From Guerrilla Theater To Media Warfare Abbie Hoffman's Riotous Revolution In America: A Myth, Bruce Eric France, Jr. Jan 2004

From Guerrilla Theater To Media Warfare Abbie Hoffman's Riotous Revolution In America: A Myth, Bruce Eric France, Jr.

LSU Master's Theses

The following thesis is a discussion of the radical activist Abbie Hoffman's theatrical work to revolutionize the United States. What the author does is explain the historical uniqueness of Hoffman's theatrical techniques as tools for social change. What made Abbie Hoffman such a unique character from that already bizarre and devastating time in the United States known as The Sixties was his ability to infuse pot with politics, fun with social activism and cultural change with his contemporary means of communication. He was able to excite and activate a whole generation of people who would otherwise drop out of society …

Same Struggle, Different Difference: Ada Accommodations As Antidiscrimination, Michael Ashley Stein Jan 2004

Same Struggle, Different Difference: Ada Accommodations As Antidiscrimination, Michael Ashley Stein

Faculty Publications

The Americans with Disabilities Act (ADA) was heralded as an "emancipation proclamation" for people with disabilities, one that would achieve their equality primarily through its reasonable accommodation requirements. Nevertheless, both legal commentators and Supreme Court Justices assert that the ADA's employment mandates distinguish the ADA from earlier antidiscrimination measures, most notably Title VII, because providing accommodations results in something more than equality for the disabled. The Article challenges this prevalent belief by arguing that ADA-mandated accommodations are consistent with other antidiscrimination measures in that each remedies exclusion from employment opportunity by questioning the inherency of established workplace norms, and by …

Non-Procrustean Bankruptcy, Richard M. Hynes Jan 2004

Non-Procrustean Bankruptcy, Richard M. Hynes

Faculty Publications

Many advocates of bankruptcy reform bristle at aspects of the bankruptcy system they find distributively "unfair." These scholars point to the instances in which wealthy debtors have been able to retain million-dollar homes and luxury items, examples which at first glance might offend any reasonable sense of decency or fairness. Yet if bankruptcy provides insurance otherwise unavailable because of market failures, then an ideal bankruptcy system would embrace much of this inequality in post-bankruptcy standards of living. The wealthy generally choose private contracts that ensure their high standards of living. Though others envy these benefits, they do not wish to …

Nationalism And Multiculturalism, Chandran Kukathas Jan 2004

Nationalism And Multiculturalism, Chandran Kukathas

Research Collection School of Social Sciences

If any issue dominates contemporary political theory, it is how to deal with cultural diversity and the claims –moral, legal, and political – made in the name of ethnic, religious, linguistic, or national allegiance (Kymlicka,2001: 17). Today, governments are confronted by demands from cultural minorities for recognition, protection, preferential treatment, and political autonomy within the boundaries of the state. Equally, international societyand its political institutions, as well as states themselves, have had to deal with demands from various peoplesfor political recognition as independent nations, and for national self-determination. The turbulent politics ofthe contemporary world may account in part for this development: …

Regulating Genetically Modified Foods: Is Mandatory Labeling The Right Answer?, Jonathan H. Adler Jan 2004

Regulating Genetically Modified Foods: Is Mandatory Labeling The Right Answer?, Jonathan H. Adler

Faculty Publications

What I want to talk about are some legal issues relating to labeling and, in particular, constitutional issues relating to mandatory labeling for genetically modified foods or food products that may contain genetically modified components. This is a separate issue from whether or not the FDA, or some other agency, has sufficient statutory authority at present to mandate labeling, and that is something worth discussing. Even if they do have such authority, or even if Congress tomorrow were to give the FDA such authority or were to require the FDA to impose labels on genetically modified foods, or if a …

Conservation Through Collusion: Antitrust As An Obstacle To Marine Resource Conservation, Jonathan H. Adler

Although it is not a new environmental problem, overfishing is arguably one of the most serious environmental problems today. Despite decades of government regulation, fisheries are in trouble the world over.

With little doubt, the federal fishery regulations adopted in the last twenty-five years have failed to ensure sustainable utilization of U.S. fisheries. The existing regulatory framework is "a failed experiment that has led to the destruction of United States coastal fisheries." At the same time that the federal government adopted an elaborate regulatory structure, federal law has impeded the development of cooperative fishery management institutions that may have helped …

An Implicit Surface Modeling Technique Based On A Modular Neural Network Architecture, Manuel Carcenac Jan 2004

An Implicit Surface Modeling Technique Based On A Modular Neural Network Architecture, Manuel Carcenac

Turkish Journal of Electrical Engineering and Computer Sciences

Independently from artificial intelligence applications, an artificial neural network can be viewed as a powerful tool for function reconstruction. Previous papers used this property to model an implicit surface out of some control points by reconstructing its underlying scalar field. Such an approach requests the neural network to memorize the control points, which has turned problematic for complex surfaces. In our paper, we show that this problem can be efficiently tackled by adapting the architecture of the neural network to the features compounding the surface: by learning first these features independently and then blending them gradually together, our modular architecture …

Real-Time Classification Algorithm For Recognition Of Machine Operating Modes By Use Of Self-Organizing Maps, Gancho Vachkov, Yuhiko Kiyota, Koji Komatsu, Satoshi Fujii Jan 2004

Real-Time Classification Algorithm For Recognition Of Machine Operating Modes By Use Of Self-Organizing Maps, Gancho Vachkov, Yuhiko Kiyota, Koji Komatsu, Satoshi Fujii

Turkish Journal of Electrical Engineering and Computer Sciences

In this paper a new algorithm for classification and real-time recognition of different a-priorily assumed operating modes for construction machines is proposed. This algorithm utilizes the effectiveness of the Self-Organizing Maps (SOM) for creating the so called Separation Models, that are able to distinguish each operating mode separately. After training, these models are used in a real-time procedure, which calculates at each sampling time the minimal Euclidean distances from the current data point to a certain node of each SOM. Then the separation model (represented by a respective SOM) that has the least minimal distance to this data point defines …

Structural Effects Of Carbon Monoxide Coordination To Carbon Centers. Π And Σ Bindings In Aliphatic Acyl Versus Aromatic Aroyl Cations, M. G. Davlieva, Sergey V. Lindeman, Ivan S. Neretin, Jay K. Kochi Jan 2004

Structural Effects Of Carbon Monoxide Coordination To Carbon Centers. Π And Σ Bindings In Aliphatic Acyl Versus Aromatic Aroyl Cations, M. G. Davlieva, Sergey V. Lindeman, Ivan S. Neretin, Jay K. Kochi

Chemistry Faculty Research and Publications

The binding of carbon monoxide to carbon centers has been examined with two series of aromatic and aliphatic oxocarbonium ions that are successfully isolated as crystalline and highly reactive (hygroscopic) aroylium and acylium salts with poorly coordinating counteranions. X-Ray crystallographic analyses at −150 °C afford precise structural parameters for the characteristic linear carbonyl bond (rCO) and the bond to the carbon centers (rCα). The correlations of these structural parameters evaluated for alkyl (Me, Et and i-Pr) and aryl (p-Me, 2,4,6-trimethyl, p-MeO and p-fluorophenyl) oxocarbonium ions with the corresponding carbonyl …

Marry Me, Bill: Should Cohabitation Be The (Legal) Default Option?, Margaret F. Brinig, Steven L. Nock Jan 2004

Marry Me, Bill: Should Cohabitation Be The (Legal) Default Option?, Margaret F. Brinig, Steven L. Nock

Journal Articles

Are cohabitation and marriage similar enough to warrant similar legal treatment? Earlier public reports on cohabitation have focused on the question of whether cohabitation before marriage increases or decreases the divorce rate.

But increasingly cohabitation is being proposed not as a testing ground for marriage, but as a functional substitute for it. The trend in family law and scholarship in Europe and Canada is to treat married and cohabiting couples similarly, or even identically.

In this country, the American Law Institute [ALl] recently proposed that, at least when it comes to the law of dissolution, couples who have been living …

Overcoming Impediments To Information Sharing, Avishalom Tor, Amitai Aviram Jan 2004

Overcoming Impediments To Information Sharing, Avishalom Tor, Amitai Aviram

Journal Articles

When deciding whether to share information, firms consider their private welfare. Discrepancies between social and private welfare may lead firms excessively to share information to anti-competitive ends - in facilitating of cartels and other harmful horizontal practices - a problem both antitrust scholarship and case law have paid much attention to. On the other hand, legal scholars have paid far less attention to the opposite type of inefficiency in information sharing among competitors - namely, the problem of sub-optimal information sharing. This phenomenon can generate significant social costs and is of special importance in network industries because the maintenance of …

Alternative Sanctions And The Federal Tax Law: Symbols, Shaming, And Social Norm Management As A Substitute For Effective Tax Policy, Michael S. Kirsch Jan 2004

Alternative Sanctions And The Federal Tax Law: Symbols, Shaming, And Social Norm Management As A Substitute For Effective Tax Policy, Michael S. Kirsch

Journal Articles

On several occasions in the past decade, when confronted with taxpayers taking advantage of the Internal Revenue Code in ways that Congress considered objectionable, Congress responded in an unusual way. Rather than merely modifying the Internal Revenue Code to alter the tax consequences of the taxpayer's actions, or imposing traditional civil or criminal penalties on the taxpayer, Congress turned to alternative sanctions. For example, in response to United States citizens who renounce citizenship to avoid taxes, Congress enacted public shaming provisions that require publication of the individuals' names in the Federal Register and modified the federal immigration laws to banish …

Helping Enact Unjust Laws Without Complicity In Injustice, John M. Finnis Jan 2004

Helping Enact Unjust Laws Without Complicity In Injustice, John M. Finnis

Journal Articles

The form of enactments must be distinguished from their legal meaning (their "juridical effect"), that is, from the propositions of law which those enactments, properly interpreted, make legally valid. This distinction makes it possible, and rationally necessary, to conclude that, in certain contexts, a certain statute which declares or textually implies that some abortions are legally permitted (but others prohibited) is not apermissive law within the meaning of the principle, assumed in this article to be true, that permissive abortion laws are intrinsically unjust and may never be voted for. A permissive statute, in that sense, is one which has …

Establishing Partnerships, Dare Mighty Things

Partnerships/Community

While there are many nationally recognized benefits and advantages to partnership development, the answer to why one seeks to establish partnerships is relatively simple. There is added value in working with other organizations including the sharing of staff and financial resources. Partnership development is nor a new concept. Communities, organizations and individuals have been working together in partnerships to improve the quality of life at the grassroots level for a number of years. There are a number of multi-agency "stakeholder" partnerships both locally and nationally that manage and deliver a wide range of community development programs, as well as service …
