The note explores the intersection of public perception, legal ethics, and professional identity in the twentieth century, focusing on how Arthur Train's fictional character, Ephraim Tutt, influenced both the public's idealized view of lawyers and the legal profession's response to declining prestige. The subject of mediating associations and voluntary associations have received much attention in recent years. Both conservative and liberal scholars have invoked the idea that certain institutions that fall somewhere on the spectrum between the State and the Individual play a significant role in society and that they therefore ought to be protected and even cultivated. But much of this work proceeds from a flawed premise, and leads to an instrumental view of these non-State associations that requires that these institutions be justified based on their social utility. Analytically Calibrated Box-Cox Percentile Limits For Duration And Event-Time Models, Zhenlin Yang, Albert K.C. Tsui

This paper proposes a unified approach to constructing confidence limits for a future percentile duration or event-time. The construction is based on an analytical calibration of the Box-Cox-type “plug-in” percentile limits (PL). The performance of the calibrated Box-Cox PL is investigated using Monte Carlo experiments. Comparisons are made with PLs that are specifically designed for a particular distribution such as Weibull and lognormal. Excellent performances of the calibrated Box-Cox PL are observed. Simulation based on other popular duration models such as gamma and inverse Gaussian reveal that the proposed PL is robust against distributional assumptions and that it performs much …

LS Penrose’s limit theorem (PLT) – which is implicit in Penrose [5, p. 72] and for which he gave no rigorous proof – says that, in simple weighted voting games, if the number of voters increases indefinitely while existing voters retain their weights and the relative quota is pegged, then – under certain conditions – the ratio between the voting powers of any two voters converges to the ratio between their weights. This paper analyzes the question: what does it take for science parks and technology districts to evolve and grow? We propose an analytical framework to examine the gestation, evolution and sustainability of science parks and regional phenomena at a broader scale such as technology districts. The framework comprises three aspects of a science park's development: growth mechanisms, level of technological capabilities, and integration with national or global markets. The main growth mechanisms we identify are government-led infrastructure provision, agglomeration effects and continual self-renewal through the creation of new businesses. This study investigated how K--12 teachers and interns in West Virginia University's Professional Development Schools (PDS) are using technology as a tool to enhance their students' education. The study addressed the use of technology as a classroom tool for research, communication, productivity, and problem-solving as outlined by the National Technology Standards for students. Eleven research questions framed this study. Comparisons across grade levels (elementary, middle, and high schools) and subject areas (English, mathematics, science, and social studies) were included. Despite the rising popularity of the practice of competency modeling, research on competency modeling has lagged behind. This study begins to close this practice-science gap through 3 studies (1 lab study and 2 field studies), which employ generalizability analysis to shed light on (a) the quality of inferences made in competency modeling and (b) the effects of incorporating elements of traditional job analysis into competency modeling to raise the quality of competency inferences. Study 1 showed that competency modeling resulted in poor interrater reliability and poor between-job discriminant validity amongst inexperienced raters. Real estate investments are typically characterized by high degrees of leverage and long-loan tenures. In perfect capital markets, leverage has no impact on the investment decision apart from tax considerations. However, the mortgage financing market is imperfect in many countries. In the presence of market imperfections, an optimal holding period exists for real property investments. We provide a simple rule to calculate the optimal holding period to compare the required rate of return with the leveraged rate of return on equity.

On Measuring Influence In Non-Binary Voting Games, Vincent Chua, C. H. Ueng

In this note, we demonstrate using two simple examples that generalization of the Banzhaf measure of voter influence to non-binary voting games that requires as starting position a voter’s membership in a winning coalition is likely to incompletely reflect the influence a voter has on the outcome of a game. Generalization of the Banzhaf measure that takes into consideration all possible pivot moves of a voter including those moves originating from a losing coalition will, on the other hand, result in a measure that is proportional to the Penrose measure only in the ternary case.

It is well documented that intensive behavioral treatment of early childhood autism can result in significant improvements in adaptive behavior. The typical teaching format in such programs is based on the restricted operant (i.e., discrete trial) in which the performance of an exemplar skill follows a clear instruction and precedes programmed reinforcement or error correction. Because of the often-intensive nature of behavioral treatment, it is not unusual for thousands of learning opportunities to be presented each week. In medieval England spectators applauded as knights fought each other in jousting tournaments. Shakespearean audiences were awed with bloody and violent conclusions of plays such as Macbeth, King Lear and Hamlet. Violence in entertainment today exists in a more accessible form, with over 60 per cent of television programs containing some form (Bushman & Anderson, 2001). The objective of the dissertation was to map the glacial geology in southern St. Joseph County, Michigan. The surficial geology was divided into three distinct land systems which are moraine, outwash and fan deposits. The Sturgis Moraine is the most prominent feature transecting the study area from east to west. The topography is further dissected by southwest-trending channels interpreted as tunnel channels.

Thick accumulations of sand and gravel in the study area indicate that glacial meltwater deposition played a dominant role in shaping the landscape. Based on the relative size of the channels and outwash deposits, the largest contribution from …

Cultural and familial ties are crucial for the overall well-being of children. Extant research and permanency planning practices support the reunification of children with their families when possible. In 1978, the Indian Child Welfare Act (ICWA) was enacted to promote cultural and familial preservation for Indian children, but sparse empirical research has examined the implementation and outcomes associated with this landmark legislation. This article examines the relationship between compliance with ICWA in one Southwestern state and the rate of reunification of Indian children with family or tribal members following out-of-home placement.

Southern Michigan's geomorphology is a testament to the glacial processes that buried and sculpted the landscape during the last glaciation. Many glacial landforms in southwestern Michigan, including the Kalamazoo River Valley, provide evidence that aids in understanding the chronology, ice dynamics and glacial processes that occurred in Michigan during the last ice age.

Factors Influencing Basal Area Growth Of Yellow-Poplar ( Liriodendron Tulipifera L.) In Central West Virginia, Christopher T. Crum

This paper uses data from continuous forest inventory (CFI) plots to evaluate basal area growth of yellow-poplar (Liriodendron tulipifera L.) as related to four topographic factors (aspect, slope position, steepness, and landform), two competition variables (basal area per acre and trees per acre) and four tree characteristics (age, diameter, total height, and crown diameter). These variables were plotted against basal area growth per year using simple linear regression on 69 yellow-poplar trees. The four tree characteristics all had a highly significant (p < .01) relationship with basal area growth. While the other variables did not exhibit a significant relationship, the two competition variables did have a significant (p < .05) relationship with each other.

Analysis of fault characteristics and control of microelectromechanical systems (MEMS) is becoming increasingly important as these devices are incorporated into safety critical systems. Mechanically decoupled monitoring techniques are needed to ensure that accurate, low-noise positional information is gathered from these devices during operation. Optical monitoring has been shown by various groups to be capable of achieving this goal. Anaerobic digestion is one of the several technologies used for biomass conversion to electricity or heat. This thesis focused on microwave irradiation of corn stover as a pretreatment for anaerobic digestion, and studies its impact on methane production.

The first run comprised three sets of stover soaked overnight in water, dilute sulfuric acid and dilute acetic acid, and each treated to three different levels of microwave irradiation. The results indicated a high variability in the data of the water set, which showed that there was no clear impact of microwave pretreatment on methane production.
