Interactions Among Western Ragweed And Other Sandhills Species After Drought, Patrick E. Reece, Joe E. Brummer, Brian K. Northup, Ann E. Koehler, Lowell E. Moser

Interannual differences in yield and species composition of herbaceous vegetation on semiarid rangelands are common and often related to variations in precipitation regime. Interspecific interactions that occur after drought-induced population fluxes of western ragweed (Ambrosia psilostachya D.C.) were evaluated by removing western ragweed or associated species from 1-m2 quadrats at weekly intervals beginning in early May, June, or July 1991 or 1992 on high-seral sandhills prairie in Nebraska. The composite of peak standing crops for ragweed and each group of associated species was 77% greater during May–October 1991 (2 252 kg•ha-1) compared with 1992 (1 275 …

In this invited response to Stephen Choi & Mitu Gulati, "Choosing the Next Supreme Court Justice: An Empirical Ranking of Judge Performance," 78 S. CAL. L. REV. 23, 30 (2004), I analyze the central normative assumptions underlying Choi and Gulati’s "Tournament of Judges." To that end, I explore the concept of "merit" as it applies to the selection of individuals for important institutional positions. I suggest that an ascription of merit can be understood to entail a claim that an individual exemplifies the aptitudes, excellences, and virtues of a particular office or position. I argue that merit in this sense …

Risk Realization, Emotion, And Policy Making, Chris Guthrie

Missouri Law Review

People are likely to overestimate the impact of negative life events on our enduring sense of well-being. If true, this empirical finding puts policy makers in an awkward position because they are generally called upon to make policy in anticipation of , rather than in response to, such events. Nonetheless, I will argue that policy makers should take into account our tendency to overestimate the emotional impact of such events.

Northern Illinois University Law Review

This article examines the three major Supreme Court cases, Brown, Pico, and American Library Association, which span a period of almost 30 years and address the appropriate role of libraries and the activities allowed within library premises. The scope of the cases includes the legality of silent protests in libraries, the removal of print materials from libraries, and implementing filters for Internet content. These cases exemplify the important struggle over the larger role of libraries in society. Nothing Concentrates The Mind Like The Prospect Of A Hanging: The Criminalization Of The Sarbanes-Oxley Act, Ann Marie Tracey, Paul Fiorelli

This article discusses: (1) the post-Enron environment and the events that led up to the whirlwind passage of the Sarbanes-Oxley Act of 2002, (2) the legislative history for criminalizing a bill that originated in the House Financial Services Committee, and (3) a comparison between the increased criminal provisions and penalties under the Act with already existing legislation. It also analyzes how Congress closed loop-holes, flexed its muscles with respect to corporate practices, and the necessity of the new criminal laws.

Post-penetration rape describes the scenario when, at some point after consensual intercourse begins, one of the participants asks that the intercourse cease and the other does not desist. This situation is one of the more recently recognized forms of acquaintance rape. This recognition comes with various nuances and complexities that have caused a split amongst courts regarding how to deal with it when it arises in criminal prosecutions. Defamation Law And Free Speech: Reynolds V. Times Newspapers And The English Media, Andrew T. Kenyon, David F. Partlett, Clive P. Walker, Russell L. Weaver

Vanderbilt Journal of Transnational Law

The common law of defamation cut the balance between speech and reputation decisively in favor of reputation and allowed for the imposition of significant damages against media outlets that defamed. For the last four decades, U.S. media outlets have been insulated against the common law rules by the United States Supreme Court's landmark decision in New York Times Co. v. Sullivan. Following Sullivan, Commonwealth countries clung steadfastly to common law rules and are only now beginning to modify the common law rules to provide speech and media protections. In recent years, volunteers and practitioners alike have been drawn to creating and participating in various types of alliances and coalitions as a way to address and solve complex community problems. Community coalitions, in particular, have brought together diverse volunteers and agencies committed to specific community change. Staff Nurse Perceptions Of The Contributions Of Students To Clinical Agencies, Geraldine Matsumura, Lynn Clark Callister, Sheri P. Palmer, Amy Harmer Cox, Larissa Larsen

This study is a replication and extension of Grindel and associates' 2001 study of the perceptions of staff nurses (psychiatric, perinatal, and medical/surgical) regarding the benefits of having students from a baccalaureate nursing program work in clinical agencies. Using the Nursing Students' Contributions to Clinical Agencies tool, the overall perception of students' contributions ranged from -4 to +5, with a mean of 2.50. The two highest ranked items were "allows opportunities for mentoring" and "threatens professional role development," indicating the ambivalence staff nurses feel toward nursing students. Qualitative data also demonstrated the benefits and challenges of working with students. Recommendations …

Objective: To study the epidemiology of ocular Rhabdomyosarcoma (ORMS) in Karachi.

Methods: Incident ORMS cases resident of Karachi, registered at Karachi Cancer Registry (KCR) during 1st January 1998 to 31st December 2002 were included in the study. The data were classified using ICD-O2; computerized with Canreg-3, and analyzed using SPSS 10.0.

Results: Ten cases of ORMS were reported to KCR during 1998-2002. RMS originated in the orbit in eight cases, conjunctiva in one and eyelid in one. Nine cases presented with proptosis, associated with conjunctivitis in four cases. One case presented with eyelid swelling. The crude annual incidence rate was …
