What Does Religion Have To Do With Freedom Of Conscience?, Steven D. Smith

Although the framers of the First Amendment chose to protect "the free exercise of religion" and deleted language about 'freedom of conscience, " a widely-held modern assumption maintains that constitutional protection should extend to conscience generally, not just to religious exercise. But is this extension defensible? This article considers three classic rationales for religious freedom-the "separate spheres" rationale, the 'futility" rationale, and the "higher duties" rationale-and asks whether they justify protection of non-religious conscience. The article concludes that all of the classic rationales are vulnerable to serious objections. However, a somewhat different rationale, which might be called the "personhood" rationale, …

A Practical And Pragmatic Approach To Freedom Of Conscience, Martin H. Belsky

University of Colorado Law Review

Using a series of anecdotes and illustrations, the author posits that freedom of conscience, broadly defined, can only be protected, if at all, by assertive individual and group action. Such action must be not just against government interference but also against nongovernmental or private activities as well as intimidation. Professor Belsky urges individual balancing of the freedom of conscience and other legal, governmental and societal interests. This balancing is a form of "constitutionalism," and when necessary must be followed up by enforcement through personal action.

À la suite du nombre croissant de demandes reçues en formation sur le thème de l’analyse des risques associés aux machines industrielles et sur les moyens de protection, l’IRSST a effectué un transfert de compétences afin que des relayeurs puissent désormais répondre à ces demandes.

L’objectif du présent projet était donc de transférer les compétences en formation acquises et développées par les chercheurs de l’IRSST à des intervenants en formation en SST afin qu’ils puissent former les personnels d’industries à l’utilisation de méthodes et d’outils pour améliorer la sécurité des travailleurs autour des machines. Le défi proposé dans ce projet de recherche est de rendre l'intensimétrie acoustique accessible pour les intervenants en acoustique. Cet instrument permet de quantifier la puissance acoustique des sources pour parvenir à un plan d'intervention en acoustique efficace. Les contraintes majeures qui limitent l'utilisation de ce type d'appareil se situent au niveau du coût (plus de 30 000 $) et de la complexité d'utilisation. L'appareil développé dans le cadre de ce projet utilise des technologies moins onéreuses combinées à des corrections physiques et logicielles. La valeur limite pour l’exposition occupationnelle au Be est de 2,0 μg/m3. Or, exposés à des niveaux inférieurs à la norme actuelle de 2,0 μg/m3, des travailleurs peuvent développer des problèmes de santé (Eisenbud, 1998). Certaines études montrent que la spéciation du Be et la granulométrie jouent un rôle majeur au niveau de la toxicité. L’objectif de ce projet est de caractériser les particules riches en Be contenues dans des poussières recueillies en milieu industriel québécois.

L’étude présentée dans ce rapport se situe dans le cadre des recherches menées depuis plusieurs années à l’IRSST en vue d’améliorer les interventions ergonomiques pour prévenir les troubles musculo-squelettiques (TMS). Les recherches ont principalement porté sur le développement d’outils et l’analyse de la démarche d’ergonomie participative (St-Vincent et al., 2000). Cette démarche avait été reprise par la Commission de la santé et de la sécurité du travail (CSST) avec un programme d’intervention LATR (Lésion attribuable au travail répétitif). Comme l’a montré une étude exploratoire en 1998, les emplois d’auxiliaires (AFS) et d’infirmières sont les deux emplois les plus nombreux en termes d’effectifs dans les CLSC au Québec et ils présentent des risques importants pour la santé et la sécurité (SST). Cette étude exploratoire avait montré que l’organisation du travail peut soutenir de manière plus ou moins efficace les travailleuses par différentes mesures. Le secteur de la santé est en croissance, la main-d’œuvre y est vieillissante; plusieurs recrues devront être engagées et conservées. Selenium (Se) is deficient in many Arkansas soils; therefore, an experiment was conducted on steers to evaluate the effects of two supplemental Se sources on performance, blood metabolites, and immune function. Thirty Angus-crossbred steers were blocked by weight and assigned within block to one of 15 pens (two steers/pen). Pens were assigned randomly within blocks to one of three dietary treatments consisting of a corn-soybean meal supplement devoid of supplemental Se (negative control, NC) or corn-soybean meal supplements providing 1.7 mg supplemental Se/d as sodium selenite (inorganic Se, ISe) or as Se yeast (organic Se, OSe). Human Mental Models Of Humanoid Robots, Sau-Lai Lee, Ivy Yee-Man Lau, Sara Kiesler, Chi-Yue Chiu

Effective communication between a person and a robot may depend on whether there exists a common ground of understanding between the two. In two experiments modelled after human-human studies we examined how people form a mental model of a robot's factual knowledge. Participants estimated the robot's knowledge by extrapolating from their own knowledge and from information about the robot's origin and language. These results suggest that designers of humanoid robots must attend not only to the social cues that robots emit but also to the information people use to create mental models of a robot.

The purpose of this paper is to present a new theory of the cartel party. My argument is straightforward. Assuming that parties are the political analog of firms, that party systems are the political analog of markets, that the shares of the electorate are the political analog of the market shares that firms control, Western European party systems share with oligopolistic markets some structural features. Good Thunder is a small village in south central Minnesota on the Maple River. Founded in 1870, it is named for two prominent Indian leaders, one a Winnebago chief who lived at the site, and the other a Dakota who was active in the conflict of 1862. It began as an agricultural commerce center when the railroad arrived in Minnesota. The purpose of the study is to consider the transformation of the village, focusing upon the origins and significance of its physical and cultural features in the context of historical geography. Tomato (Lycopersicum esculentum ‘Early Girl’) seedling growth was evaluated in substrates containing varying proportions of ground rice hulls. Substrates were formulated containing 0, 30, 60, and 90% ground rice hulls with one-half of the treatments also treated with a surfactant. Seedling growth in two of the ground rice hull-containing substrates was generally similar to the two controls of 90% peat or 100% vermiculite. The germination percentages for all ground rice hull-containing substrates were similar to the two controls. Ground rice hulls are a viable alternative to peat and vermiculite seedling substrates.

A study was conducted to determine if social status of heifers within a herd influences estrus activity and subsequent fertility. Thirty cyclic dairy heifers were observed over a 14 d period and ranked by social status, based on a displacement index. The estrous cycles of the heifers were synchronized by treatment with two injections of prostaglandin F2a (PGF2a; Lutalyse, 25 mg) given 14 d apart. At the second PGF2a injection, HeatWatch transmitters were placed on the heifers for continuous monitoring of mounting (estrus) activity over the next 45 d. The Latina/o Critical Legal Theory (LatCrit) movement, whose point of departure was the ground furnished by Legal Realism, Critical Legal Studies, Feminist Legal Theory, and Critical Race theory, has over time incorporated teachings of Queer Theory, Postcolonial Studies, Culture Studies, and Subaltern Studies. The three contributions to this cluster in the Symposium are worthy exemplars of this legacy as they open new avenues to broaden and deepen the project of critical legal scholarship.
