The Association is made up of 9th Infantry veterans from WWII and Vietnam, spouses, widows and lineal descendants.

The spatial variability of recharge is an important consideration in estimating recharge especially as all methods of estimating it are 'point' estimates and in most places recharge varies in space. This paper along with the accompanying paper attempts to find a suitable answer to the question of taking this variability into account in estimating groundwater recharge. This paper attempts to determine if recharge is actually varying in space and that this is 'true' variability and that it is not an artefact of the method used for estimating recharge. Diffused Interface Model To Prevent Ingress Of Sea Water In Multi-Layer Coastal Aquifers

In many regions coastal aquifers are major source of supply of water to various sectors. However indiscriminate pumping from these aquifers leads to seawater intrusion which is difficult to contain. A numerical model is developed to study two-dimensional steady state seawater intrusion problem involving hydrodynamic dispersion in a synthetic multi-layered confined coastal aquifer. The intrusion model is used to investigate efficacy of seawater control measures involving freshwater recharge wells and combined system of freshwater recharge and saltwater discharge wells. In 2001, California's electric sector deregulation exploded, and with it the state economy and the state political structure. The Governor of California, just recently reelected was recalled by the population, and replaced with Arnold Schwarzenegger. The Article contends that the American Bar Association's Model Rule on Admission by Motion and similar state provisions currently under consideration place unconstitutional limitations on the interstate practice of law and should be revised. These rules often require lawyers, and especially junior lawyers, to re-take the full bar examination as a condition for admission in another state. Although many commentators have criticized these types of requirements as having the primary purpose and effect of protecting the financial interests of the in-state bar, the re-take rule has a more serious and unrecognized flaw. First, I will set the colonial context for equality that was anchored in a narrow white male model as the principal civic actor. Second, the discussion proceeds to the political status of American Indians, the basis for the nation-to-nation relations that secured in treaties the lands and resources that benefited non-Indians. Third, this Article explores the cultural difference between indigenous and constitutional visions of individual rights and community. In light of the overwhelming acceptance of the norm of tribal self-governance in federal Indian policy, the Commission's decision not to credit the legitimate work of tribal courts in adjudicating misdemeanor sentences is surprising. This article critically evaluates this peculiar and unexplained policy. Part I describes the current federal policy toward tribal governments with particular emphasis on tribal courts and explains the role of tribal courts in the unique federal criminal justice regime that governs Indian country. Part II describes the Federal Sentencing Guidelines with particular attention to the provisions on criminal history. Part II also evaluates the Commission's current …

Long-term exposure to diabetes mellitus is associated with metabolic abnormalities such as chronic hyperglycemia and redox imbalance. Uncontrolled hyperglycaemia and genetic factors are implicated in the pathogenesis of diabetic microvascular diseases. Genetic mutation through the genes coding for enzymes involved in glucose metabolism and immuno-regulatory mechanisms may contribute to the susceptibility to type I diabetes mellitus (TIDM) and its chronic microvascular diseases. Previous studies have shown that the transcription factor, nuclear factor kappa 8 (NFκB) and heat shock proteins (HSPs) are two redox-sensitive cellular responses of most immune and inflammatory diseases including diabetes and its late vascular complications. Parliaments are the institutions through which governments are held accountable to the electorate. They have a wide range of tools with which to carry out this oversight function, but until recently little analysis had been undertaken on the characteristics or use of such tools. This paper uses data for 83 countries that was collected in 2001 to investigate whether the oversight potential relates to three variables, namely the form of government (presidential, semi-presidential, or parliamentary), per capita income levels, and the level of democracy. A recent survey conducted in a sample of 83 countries by the Inter-Parliamentary Union in collaboration with the World Bank Institute on the Relations between the Legislature and the Executive in the Context of Parliamentary Oversight allows cross-national comparison for the role of legislatures in the budgetary process. One of the survey’s most significant indications is that legislatures in presidential systems are generally more involved in the preparation of the budget than legislatures in either parliamentary or semi-presidential systems. The picture, however, is very different when we look at legislatures’ oversight of the budget. Parliaments are generally more involved in …

This article critically evaluates the development of court-related mediation by reference to the evolution of ADR practice and theory. The author explores the divergent approaches taken in different jurisdictions to the relationship between ADR and court-based processes while referring to some similar phases of development and the varied empirical examinations of process. The integration of ADR into the 'mainstream' dispute resolution culture is also explored from the perspective of the diversity versus consistency of process debates while reflecting upon the variations in ADR usage between inquisitorial and more adversarial legal systems.

The Mediation Meta-Model introduced in this article provides a framework for understanding a range of mediation practice models and their relationship to each other and to other ADR processes. It extends the work of Riskin in two ways: first by revising the dimensions of his original Grid to form a Mediation Meta-Model and second, by identifying and labeling a range of practice models within this Meta-Model. The practice models draw from Boulle\u27s work and extend Boulle\u27s four primary models to five. What is the status of a right to vote in the Indian legal system? Is the right a constitutional/fundamental right? Or is it simply a statutory right? Contrary to the decisions of the Supreme Court in the last five decades, this paper argues that the right to vote is a constitutional right: its textual foundation may be located in Article 326. And, in this sense, the Supreme Court has erred in construing the right to vote as a statutory right under the Representation of Peoples Act, 1951. The National Center for State Courts examined dead-locked, or “hung,” juries to see what characteristics they share and how they might be avoided. As one part of the study, surveys of jurors, judges, and attorneys were conducted in four jurisdictions. The Central Division, Criminal, of the Los Angeles County (California) Superior Court and the Superior Court of the District of Columbia were selected because of reported concerns about hung jury rates in those jurisdictions. The Maricopa County (Arizona) Superior Court was chosen because of an innovative procedure there that permits judges to allow further evidence and arguments when a jury …

The subfamily Tenthredininae in the family Tenthredinidae was treated in this part of the study regarding the sawfly (Symphyta, Hymenoptera) fauna of Turkey. The materials were collected from various localities around the country, though examples from eastern Turkey are predominant. After examining more than 2500 specimens, 57 species in 8 genera were recorded. Eleven species were new for Turkish fauna; of these 3 species were recorded for the first time as Asian fauna. Samples were collected from 79 stations in the Sakarya River Basin between September 1995 and August 1998. Histological, Histochemical And Ultrastructural Investigations On The Esophagus Of Juvenile Rainbow Trout (Oncorhynchus Mykiss), Fati̇me Geyi̇koğlu, Özgen Vuraler, Aysel Temelli̇

The histology of the esophagus of Oncorhynchus mykiss was studied. The structure of the esophagus exhibited differences as well as similarities when compared with previous studies. In this study, the histochemical and ultrastructural structure of the tunica muscularis externa in the esophagus of this fish is investigated. The muscle fibers are described as red and intermediate fibers according to the pH stability of their mATPase activities. The red fibers showed intense staining, while intermediate fibers showed moderate staining with succinic dehydrogenase (SDH) and toluidine blue. In addition, small diameter fibres were seen. Inhibitory Effect Of Bursa Propolis On Dental Caries Formation In Rats Inoculated With Streptococcus Sobrinus, Gamze Bozcuk Erdem, Seval Ölmez

The effect of propolis on the growth of Lactobacillus casei RSKK 591, Streptococcus mutans NCTC 10449 and Streptococcus sobrinus DSN sobrinus 20742 was investigated in vitro. Bursa propolis had the most inhibitory effect on S. sobrinus. The effect of Bursa propolis on rats inoculated with S. sobrinus was also studied. In rats inoculated with the bacteria and given propolis, the severity of sulcal enamel and superficial dentine lesions was significantly less than that in the control group, but colony forming unit numbers and the caries scores in other levels were not different. A Contribution To The Knowledge Of Tenthredinidae (Symphyta, Hymenoptera) Fauna Of Turkey Part Ii: Subfamilies Blennocampinae, Dolerinae, Nematinae And Selandrinae, Önder Çalmaşur, Hi̇kmet Özbek

In the second part of this contribution to the fauna of the typical sawfly, Tenthredinidae in Turkey, the subfamilies Blennocampinae, Dolerinae, Nematinae and Selandrinae are discussed. Twenty-seven species in 13 genera of Blennocampinae, 7 species in 2 genera of Dolerinae, 9 species in 6 genera of Nematinae, and 4 species in 4 genera of Selandrinae, a total of 47 species, are recorded. Of these, 7 species were new to the Turkish fauna. New data on geographical distribution and host plants are given for some species. For each species, a chorotype is reported.

Phorbia securis Tiensuu, 1935 (Diptera, Anthomyiidae) is a new pest found in the cereal areas of the Thrace region in Turkey. In this paper, its morphology, short biology, hosts and distribution in Turkey are presented.

Biological characteristics such as sex, age and length compositions, growth, condition factor, reproduction, mortality and exploitation rates of the silver crucian carp, Carassius gibelio (Bloch 1782), population in Lake Eğirdir were investigated between March 2001 and February 2002. According to the 616 specimens ranged in age groups from I to VI, the percentages of male and female individuals in the population were 53.4% and 46.6%, respectively. The fork lengths of the samples ranged from 9 to 33 cm. Allometric growth was also determined among the lengths and weights of both sexes. Incremental growth rates in length and weight for both …
