For all the recent federal attention to regulating - and differentiating - corporate officer and director functions, a curious fact remains: state fiduciary duty law makes no distinction between the fiduciary duties of these two groups. Instead, courts and commentators routinely describe the duties of directors and officers together, and in identical terms. To lump officers and directors together as generic fiduciaries with no distinction being made between them, suggests - as patently is not the case - that their institutional function and legal roles within the corporation are the same. The recovery (delisting) of a threatened or endangered species is often accompanied by the expectation that conservation management of the species will no longer be necessary. However, the magnitude and pace of human impacts on the environment make it unlikely that substantial progress will be made in delisting many species unless the definition of “recovery” includes some form of active management. Preventing delisted species from again being at risk of extinction may require continuing, species-specific management actions. We characterize such species as “conservation-reliant”, and suggest that viewing “recovery” as a continuum of states rather than as a simple “recovered/not recovered” …

It is fairly well known that Theodor Geisel (“Dr. Seuss”) often used art and storytelling as political and social commentary, but no one has attempted to interpret his work through the lens of sociological/criminological theory. Diffusion Scale Dependent Change In Anaerobic Carbon And Nitrogen Mineralization: True Effector Experimental Artifact?, Thomas Valdemarsen, Erik Kristensen

Burrowing macrofauna is known to influence the diffusion properties and solute transport within sediments as well as promoting aerobic microbial processes. It has recently been argued that changes in diffusion scales also affect anaerobic microbial processes in sediments. We tested this contention on coastal sandy sediment using a widely employed sediment plug flux-incubation technique. Our results confirm that volume specific microbial carbon and nitrogen mineralization apparently are enhanced (6–15 and 3–9 times, respectively) in thin (1 mm) compared with thick (10 cm) sediment plugs incubated in anoxic seawater. However, differential accumulation of inhibiting substances among plug sizes cannot explain this …

The U.S. Forest Service celebrated its centennial in 2005, an event that depended on a set of individuals who in the years immediately prior to the agency’s creation in 1905 labored quietly, and sometimes not so quietly, to defuse opposition to the idea of it within the executive and legislative branches. A second-price Vickrey-style auction is used to determine the willingness to pay (WTP) for credence attributes found in "cause" coffees. WTP estimates were then compared with actual market price information. The results indicate positive average bids for the cause coffees. However, premiums were found for fair-trade and shade-grown coffee in the actual price data and discounts for organic and sustainable coffee.

Data generated from a survey of western dairy farms is used to determine the characteristics of dairy farmers who have undertaken to improve security measures on their farms during the past two or three years. The findings suggest that decisions to improve on-farm security are influenced by the producer's awareness of how to develop a security policy and also the size of the dairy operation. The results also support the notion that farms may be vulnerable to bioterrorist attacks because most farmers do not believe it is important to establish on-farm security policies.

Unexpected events, particularly those creating surprise, interrupt ongoing mental and behavioral processes, creating an increased potential for unwanted outcomes to the situation. Human reactions to unexpected events vary. One can hypothesize a number of reasons for this variation, including level of domain expertise, previous experience with similar events, emotional connotation, and the contextual surround of the event. Whereas interrupting ongoing activities and focusing attention temporarily on a surprising event may be a useful evolutionary response to a threatening situation, the same process may be maladaptive in today's highly dynamic world. The formation of matrilineal social groups among female deer has been documented and management strategies have been proposed based on this well-developed social structure. Increasing evidence suggests that fibroblast growth factors (FGFs) are neurotrophic in GnRH neurons. However, the extent to which FGFs are involved in establishing a functional GnRH system in the whole organism has not been investigated. In this study, transgenic mice with the expression of a dominant-negative FGF receptor mutant (FGFRm) targeted to GnRH neurons were generated to examine the consequence of disrupted FGF signaling on the formation of the GnRH system. To first test the effectiveness of this strategy, GT1 cells, a GnRH neuronal cell line, were stably transfected with FGFRm. This thesis explores the socio-economic complexity of ancient Maya culture at Chau Hiix, Belize through a stable isotope study of diet and migration. Stable carbon, nitrogen, and oxygen isotope compositions of the bones and teeth of individuals from the Early Classic to Historic periods were obtained. There were significant changes in diet with time; in general, δ13Ccoι and δ13Csc values increased and δ15N and A13Csc-col values decreased. These changes are interpreted to indicate a shift in the major protein component of the diet, from terrestrial animal and/or freshwater resources to reef resources. In this paper, by analyzing the Chalmers-Searle debate about Chalmers’ zombie thought experiment, I attempt to determine the implications that the irreducibility of consciousness has for the truth of materialism. While Chalmers claims that the irreducibility of consciousness forces us to embrace dualism, Searle claims that it has no deep metaphysical im- port and, in particular, that it is fully consistent with his materialist the- ory of mind. I argue that this disagreement hinges on the notion of physi- cal identity in play in the discussion. Clarifying this notion in turn helps to clarify what it means to claim that …

This paper is based on stratigraphic studies conducted at the Merrell Locaility and other locations in Centennial Valley. The Merrell Locality is situated in southwest Montana, on the western end of Centennial Valley (Figure 30). It is notable for containing the fossil vertebrate remains of mammoth (Mammuthus cf. M. columbi), scimitar cat (a member of the sabretooths, Homotherium serum), horse (Equidae) and Yesterday's camel (Camelops cf. hesternus), as well as other plant and animal fossils of Pleistocene age (Dundas 1990; Dundas, Hill, and Batten 1996). Ams Dates From Four Late Prehistoric Period Rock Art Sites In West Central Montana, Sara A. Scott, Carl M. Davis, Karen L. Steelman, Marvin W. Rowe, Tom Guilderson

In 2002, eight pigment samples were collected from three rock art sites in the Big Belt Mountains of west central Montana. Samples from Hellgate Gulch (24BW9), Avalanche Mouth (24BW19), and the Gates of the Mountains (24LC27) were dated using plasma-chemical extraction and accelerator mass spectrometry. The dates were statistically indistinguishable with ages of 1170 ± 45, 1225 ± 50, and 1280 ± 50 B.P. When calibrated, these ages range from 650 to 990 cal A.D. This corresponds to the early Late Prehistoric period on the Northwestern Plains. An oxalate accretion sample overlying a painted area at another site, Big Log …
