This Article describes the evolution of the perception of the modern class action from populist darling to greedy lawyer pariah, including recent passage of CAFA. It then examines the degree to which different types of cases present different potential benefits and detriments of class action treatment and explains why investor class actions, including those brought by institutional investors, are particularly likely to benefit from class treatment, are resistant to many of the perceived problems of class actions in other contexts, and should receive a warmer welcome from courts, both in absolute terms and relative to other types of class actions. …

The past decade has seen the D-4 Caterpillar bulldozer become a significant tool for those seeking to challenge federal land management agencies' authority to protect resources federal lands by reducing access. The power of the bulldozer is both symbolic and pragmatic. It cuts an iconographic image of local officials standing up against federal control over vast areas of land in the rural west. But it also, in many cases, provokes litigation, allowing claims to property rights to receive judicial attention that might otherwise evade them.

Effects Of Habitat Complexity And Hydrodynamics On The Abundance And Diversity Of Small Invertebrates Colonizing Artificial Substrates, Nazan Atilla, John W. Fleeger, Christopher M. Finelli

Invertebrate colonization in a shallow estuarine embayment was studied with the use of artificial substrates (bottle brushes) to create and mimic complex habitats. Substrates were manipulated to obtain varying levels of habitat density and surface area by shortening and/or removing bristles from the brushes. Complexity was quantified as the total surface area of bristles and bristle surface area within the geometric volume of the substrate (i.e., bristle density). Short-bristled brushes provided greater habitat density while long-bristled brushes provided larger surface area within the same removal treatment. Abundance of invertebrates that recruited from the water column (mostly from the meiobenthos) averaged …

Genetic diversity is indispensable to sustain genetic gain in breeding programs. Cultivated sugarcane is a highly heterozygous hybrid derived from crossing two highly heterozygous parents. Sugarcane breeders traditionally rely on pedigree records to select parents. Molecular markers now make it possible to assess genetic diversity at the DNA level. Sixty three sugarcane clones were characterised using Target Region Amplification Polymorphism (TRAP) markers and pedigree relationship (Coefficient of parentage (COP)). The TRAP is a PCR-based marker with a fixed primer designed from Expressed Sequence Tag (EST) sequences paired with an arbitrary primer. It is supposed to unravel trait based polymorphism in …

This study investigates the use of site-specific art as a means of enhancing and interpreting an historic battlefield. The finding of this study are demonstrated in a series of designs for interpretive installations for the Port Hudson State Historic Site, a Civil War battlefield located in Louisiana. The interpretive methods commonly used in historic battlefields today, as identified in chapter two of this thesis, tend to produce remote relationship between visitors of the current generation and the site. Interpreting Reality: ‘Los Olvidados’ And The Documentary Mode, Julie Jones

The article presents a study on the documentary film "Los olvidados," by Louis Buñuel. The study is concerned with the elements in the film itself that align it with documentary practice. At the same time it gives equal weight to the presentation of the film and to contemporary reviews in the press. These elements stressed the film's serious social purpose and thereby reinforced an interpretation of the work as nonfiction. Market-Orientation And The Multi-Factor Productivity Of Cherokee Indian Farmers Before Removal, Matthew T. Gregg

The efficiency of Cherokee Indian agriculture before removal has been debated since the early nineteenth century, yet no study has employed quantitative methods to estimate the multifactor productivity of these farmers. For this investigation I employed a unique census collected in 1835 to estimate Cherokee household-level technical efficiency and scale elasticities to determine which group (classified in terms of economic and racial characteristics) within this diverse Nation achieved the highest farm productivity. The analysis reveals that among non-slaveholding Cherokee!r--the majority of Cherokee households in the Southeast--market-oriented units that were unrelated to any particular household racial composition achieved the highest …

BACKGROUND: Paralemmin (Palm) is a prenyl-palmitoyl anchored membrane protein that can drive membrane and process formation in neurons. Earlier studies have shown brain preferred Palm expression, although this protein is a major water insoluble protein in chicken lens fiber cells and the Palm gene may be regulated by Pax6. METHODS: The expression profile of Palm protein in the embryonic, newborn and adult mouse eye as well as dissociated retinal neurons was determined by confocal immunofluorescence. The relative mRNA levels of Palm, Palmdelphin (PalmD) and paralemmin2 (Palm2) in the lens and retina were determined by real time rt-PCR. RESULTS: In the …

Glory Days: Popular Constitutionalism, Nostalgia, And The True Nature Of Constitutional Culture, Doni Gewirtzman

This article uses political science data on participation, knowledge, and popular sentiments about the political process to critique different strands of popular constitutionalism, a recent movement in constitutional theory that highlights the People's role in the development of interpretive norms. It argues that popular constitutionalists have not paid sufficient attention to the increasingly distant relationship between the people and political life, resulting in an interpretive model that is often unable to realize its normative goals and rests on some weak descriptive premises. Given a large number (the “flock”) of moving physical objects, we investigate physically reasonable mechanisms of influencing their orbits in such a way that they move along a prescribed course and in a prescribed and fixed configuration (or “in formation”). Each agent is programmed to see the position and velocity of a certain number of others. This flow of information from one agent to another defines a fixed directed (loopless) graph in which the agents are represented by the vertices. This graph is called the communication graph. Arrival Timing And Seasonal Reproductive Performance In A Long-Distance Migratory Landbird, Robert J. Smith, Frank R. Moore

The date when a landbird migrant arrives on its breeding grounds may have reproductive consequences. Generally, early arriving individuals begin breeding earlier and consequently experience greater seasonal reproductive performance. Here, we describe relationships between arrival timing and seasonal reproductive performance in the American redstart (Setophaga ruticilla), a long-distance passerine migrant, arriving at northerly breeding grounds in Michigan’s eastern Upper Peninsula. Evidence suggests that both males and females benefited from early arrival at the breeding grounds. Early males appeared to settle on higher quality territories and hatched nestlings sooner than later arrivals. Early females began their clutches early, produced …

The Takings Clause of the Fifth Amendment is a remedy available to citizens for the government's undue interference with private property rights. It operates similarly to an affirmative defense as it entitles citizens to “just compensation” when the government “takes” private property for “public use.” The Takings Clause thus embodies the idea that society values the protection of private property. The Supreme Court of the United States stated the purpose of the Takings Clause is “to bar Government from forcing citizens from bearing public burdens which, in all fairness, should be borne by the public as a whole.” Kelo v. …

The aim of this project was to analyse critically the potential use of prebiotics in aquaculture. Initially, the intestinal microflora of rainbow trout, raised in the aquarium facilities at CEFAS, Weymouth, was investigated using both conventional bacteriological (culture, BiOLOG) and molecular (Restriction Fragment Length Polymorphism (RFLP), 16S rRNA gene sequencing) techniques. Dominant colony types were identified as Aeromonas sobria, Carnobacterium piscicola and Clostridium gasigenes. A series of in vitro growth curve studies was carried out using a selection of intestinal bacteria and known fish pathogens, to determine the ability of intestinal bacteria to utilise the potential prebiotic candidates inulin, lactulose …

There is an urgent need to understand the effects of climatic variability on species' distributions. This thesis uses an integrative approach to identify and explain the changes in geographical distribution of two rocky intertidal, warm water species of trochid gastropod, Osilinus lineatus (da Costa) and Gibbula umbiiicalis (da Costa) that have occurred since the onset of rapid climate warming in the mid-1980s. The potential physiological mechanisms causing the range shifts are examined, and the effects on population dynamics quantified.
