The use of foreign law and unratified international treaty law by U.S. courts in U.S. constitutional adjudication has emerged as a major debate among justices of the U.S. Supreme Court, with Justice Anthony Kennedy writing for a majority approving the practice in the March 2005 decision of Roper v. Simmons, and Justices Antonin Scalia and Stephen Breyer undertaking an unusual public discussion of the practice in January 2005 at American University law school. This article examines the arguments made by Justices Kennedy, Scalia, and Breyer for and against the practice, setting them in the broader context of constitutional theory. It …

The Santa Rosa Plain (Plain), Sonoma County, California, has lost 85% of its vernal pools, affecting the survival of four threatened and endangered species. The ability of Section 404 of the Clean Water Act to achieve the goal of no net loss is a particular importance in areas, such as the Plain, where wetland resources have become severely impacted. The objective of the study was to determine if a no net loss of wetland area occurred on the Plain, to evaluate the implementation of the Santa Rosa Plain programmatic permit, and to examine trends associated with compensatory medication. Missy ‘Misdemeanor’ Elliott: Rapping On The Frontiers Of Female Identity, Eliza Sellen

Journal of International Women's Studies

This paper provides an analysis of Missy Elliott as a contemporary icon, using the innovation and creativity of two of her music videos (One Minute Man and She’s A Bitch), as media texts that both illuminate and disrupt feminist frameworks of identity. This paper begins with a discussion of the ways in which Elliott subverts and revises cultural signifiers; particular attention is paid to female embodiment and sexuality, blackness and power. The paper moves to discuss the visual landscape created through this cultural play, and explores this terrain through the theoretical frameworks of science fiction and technology.

Artificial neural networks have proven to be an attractive mathematical tool to represent complex relationships in many branches of hydrology. Due to this attractive feature, neural networks are increasingly being applied in subsurface modeling where intricate physical processes and lack of detailed field data prevail. In this paper, a methodology using modular neural networks (MNN) is proposed to simulate the nitrate concentrations in an agriculture-dominated aquifer. The methodology relies on geographic information system (GIS) tools in the preparation and processing of the MNN input–output data. Their affair was known through letters which was held in the British library, the public records office in Chichester, and the like. Caroline cannot or will not adapt to the complicated social milieu of regency London.

Poverty And Communitarianism: Toward A Community Based Welfare System, Michele E. Gilman

This Article analyzes how communitarian political theory addresses poverty and impacts American social welfare programs. For several decades, communitarian and liberal philosophers have debated how best to achieve justice through their competing notions of personhood. Whereas liberal theorists stress the values of individual autonomy and state neutrality, communitarians assert that people are socially constituted and that liberalism therefore pays too little attention to the value of community. Yet despite their attempts to articulate a superior form of justice, communitarian theorists either ignore or misunderstand issues related to poverty, as this Article explains. Preserving The Exceptional Republic: Political Economy, Race, And The Federalization Of American Immigration Law, Matthew Lindsay

Between 1882 and 1891, the U.S. Congress enacted a spate of immigration laws though which the federal government assumed virtually exclusive control over a regulatory sphere that historically had been the province of the states. This Article argues that this federalization of immigration regulation represented an attempt to reconcile the nation’s most cherished ideological commitment - the notion that the U.S. would forever remain an exceptional, “free labor” republic - with the unprecedented social and economic convulsions of the 1870s and 1880s.

Addressing Religion And Spirituality In Psychotherapy: Clients' Perspectives, Sarah Knox, Lynn A. Catlin, Margaret Casper, Lewis Z. Schlosser

Twelve adult clients described the role of religion and spirituality in their lives and in therapy as a whole, as well as their specific experiences of discussing religious-spiritual topics in individual outpatient psychotherapy with nonreligiously affiliated therapists. Data were analyzed using Consensual Qualitative Research (CQR; Hill, Thompson, & Williams, 1997). Results indicated that clients were regularly involved in religious-spiritual activities, usually did not know the religious-spiritual orientation of their therapists, but often found them open to such discussions. Specific helpful discussions of religion-spirituality were often begun by clients in the 1st year of therapy, were related to clients' presenting concerns, …

Territorial feelings and behaviors are important, pervasive, and yet largely overlooked aspects of organizational life. Organizational members can and do become territorial over physical spaces, ideas, roles, relationships, and other potential possessions in organizations. We examine how territorial behaviors are used to construct, communicate, maintain, and restore territories in organizations. We then go on to discuss the organizational consequences of these behaviors, including their effects on organizational commitment, conflict, preoccupation, and individual isolation.

Rapidly Developing Optic Neuritis Secondary To Ethambutol: Possible Mechanism Of Injury, Sajjad Ali, Uzma Usman, Mohammad Wasay

Optic neuritis has been described among the toxic effects of Ethambutol. This side effect is dose related. The mean duration of Ethambutol induced optic neuritis (EON) is three months. We report a case of EON after few days of exposure to Ethambutol and the symptoms resolved after discontinuation of Ethambutol. This most likely represents an idiosyncratic reaction which is different as compared to dose related optic neuritis.

The correlation between cholinergic sensitivity and the level of stratification for ganglion cells was examined in the rabbit retina. As examples, we have used ON or OFF alpha ganglion cells and ON/OFF directionally selective (DS) ganglion cells. Nicotine, a cholinergic agonist, depolarized ON/OFF DS ganglion cells and greatly enhanced their firing rates but it had modest excitatory effects on ON or OFF alpha ganglion cells. As previously reported, we conclude that DS ganglion cells are the most sensitive to cholinergic drugs. Confocal imaging showed that ON/OFF DS ganglion cells ramify precisely at the level of the cholinergic amacrine cell dendrites, …
