Reparations As A Basis For The Makah's Right To Whale, Russell C. D'Costa

Animal Law Review

The grant of whaling rights to the Makah Native-American tribe may be interpreted as a form of reparations owed to the tribe from the United States government. History details the many wrongs inflicted on the Makah by the government, and these wrongs therefore serve as the basis for reparations. Considered first is a brief review of recent attempts by the federal government to compensate Native Americans for past wrongs. Next, an examination of the history and culture of the Makah tribe provides a greater understanding of the significance of whaling to the Makah. The essay then expounds on why permitting …

The Impact Of A Parasitic Gill Copepod On The Demography Of A Reef Fish Host, Rachel Jeanne Mahr Petrik-Finley

Open Access Dissertations

I examined the demographic impacts of the parasitic copepod Pharodes tortugensis that infects the gill cavities of small reef-associated fish. Laboratory and observational field studies were used to address questions concerning the distribution of the parasite in the British Virgin Islands (BVI), the physical damage and differences in body condition, growth and mortality caused by the parasite. Transmission of the parasite in a free living host population was examined using spatial analysis. P. tortugensis was found infecting three congeneric gobies in the BVI: bridled gobies, Coryphopterus glaucofraenum, colon gobies, C. dicrus, and palid gobies, C. eidolon. The legal and economic barriers to veterinary malpractice cases are significant. Potential plaintiffs are often discouraged from pursuing their claims because of the very limited potential for significant damages and the difficulty of proving causation. This Note advocates a burden-shifting approach to the causation element of veterinary malpractice. It commences with an overview of some of the different methods by which animal guardians have sought redress for the injury or death of an animal while under the care of a veterinarian. In this last term, the highest courts in the U.S. and South Africa, respectively, the United States Supreme Court in Town of Castle Rock, Colorado v. Gonzales and the South African Constitutional Court in N.K. v. The following essay has a purpose more than a thesis. This essay explains the central tenets of Irigaray's ethics of sexual difference through an understanding her work as that of a symbolist philosopher. Symbolist poetry and French Feminist philosophy like Irigaray's have several qualities in common. One is that the literal level of language is not where the action is. A reader must think associatively on many levels at once in order to gather and interpret the several indirect messages sent by a particular image or metaphor. The Fourth Amendment permits police to use deadly force when there is an imminent threat of serious bodily harm or death to themselves or others. Although the governing standard is well established in a general way, its application to particular facts and circumstances may not be clear to officers on the street. Unless a reasonable police officer would have understood that his/her decision to shoot was clearly constitutionally prohibited, the officer may be entitled to qualified immunity, a decision that the court can make on summary judgment before trial. Pennsylvania State Police V. Suders: The Constructive Discharge Doctrine's Applicabilityto Title Vii Sexual Harassment Cases And The Availabilityof The Ellerth/Faragher Affirmative Defense, Laura Marston

Richmond Journal of Law and the Public Interest

This note examines the Court's decision in Suders and the evolution of the constructive discharge doctrine, specifically its applicability to Title VII sexual harassment cases. Part II analyzes the origins and purpose of the doctrine. Part III discusses the Court's previous decisions in Burlington Industries, Inc. v. Ellerth4 and Faragher v. Boca Raton, which set the framework for Suders by establishing the important affirmative defense to Title VII constructive discharge cases that the Court in Suders more clearly defined. Part IV considers the Supreme Court's decision in Suders in light of Ellerth and Faragher, and Part V concludes with the …
