An Analysis Of The Factors That Determine When And How To Resolve A Trademark Dispute, Thomas J. Speiss, Stephen M. Levine Jan 2004

An Analysis Of The Factors That Determine When And How To Resolve A Trademark Dispute, Thomas J. Speiss, Stephen M. Levine

Richmond Journal of Law & Technology

Business and war have one thing in common: strategy. “Never to be undertaken thoughtlessly or recklessly, [strategy is] to be preceded by measures designed to make it easy to” obtain the desired outcome. “A skilled general must be master of the complementary arts of simulation and dissimulation; while creating shapes to confuse and delude the [negotiating adversary] he conceals his true dispositions and ultimate intent.” His actions “are designed to entice the [adversary], to unbalance him, and to create a situation favourable for a decisive counter-stroke.”

Grutter V. Bollinger: This Generation's Brown V. Board Of Education, Michelle Adams Jan 2004

Grutter V. Bollinger: This Generation's Brown V. Board Of Education, Michelle Adams

Articles

At first blush, Grutter appears to be a deviation from the body of the Court's recent affirmative action jurisprudence: it says "yes" where the other cases said "no." But it is not so clear that Grutter is a deviation from current law. Instead, it might be seen as consistent with it, in that the justification for the racial preference recognized in Grutter transcended the justifications offered in the previous cases, and the method used to achieve that end, "race as a factor," diffused rather than highlighted race. From this perspective, Grutter addressed several concerns that had troubled the Court for …

Sec Enforcement Of Attorney Up-The-Ladder Reporting Rules: An Analysis Of Institutional Contraints, Norms, And Biases, Michael A. Perino

Faculty Publications

In their paper and in their earlier comments to the SEC on the proposed attorney reporting rules, Professors Cramton, Cohen and Koniak do an excellent job recounting the genesis of the attorney reporting requirements in the Sarbanes-Oxley Act, describing the SEC's proposed and final rules and critiquing the rule's triggering mechanism and now apparently shelved noisy withdrawal requirement. Their case study of the recent Spiegel, Inc. independent examiner's report is a particularly useful vehicle for examining the practical implications of the SEC's policy and drafting choices. Although I was a member of a committee that submitted comments opposed to noisy …

Grandparents’ Rights: What Every Grandparent Needs To Know, Robin Boyle

Faculty Publications

(Excerpt)

Patricia Perkins Slorah, has written an easy-to-read book for grandparents who are considering assistance from the legal community to secure visitation with their grandchildren. The book is aptly titled, Grandparents’ Rights: What Every Grandparent Needs to Know. For grandparents who are unfamiliar with the court system, Ms. Slorah provides helpful guidance. Although any book about the current state of the laws would be outdated at some point in the future as to what certain laws provide, this book provides timeless personal stories of grandparents who have struggled to gain visitation rights with their grandchildren.

Emancipatory Pedagogies is the capstone experience for our Alternative Education Programs Licensure program. Employing non-traditional pedagogies, we taught Emancipatory Pedagogies for the first time in the summer of 2002. The reading list included several chapters from The Paulo Freire Reader (Freire and Macedo, 2001) and We Make the Road by Walking, the text spoken by Freire and Myles Horton. Recognizing the potential for powerful and empowering classroom dialog in the Freire-Horton model, our culminating activity was the "talking" of an article. That extended conversation is presented here. The reader will find that our dialog presents issues that Freire raised in …

Burakugaku (Buraku Study): A Paradigm Shift For Education, Yoshikazu Kawamoto, Hidetada Shimizu Jan 2004

Burakugaku (Buraku Study): A Paradigm Shift For Education, Yoshikazu Kawamoto, Hidetada Shimizu

Mid-Western Educational Researcher

Burakumin, Japan’s largest minority group, have been discriminated against throughout Japanese history for engaging in jobs that were considered to be defiling, e.g., slaughterers, tanners, and undertakers. Specifically, burakumin played the social and occupational roles despised by the majority Japanese, but those without which the Japanese society as a whole could not maintain its viable function, i.e., actual and symbolic processes of recycling whereby those which are dead and polluted were transformed into living and holy. In recent years, however, some burakumin scholars have begun to recast their identities; instead of examining the problem of being burakumin (the deficit model), …

Social Issues And Education: Commentary On The Use Of Freirian, Hortonian And Boalian Pedagogies In A Graduate College Classroom, Michael Sanders Jan 2004

Social Issues And Education: Commentary On The Use Of Freirian, Hortonian And Boalian Pedagogies In A Graduate College Classroom, Michael Sanders

Mid-Western Educational Researcher

My purpose for writing this commentary is to reflect on how one teacher attempted to utilize the philosophies and practices of Paolo Freire, Augusto Boal, and Myles Horton in a graduate level, educational foundations classroom. I take as my premise the view that pedagogical practice is political and that the processes of studying and changing practice are also political (Kemmis and McTaggart, 2000). The commentary is a testimony about how I attempted to construct ways in which classroom relations would encourage participants to engage with each other and the instructor in confrontational interaction to expose and examine held values and …

Visualization Techniques For The Analysis Of Neurophysiological Data, Martin Alan Walter Jan 2004

Visualization Techniques For The Analysis Of Neurophysiological Data, Martin Alan Walter

School of Engineering, Computing and Mathematics Theses

In order to understand the diverse and complex functions of the Human brain, the temporal relationships of vast quantities of multi-dimensional spike train data must be analysed. A number of statistical methods already exist to analyse these relationships. However, as a result of expansions in recording capability hundreds of spike trains must now be analysed simultaneously. In addition to the requirements for new statistical analysis methods, the need for more efficient data representation is paramount. The computer science field of Information Visualization is specifically aimed at producing effective representations of large and complex datasets. This thesis is based on the …

Department of Pathology and Laboratory Medicine

Objective: To study the prevalence of hepatitis C virus in lymphoproliferative disorders.
Methods: A case control prospective study was performed on 143 patients with lymphoproliferative disorders and 29 patients with non-hematological malignancies were taken as controls. All the patients in both groups were analyzed for various risk factors for infection with hepatitis C virus and were tested for the presence of hepatitis C virus antibody (anti HCV), cryoglobulins and rheumatoid factor antibody. Hepatitis C viremia was documented by detection of HCV RNA by polymerase chain reaction.
Results: There was no significant difference for risk factors for hepatitis …

Pee-To-Park: Should Public High School Students Applying For On-Campus Parking Priviledges Be Required To Pass A Drug Test, Jared M. Hartman

Journal of Law and Health

This note will address the concerns raised by suspicionless drug-testing programs in public high schools by ultimately arguing that public policy considerations should be factored into the Supreme Court's balancing test, and that such considerations will weigh and balance against expanding drug-testing programs to contexts beyond those already upheld by the Supreme Court. At the least, this note will argue that the Groveport Madison drug-testing program, imposed on students applying for on-campus parking privileges, should not be upheld. However, before this argument can be properly asserted, a number of pertinent topics must be discussed. Section II of this note will …

United States V. Sell: Involuntary Administration Of Antipsychotic Medication - Are You Dangerous Or Not, Gregg Single Jan 2004

United States V. Sell: Involuntary Administration Of Antipsychotic Medication - Are You Dangerous Or Not, Gregg Single

Journal of Law and Health

Antipsychotic drugs "alter the chemical balance in a patient's brain and can cause irreversible and fatal side effects." Furthermore, they "act at all levels of the central nervous system as well as on multiple organ systems. [They] can induce catatonic-like states, alter electroencephalographic tracings, and cause swelling of the brain. Adverse reactions include drowsiness, excitement, restlessness, bizarre dreams, hypertension, nausea, vomiting, loss of appetite, salivation, dry mouth, perspiration, headache, constipation, blurred vision, impotency, eczema, jaundice, tremors, and muscle spasms". As well as these symptoms, they can also cause "tardive dyskinsesia, an often irreversible syndrome of uncontrollable movements that can prevent …

The Mentally Ill Offender: A Brighter Tomorrow Through The Eyes Of The Mentally Ill Offender Treatment And Crime Reduction Act Of 2004, Ralph M. Rivera Jan 2004

The Mentally Ill Offender: A Brighter Tomorrow Through The Eyes Of The Mentally Ill Offender Treatment And Crime Reduction Act Of 2004, Ralph M. Rivera

Journal of Law and Health

Beginning in the early 1950s and '60s, states began to close their public mental health hospitals. This process was known as "deinstitutionalization." In recent years, following the massive wave of deinstitutionalization, a substantial number of institutionalized persons with mental disabilities were relocated from civil mental hospitals into jails and prisons, Despite this shift in population, correctional facilities remain ill-equipped to handle and deal with offenders with mental disabilities. One study found that approximately 6.5-10% of inmates suffered from a serious mental illness, while another 15-40% suffered from a moderate mental illness. Another study done by the Bureau of Justice Statistics …

The Sexual Assault Crisis In The United States Air Force Academy, Colleen Dalton Jan 2004

The Sexual Assault Crisis In The United States Air Force Academy, Colleen Dalton

Cardozo Journal of Equal Rights & Social Justice

The note examines the systemic crisis of sexual assault at the United States Air Force Academy, highlighting how military culture, legal frameworks, and institutional failures perpetuate this issue. It argues that comprehensive legal and cultural reforms are necessary to address the pervasive gender discrimination and retaliation against victims. The analysis emphasizes the need for Congress to modernize the Uniform Code of Military Justice and for the military to adopt a model that promotes gender equality and accountability.

Rites Of Passing: Foucault, Power, And Same-Sex Commitment Ceremonies, Ladelle Mcwhorter Jan 2004

Rites Of Passing: Foucault, Power, And Same-Sex Commitment Ceremonies, Ladelle Mcwhorter

Philosophy Faculty Publications

According to Catherine Bell, "The popular contention that ritual and religion decline in proportion to modernization has been something of a sociological truism since the mid-19th century". Conventional wisdom maintains that ritual practices just don't hold central importance in the lives of those raised in the industrialized world as compared with the importance such things had for our distant ancestors or for our contemporaries in non-industrial societies. Some have contended that this is because ritual tends to be strongly correlated with pre-scientific cosmological beliefs that our society has for the most part outgrown. But for whatever reason, " [c]omparatively speaking," …

Does Baldrige Make A Business Case For Quality?, Mark L. Dean, Cynthia L. Tomovic Jan 2004

Does Baldrige Make A Business Case For Quality?, Mark L. Dean, Cynthia L. Tomovic

STEMPS Faculty Publications

The Malcolm Baldrige National Quality Award (MBNQA) is a widely accepted model promoting quality management as a means to business success. However, because business results are themselves part of the model, the contribution of the approach-deployment elements to results cannot be determined. The National Institute of Standards and Technology (NIST) maintains a history of Baldrige applications and the results of their evaluations. Statistical analysis of these data could yield insight into whether the approach-deployment advocated by the Baldrige model actually produces excellent results. Although NIST does not currently allow access to the data, future empirical evaluation of the data could …

The Importance Of The Emotional Climate In Schools : Linking Teachers' Sense Of Belonging To School Community With Student Outcomes, Linda Rogerson Jan 2004

The Importance Of The Emotional Climate In Schools : Linking Teachers' Sense Of Belonging To School Community With Student Outcomes, Linda Rogerson

Theses : Honours

The way that children feel about school is important to their continued engagement with education. This review examines the issues that impact on the school environment and therefore influence students' school experience. A decline in educational standards in America prompted school reform research which has identified that the emotional climate in schools was impacting on students in that they felt alienated and disenfranchised from the school community. The emotional climate of a school stems from the nature of the relationship that exists between the students and staff of the school. A movement to establish caring community schools that promote the …

The Effects Of Neo-Liberalism: A Proposal To Measure Women's Feeling Of Safety And Job Satisfaction In Two Garment Factories, Briana Henscheid

Honors Program Theses

Neo-liberal policies have facilitated increased globalization. ln tum, environmental, as well as occupational concerns have increased. The following is an overview of principle neo-liberal ideologies as well as their contribution to globalization. The detrimental effects of globalization on the environment as well as occupational health and safety are examined. To narrow the scope, a proposal is set forth which would examine specifically the attitudes of women workers in two garment factories, one with production in the United States, the other with production in Mexico. Although no research is conducted, the format is clear and preliminary conclusions are drawn.
