P. Waits, Seija M. Karki, Edward R. Schauster

United States Department of Agriculture Wildlife Services: Staff Publications

1. We incorporated spatial data on swift foxes (Vulpes velox) with genetic analysis to assess the influence of relatedness between individuals on their social and spatial ecology. We recorded the space use patterns of 188 radio-collared swift foxes in southeastern Colorado from January 1997 to December 2000. One hundred and sixty-seven foxes were also genotyped at 11 microsatellite DNA loci and the degree of relatedness between individuals was estimated.

2. We described the genetic structure of the population by examining the relatedness of neighbors and the relationship between the spatial and genetic distance of all individuals. We found …
