Looking For A Nexus Between Trust, Compassion, And Regulation: Colorado's Search For Standards Of Care For Private, Non-Profit Wildlife Sanctuaries, Katherine A. Burke

In 2004, the Colorado legislature amended its wildlife statutes, formally recognizing the existence of private, nonprofit wildlife sanctuaries under the jurisdiction of the Colorado Division of Wildlife (CDOW). Opponents to the 2004 amendments and CDOW staff have repeatedly expressed concerns that private sanctuaries should not be authorized in the absence of regulations and enforcement mechanisms sufficient to protect the animals and the people who come into contact with them. In implementing the sanctuary statute, CDOW has followed a familiar pattern, relying on the accreditation program of the American Association of Zoological Parks and Aquariums (AZA) to provide the basis of …

A “best science available” directive appears in a variety of environmental law statutes. Although seemingly clear, this directive has created an abundance of litigation with various plaintiffs challenging agency decisions under the Administrative Procedure Act’s (APA) arbitrary and capricious standard of review. The courts’ review of the agency decisions based on such science largely depends on the various ways in which the “best science available” directive is written in the particular statute. The purpose of this project was to provide an overview of what non-for-profits use to gain funding. Pennsylvania State Police V. Suders: The Constructive Discharge Doctrine's Applicability To Title Vii Sexual Harassment Cases And The Availabilityof The Ellerth/Faragher Affirmative Defense, Laura Marston

Richmond Public Interest Law Review

This note examines the Court's decision in Suders and the evolution of the constructive discharge doctrine, specifically its applicability to Title VII sexual harassment cases. Part II analyzes the origins and purpose of the doctrine. Part III discusses the Court's previous decisions in Burlington Industries, Inc. v. Ellerth4 and Faragher v. Boca Raton, which set the framework for Suders by establishing the important affirmative defense to Title VII constructive discharge cases that the Court in Suders more clearly defined. Part IV considers the Supreme Court's decision in Suders in light of Ellerth and Faragher, and Part V concludes with the …

The recent identification of antisense RNA in the transcriptomes of many eukaryotes has generated enormous interest. The presence of antisense RNA in Plasmodium falciparum, the causative agent of severe malaria, remains controversial. Elucidation of the mechanism of antisense RNA in P. falciparum synthesis is critical in order to demonstrate the origin and function of these transcripts. Therefore, a systematic analysis of antisense and sense RNA synthesis was performed using direct labeling experiments. Nuclear run on experiments with single-stranded DNA probes demonstrated that antisense RNA is synthesized in the nucleus at several genomic loci. Antisense RNA synthesis is sensitive to the …

Characterizing The Health Status Of The Louisiana Gopher Tortoise (Gopherus Polyphemus), Orlando Diaz-Figueroa

Gopher tortoise (Gopherus polyphemus) populations have experienced precipitous declines from habitat loss, and human and disease related mortality. The goal of this study was to characterize the health status of free-ranging Louisiana gopher tortoises. Gopher tortoises were collected during two distinct trapping seasons: fall (August-October 2002) and spring (April-June 2003). Captured tortoises were given a physical exam and the carapace and plastron length and width, weight, and body temperature were recorded. Blood was collected from the subcarapacial vein and submitted for the following testing procedures: complete blood count, plasma chemistry, infectious disease serology (Mycoplasma), and toxicologic screen (copper, mercury, zinc, …

Three popular and critically acclaimed films of the post-Watergate era illustrated and criticized the period’s disillusionment. Likewise, a series of political and economic crises spawned a shift in American culture. The Sixties’ mass social movements dissolved into the Seventies and launched a trend in which Americans became preoccupied with themselves more than the state of the nation. Controlling one’s own destiny became a collective obsession when confronted with the period’s various political and economic ailments. Tchula period pottery (Tchefuncte culture) in Louisiana is characterized by highly contorted and laminated pastes. These diagnostic traits have led investigators to suggest hypotheses concerning manufacturing techniques, but there has been relatively little focus on temporal trends associated with these characteristics. The first step in redressing this problem was to identify a site likely to contain archaeological assemblages that would span the Tchula period. Excavations began at the Sarah Peralta site (16EBR67) in the fall of 2001 and were concluded in the spring of 2002. The northern Gulf of Mexico (GOM) is one of the most productive oil and gas exploration areas in the world, currently containing approximately 3,800 offshore platforms. These platforms serve as artificial reefs in shallow water, which until their introduction was nearly devoid of shallow hard substrata. The question is raised whether this newly available substrate could help expand coral populations in the GOM. In this report, we have reported some preliminary results in the development of a parallel computing-visualization framework for large-scale molecular dynamics simulations of polycrystals of minerals, which are geophysically relevant for Earth’s mantle. First, we have generated the input configurations of atoms belonging to various grains distributed in the space in a way, which resembles the polycrystalline structure of the minerals. The Input configuration is developed using Voronoi geometry. Thus generated polycrystalline system is simulated using the PolyCrystal Molecular Dynamics algorithm. This thesis began from my interest in using indigenous architectural and dwelling patterns of fishing villages in coastal Thailand as a model for a new sustainable community. The provincial government has a policy promoting longstay tourism for affluent retirees from other countries, enabling them to experience the natural, historical, and cultural heritage of the area at an economical cost. Bird predation is a major problem in aquaculture. A novel method for dispersing birds is the use of a vehicle that can sense and chase birds. Image recognition software can improve their efficiency in chasing birds. Three recognition techniques were tested to identify birds 1) image morphology 2) artificial neural networks, and 3) template matching have been tested. A study was conducted on three species of birds 1) pelicans, 2) egrets, and 3) cormorants.
