Scale Model Of A Soil Aggregate And Associated Organisms: A Teaching Tool For Soil Ecology, Mary Anne Bruns, Loren B. Byrne

Arts & Sciences Faculty Publications

Soil is a complex habitat for diverse biota. A significant challenge in teaching soil ecology is our inability to observe organisms as they live and interact in the soil. The objective of this article is to describe an interactive class project to help students visualize the sizes of different groups of soil organisms and to relate these to soil structural components. This project was carried out by students in an upper-level undergraduate soil ecology class. It involved the design and construction of a 4000× scale model of a soil aggregate and its associated organisms. The body of the model was …

Testing For Resistance Of Pelagic Marine Copepods To A Toxic Dinoflagellate, Sean Colin, Hans G. Dam Jan 2004

Testing For Resistance Of Pelagic Marine Copepods To A Toxic Dinoflagellate, Sean Colin, Hans G. Dam

Arts & Sciences Faculty Publications

With few exceptions, the evolutionary consequences of harmful algae to grazers in aquatic systems remain unexplored. To examine both the ecological and evolutionary consequences of harmful algae on marine zooplankton, we used a two-fold approach. In the first approach, we examined the life history responses of two geographically separate Acartia hudsonica (Copepoda Calanoida) populations reared on diets containing the toxic dinoflagellate Alexandrium fundyense . One copepod population was from a region, Casco Bay, Maine, USA, that has experienced recurrent blooms of highly toxic Alexandrium spp. for decades; whereas the other population from Great Bay, New Jersey, USA, has never been …

A Continuing Whimsical Search For The True Meaning Of The Term “Product” In Products Liability Litigation, Charles E. Cantú Jan 2004

A Continuing Whimsical Search For The True Meaning Of The Term “Product” In Products Liability Litigation, Charles E. Cantú

Faculty Articles

More than a decade has elapsed since an initial attempt was made to discern the true meaning of the term product in products liability litigation. At the time, a brief history of events leading up to the adoption of Section 402A of the Restatement (Second) of Torts was outlined, and it was emphasized that what had at first seemed so simple subsequently proved to be somewhat complex.

An examination of cases involving the sales/service transaction, as well as those involving real estate, blood, electricity, component parts, water, computer software, and ideas, sometimes held that what was involved was a product. …

Insurance Decisions - A Survey And Empirical Analysis, Willy E. Rice Jan 2004

Insurance Decisions - A Survey And Empirical Analysis, Willy E. Rice

Faculty Articles

During the period from June 2002 to July 2003, the Court of Appeals for the Fifth Circuit decided twenty-two appeals originating in eight federal district courts. Certainly, the greater majority of the insurance appeals involved recurring substantive and procedural conflicts. Major disagreements about the interpretation and enforcement of insurance contracts were before the court. Also, federal preemption questions and conflicts over subject-matter jurisdiction appeared in several cases. Furthermore, the Fifth Circuit addressed one case of first impression, and on remand from the Supreme Court, the appellate court modified and reinstated portions of a vacated opinion. For the most part, the …

Maternity Rights In Mexico: With References To The Spanish And American Codes, Roberto Rosas Jan 2004

Maternity Rights In Mexico: With References To The Spanish And American Codes, Roberto Rosas

Faculty Articles

Mexico, the United States, and Spain approach maternity rights and benefits from differing perspectives within diverse legal frameworks. Maternity and pregnancy deserve legal protection in the workplace by virtue of their vital role to society. Women worldwide share a concern for maternity rights and benefits, but countries approach legal rights related to motherhood and pregnancy from differing perspectives.

The laws in Mexico and Spain regarding maternity share many similarities, including protecting not only the mother and fetus, but also the infant and father. In contrast, the laws in the United States solely protect the mother and unborn fetus. The laws …

Report To Law Revision Commission Regarding Recommendations For Changes To California Arbitration Law, Roger P. Alford

Journal Articles

In this Article, Professor Alford discusses a report by the Law Revision Commission recommending that certain changes be made to arbitration law in California. It begins by outlining the history of arbitration in California, from its 1961 adoption of the Uniform Arbitration Act, to the 1988 enactment of an international arbitration statute modeled on the UNCITRAL Model Law, to the 1989 enactment of Section 1281.8, which allowed courts to grants provisions remedies to parties involved in arbitration proceedings. It also provides a general overview of the purpose and practice of arbitration law. Then, it provides a chapter-by-chapter analysis the Law …

Gas Phase Studies Of Molecular Clusters Containing Metal Cations, And The Ion Mobility Of Styrene Oligomers, Edreese Housni Alsharaeh Jan 2004

Gas Phase Studies Of Molecular Clusters Containing Metal Cations, And The Ion Mobility Of Styrene Oligomers, Edreese Housni Alsharaeh

Theses and Dissertations

This study is divided into three parts. Part I deals with the mechanism of the self-initiated polymerization (or thermal polymerization) of styrene in the gas phase. In this work, we present the first direct evidence for the thermally self-initiated polymerization of styrene in the gas phase. Our approach is based on on-line analysis of the gas phase Oligomers by mass-selected ion mobility. The mobility measurements provide structural information on the ionized oligomers based on their collision cross-sections (Ω) which depend on the geometric shapes of the ions. Theoretical calculations of possible structural candidates of the Oligomers ions are then used …

Copyright And Information Theory: Toward An Alternative Model Of Authorship, Alan L. Durham Jan 2004

Copyright And Information Theory: Toward An Alternative Model Of Authorship, Alan L. Durham

Articles

Both literary scholars and students of copyright law have challenged the romantic model of authorship a model emphasizing individual genius and creation ex nihilo Authorship they argue is actually a collaborative effort Authors assemble their works from the fragments of their cultural environment transforming as much as creating Copyright law however still champions the rights of authors and it requires a coherent theory of what authorship is An alternative to the romantic model of authorship can be found in information theory a branch of mathematics dealing at a very fundamental level with all forms of communication Authorship could be defined …

A Constitution For Judicial Lawmaking, Adam N. Steinman Jan 2004

A Constitution For Judicial Lawmaking, Adam N. Steinman

Articles

When courts decide cases, their decisions make law because they become precedent that binds future courts under the doctrine of stare decisis. This article argues that judicial lawmaking, like legislative lawmaking, is subject to constitutional principles that govern the extent to which a particular attempt at judicial lawmaking is valid. Because even poorly reasoned judicial decisions can still be effective lawmaking acts, it is important to distinguish between constitutional and non-constitutional principles and arguments. While a non-constitutional principle can be a basis for examining the wisdom or merits of a particular lawmaking act, only constitutional principles can assess whether the …

Profile: Student-Faculty Collaborative: Umm At Its Best, University Relations

Profile (1996-)

A college is a community of learners, and the best instruction takes place in intimate, rigorous, active conversation--a student, a teacher, a log. I hope you'll enjoy these portraits of collaborative education: there are some wonderful exemplary illustrations here. But I also encourage you to mull the fact that for each such picture in Profile there is literally hundreds of equally inspiring but publicized collaborative ventures. All these profiles in learning are UMM at its best!

Restructuring The Multilateral Export Control Regime System, Daniel H. Joyner Jan 2004

Restructuring The Multilateral Export Control Regime System, Daniel H. Joyner

Articles

This article identifies a current disharmony arising from increased expectations for the effectiveness and scope of the multilateral non-proliferation export control regime system, coupled with the reality of regime structures the inherent institutional limitations of which form significant barriers to meeting these expectations. The article will propose that, through employing international legal and organisational theory, this disharmony can be substantially mediated, and that the expectations of the multilateral non-proliferation community can be essentially met through efforts of reform and restructuring of the multilateral export control regimes. These efforts, while endowing the regimes with the increased formality necessary for higher levels …

Evaluation And Repair Of Wrought Iron And Steel Structures In Indiana, Mark D. Bowman, Amy M. Piskorowski Jan 2004

Evaluation And Repair Of Wrought Iron And Steel Structures In Indiana, Mark D. Bowman, Amy M. Piskorowski

JTRP Technical Reports

Throughout the state of Indiana, there a number of older, historical bridges which have been in service since the late 19th century. Many, although not all, of these bridges are truss structures comprised either partially or completely of wrought iron members. Moreover, most of them need some degree pf maintenance or rehabilitation. However, engineers who must recommend repair or rehab operations typically do not know the material properties and behavior of wrought iron members. Consequently, an investigation was initiated to review and classify typical material properties of wrought iron members. This investigation involved three phases that included a literature review …

A Rhetoric Of Technology: The Discourse In U.S. Army Manuals And Handbooks, Sherry Ann Steward Jan 2004

A Rhetoric Of Technology: The Discourse In U.S. Army Manuals And Handbooks, Sherry Ann Steward

Electronic Theses and Dissertations

This dissertation examines the historical technical publications of the United States Army from 1775-2004. Historical research in Army technical communication reveals the persuasive characteristics of its technical publications. Elements of narrative, storytelling, and anthropomorphism are techniques writers used to help deliver information to readers. Research also reveals the design techniques writers adopted to unite the situated literacies of the troops. Analyses of print, comic, and digital media expose the increasing visualization of information since the eighteenth century. The results of such historical research can be applied to new media designs. Automating processes captured in paper-based technical manuals and adding intelligent …
