The vital questions in child custody disputes all concern that which is in the best interest of the child. Historically, interpretations of the “best interest” standard have been founded upon presumptions steeped in the notion of natural rights and duties based largely upon a mix of scientific and subjective conclusions regarding gender-based parenting roles and the need to sustain them. My research demonstrates that, as courts attempt to avoid the decisions of the past and submit to the societal will of the present, the modern application of the “best interest of the child” standard has led unexpectedly to an abandonment …

Systemic acquired resistance (SAR) is induced following inoculation of Peronospora tabacina sporangia into the stems of Nicotiana tabacum plants highly susceptible to the pathogen. Previous results have shown that accumulation of acidic P-1,3-glucanases (PR-2's) following induction of SAR by P. tabacina may contribute to resistance to P. tabacina. We showed that up-regulation of the PR-2 gene, PR-2d, following stem inoculation with P. tabacina, is associated with SAR. Studies using plants transformed with GUS constructs containing the full length promoter from PR-2d or promoter deletions, provided evidence that a previously characterized regulatory element that is involved in response to …

The Supreme Court’s decision in Blakely v. Washington has generated impassioned judicial and academic criticisms, perhaps because the “earthquake” ruling seems to announce a destructive rule in search of a sound principle. Read broadly, the jury trial rule articulated in Blakely might be thought to cast constitutional doubt on any and all judicial fact-finding at sentencing. Yet judicial fact-finding at sentencing has a long history, and such fact-finding has been an integral component of modern sentencing reforms and seems critical to the operation of guideline sentencing. The Impact Of Different Types Of Expert Scientific Testimony On Mock Jurors’ Liability Verdicts, Brian H. Bornstein

Participants in two experiments acted as jurors for a personal-injury case containing different types of expert testimony. In both experiments, the defendant was more likely to obtain a verdict in his favor when his expert presented anecdotal case histories than when the expert presented experimental data. Participants’ liability judgments were correlated with their perceptions of the experts’ credibility (experiments 1 and 2) and were moderated somewhat by their need for cognition and preference for numerical information (experiment 2). The results are discussed in terms of reasoning heuristics such as the base-rate fallacy.

The Social Competence Of Homeschooled And Conventionally-Schooled Adolescents: A Preliminary Investigation, Denise Lopez Haugen

Homeschooling is a controversial educational option that has grown dramatically during the past two decades. Socialization concerns contribute strongly to this controversy. Research in this area is sparse, but it indicates that homeschooled students do well academically and socially. Many homeschooling studies suffer, however, from serious methodological issues. This investigation sought to discover whether differences in social competence existed between sample populations of homeschooled and conventionally-schooled students; research in the arena of competence and resilience served to guide the methodology. Where differences were found, specifics were elucidated and factors contributing to these differences were isolated.

The present invention provides a Populus 4-coumarate Co-enzyme A ligase gene promoter that directs expression in the xylem of plants. The promoter is used in methods designed to alter lignin content, lignin structure, cellulose content and combinations thereof. The methods comprise operably linking said promoter to heterologous nucleic acid molecules.

The participants for the study were 12 students enrolled in the course, Teaching Strategies in Elementary Education at Hunt University during the fall semester of 2000. Recent developments in commercial satellite products have resulted in a broader range of high quality image data, enabling detailed analysis. Transportation features have historically been difficult to accurately identify and structure into coherent networks; prior analyses have demonstrated problems in locating smaller features. One problem is that roadways in urban environments are often partly obscured by proximity to land cover or impervious objects. Ongoing research has focused on object-based methods for classification and different segmentation techniques key to this approach. In intermittent streams, hydrological variation is probably the single-most important factor affecting fish assemblage structure. While the response of aquatic assemblages to seasonal or annual variation in hydrology is well-known, less attention has been devoted to how assemblages respond to natural, intraseasonal drought. To explore this question, I conducted summer surveys of fish and aquatic insect assemblages occupying pool refugia in first to third order, intermittent streams in the Saline river drainage in the Ouachita highlands (central Arkansas, U.S.A.)(2001?2003). We report precise Doppler measurements of GJ 436 (M2.5 V) obtained at Keck Observatory. The velocities reveal a planetary companion with orbital period of 2.644 days, eccentricity of 0.12 (consistent with zero), and velocity semiamplitude of K = 18.1 m s-1. The minimum mass (M sin i) for the planet is 0.067MJup = 1.2MNep = 21MEarth, making it the lowest mass exoplanet yet found around a main-sequence star and the first candidate in the Neptune-mass domain. GJ 436 (mass = 0.41 M☉) is only the second M dwarf found to harbor a planet, joining the two-planet system around GJ 876. …

Recent corporate scandals in the U.S. - at Enron, WorldCom, Arthur Andersen, and elsewhere - have prompted renewed interest in business ethics. Consistent with the vast majority of organizational leadership literature, however, this new interest in ethics is overwhelmingly focused on the internal practices of corporations. In both the modern organizational leadership literature and recent literature regarding corporate ethics, very little attention has been given to examining leadership from the perspective of the ultimate societal (external) impact of either an organization's products/services or the processes by which they are produced.
