The Alien Tort Claims Act: A Tool For Repairing Ethically Challenged U.S. Corporations, Sonia Jimenez Jan 2004

The Alien Tort Claims Act: A Tool For Repairing Ethically Challenged U.S. Corporations, Sonia Jimenez

St. Thomas Law Review

Any good business person knows the best way to increase profit is to reduce overhead without compromising the quality of the product. With this in mind, many U.S. corporations have established business operations abroad, particularly in lesser developed countries. While lesser developed countries may not be attractive to tourists, they are attractive to industries and corporations for a number of reasons. Leaders of lesser developed countries can offer such corporations inexpensive materials, untapped natural resources, a cheap, yet highly productive, labor force, and there is virtually no regulation of business practices. Oftentimes, the leaders of such regions are just as …

Defining The Church's Advocacy Role To The Modern Prison System, Timothy Swope Jan 2004

Defining The Church's Advocacy Role To The Modern Prison System, Timothy Swope

Electronic Theses and Dissertations

This dissertation, "Defining the Church's Advocacy Role to the Modern Prison System," is developed from the Catholic Church's social thought over the past century and the episcopal teaching of the American bishops over the past three decades. Chapter one reviews the concept of 'advocate' and the Church's advocacy role to the poor, oppressed, and marginalized. Chapter two reviews the episcopal statements concerning the advocacy role to the prisons and the question of the death penalty in general.

Before defining the specific role of the Church to the prison system, this role of advocacy must deal with the question of Church …

Housing Gideon: The Right To Counsel In Eviction Cases , Rachel Kleinman Jan 2004

Housing Gideon: The Right To Counsel In Eviction Cases , Rachel Kleinman

Fordham Urban Law Journal

While the legal system recognizes an indigent’s constitutional right to counsel in a criminal trial the same is not true with respect to civil cases. This Comment examines this legal reality by focusing specifically on an indigent’s inability to gain access to counsel within the confines of eviction proceedings. The author lays out the arguments for both those who favor recognizing an indigent’s right to counsel in eviction proceedings and those opposed to recognizing that right. Ultimately, absent an indigent’s access to counsel in these civil cases, their ability to have any sort of meaningful access to justice is seriously …

Conference Report: New York City's Criminal Courts Are We Achieving Justice?, Martha Rayner Jan 2004

Conference Report: New York City's Criminal Courts Are We Achieving Justice?, Martha Rayner

Fordham Urban Law Journal

On October 18, 2003, more than one hundred professionals from the five boroughs of New York City came together to identify, evaluate, and begin to solve some of the complex problems embedded in the culture, operations, and practice in New York City's Criminal Courts. The conference planners focused on five problems that have undermined the pursuit of justice in New York City’s Criminal Court system for decades. The first group, Arraignment Norms, Practices and Culture, targeted professionalism and justice at the first and often last court appearance for people arrested and charged with misdemeanor crimes in New York City. The …

Public Access To Juvenile Dependency Proceedings In Washington State: An Important Piece Of The Permanency Puzzle, Sara Vanmeter Jan 2004

Public Access To Juvenile Dependency Proceedings In Washington State: An Important Piece Of The Permanency Puzzle, Sara Vanmeter

Seattle University Law Review

This Comment argues that the Washington State legislature took an important step along the road to permanency for abused and neglected children in the state's care when it revised its Juvenile Court Act in 2003. This Act created the presumption that dependency proceedings are open to the public unless a judge determines that excluding the public is in the best interest of the child. This change in Washington state law represents one piece of the puzzle of reforms necessary to reach permanency goals for children in our child welfare system. Those states whose juvenile dependency hearings remainclosed should now consider …

Scene Of The Crime: The Study And Practice Of Local Television Crime Coverage From The Mid-1990s To The Present, Debora Wenger, Jeff C. South Jan 2004

Scene Of The Crime: The Study And Practice Of Local Television Crime Coverage From The Mid-1990s To The Present, Debora Wenger, Jeff C. South

Richard T. Robertson School of Communication Presentations

This study examines the quantity and quality of crime coverage on television and its perceived impact on public policy. It discusses various stations’ attempts to address the concern that there is “too much crime on local TV newscasts.” The paper explores three techniques that can make such coverage more relevant to viewers: adoption of crime coverage guidelines, use of interactive crime Web sites and, most notably, the coverage of crime from a public health perspective.

Covering The Uninsured: What Is It Worth?, Wilhelmine Miller, Elizabeth Richardson Vigdor, Willard G. Manning Jan 2004

Covering The Uninsured: What Is It Worth?, Wilhelmine Miller, Elizabeth Richardson Vigdor, Willard G. Manning

Health Policy and Management Faculty Publications

One out of six Americans under age sixty-five lacks health insurance, a situation that imposes sizable hidden costs upon society. The poorer health and shorter lives of those without coverage account for most of these costs. Other impacts are manifested by Medicare and disability support payments, demands on the public health infrastructure, and losses of local health service capacity. We conclude that the estimated value of health forgone each year because of uninsurance ($65?$130 billion) constitutes a lower-bound estimate of economic losses resulting from the present level of uninsurance nationally.

Optimal War And Jus Ad Bellum, Eric A. Posner, Alan O. Sykes Jan 2004

Optimal War And Jus Ad Bellum, Eric A. Posner, Alan O. Sykes

Articles

The laws of war forbid states to use force against each other except in self-defense or with the authorization of the United Nations Security Council. Self-defense is usually understood to mean self-defense against an imminent threat. We model the decisions of states to use force against "rogue" states and argue that under certain conditions, it may be proper to expand the self-defense exception to preemptive self-defense. We also consider related issues such as humanitarian intervention, collective security, and the role of the Security Council.
