Can I Call Kimura Crazy?: Ethical Tensions In The Cultural Defense, Rashmi Goel

Sturm College of Law: Faculty Scholarship

Defining Cyberterrorism, 22 J. Marshall J. Computer & Info. L. 397 (2004), Mohammad Iqbal

UIC John Marshall Journal of Information Technology & Privacy Law

This article explores the definition of the term “cyberterrorism” in light of available literature and recent legislation in an attempt to distinguish cyberterrorism from other cyber activities and crimes. Cyberterrorism is the convergence of terrorism and cyberspace. The author discusses the differences between true cyberterrorism – that is, actual harm caused by cyber attacks – versus less malignant attacks that do more to annoy than harm. The author points out that the main difference between cyberterrorism and other cyber attacks, such as hacking and cracking, is that cyberterrorists are politically motivated, while other cyber attackers have non-politic motives.

"You Have The Right To Remain Silent . . . You Have No Right To Your Dna" Louisiana's Dna Detection Of Sexual And Violent Offender's Act: An Impermissible Infringement On Fourth Amendment Search And Seizure, 22 J. Marshall J. Computer & Info. L. 759 (2004), Reneé A. Germaine

UIC John Marshall Journal of Information Technology & Privacy Law

In 2003 Louisiana legislature enacted the DNA Detection Of Sexual And Violent Offenders Act requiring that any person arrested for certain offenses must submit to a DNA sample extraction to be stored with the State’s DNA databank, for the purpose to be utilized as a tool for identification in the criminal investigation and in discovering missing persons. The comment, after a brief presentation of the history of the Act and the DNA technology overview, argues that the Act infringes the Fourth Amendment protections against unreasonable search and seizure. It presents the already established standards of probable cause as well as …

Dark Days In The Ohio Valley: Three Western Kentucky Lynchings, 1884-1911, Woodrow Wilson Maglinger, Iii

Masters Theses & Specialist Projects

This thesis investigates three lynchings of African Americans in Progressive-Era western Kentucky. The first occurred in Owensboro. In July 1884, a masked mob at-tacked the Daviess County jail. Richard May, an African-American field hand, had been incarcerated for the alleged sexual assault of a local farmer’s daughter. During the lynch mob’s actions that claimed May’s life, the white county jailer was killed protecting his prisoner. Ironically, just two decades earlier Jailer William Lucas had fought for the Confederate States of America during the Civil War.

In nearby Hawesville in September 1897, Raymond Bushrod was also arrested on suspicion of raping …

Exploring The Drugs-Homicide Connection, Sean P. Varano, John D. Mccluskey, Justin W. Patchin, Timothy S. Bynum Jan 2004

Exploring The Drugs-Homicide Connection, Sean P. Varano, John D. Mccluskey, Justin W. Patchin, Timothy S. Bynum

Justice Studies Faculty Publications

Although research generally assumes a close relationship between drugs and violence, very little is known about the many different roles drugs can play in criminal events. Drug related as an event classification scheme is relatively common in homicide research, as well as other areas of inquiry, and is usually understood to be an important component in the causal processes of criminal events. Yet such classification schemes often suggest a simple, unidimensional construct. In reality, drug-related crimes are com-plex events. The purpose of this researchwas first to disaggregate the concept of drug-related homicide by providing an event classification scheme that conceptualizes …

Social Worker Or Cop? Measuring The Supervision Styles Of Probation & Parole Officers In Kentucky And Missouri, Angela D. Crews, Richard P. Seiter Jan 2004

Social Worker Or Cop? Measuring The Supervision Styles Of Probation & Parole Officers In Kentucky And Missouri, Angela D. Crews, Richard P. Seiter

Criminal Justice Faculty Research

This study surveyed probation and parole officers in Missouri and Kentucky to determine their supervision styles along a “casework to surveillance” continuum. These self-ratings were correlated with officer self-reports of how they spend their time on the job engaged in various casework or surveillance activities. Additionally, volunteering officers were interviewed to provide clarification on their perceptions regarding the distinctions between a casework approach and a surveillance approach. Results indicate that officers spend more of their time engaged in casework activities, but perceive themselves as more surveillance oriented. Style varied significantly by sex of officer, with female officers spending significantly more …

Characteristics Of Aboriginal Injecting Drug Users In Sydney, Australia: Prison History, Hepatitis C Status And Drug Treatment Experiences, Carolyn Day, Joanne Ross, Kate Dolan

Aboriginal Policy Research Consortium International (APRCi)

Australian Aboriginals are overrepresented in prisons and tend to be overrepresented in studies of injecting drug users (IDU). The aim of this study was to examine differences between Aboriginal and non-Aboriginal IDUs in terms of gender, prison history and hepatitis C status and testing. Secondary analyses were conducted on data from three cross-sectional studies of IDUs. These studies employed similar methodologies, with recruitment being through needle and syringe programs, methadone clinics, snowballing and street intercepts. All studies were coordinated through the National Drug and Alcohol Research Centre. Aboriginal people were overrepresented in all studies, were more likely to have been …

Personality Measurement In The Prediction Of Positive And Negative Police Officer Performance, Brian P. Enright Jan 2004

Personality Measurement In The Prediction Of Positive And Negative Police Officer Performance, Brian P. Enright

Dissertations

Police officer selection research has revealed a number of relationships between scores on psychological tests and performance on the job. Although a few of these predictor scales have been consistently linked with job performance, many still require further investigation. It was proposed that the personality scales most consistently linked to job performance concern two broad constructs including: (1) prosocial personality characteristics, and (2) level of psychological distress. Guided by findings from the police outcomes literature and research regarding the factor structure and intercorrelation of MMPI and CPI scales, it was proposed that Scales 4 and 9 from the MMPI and …

The Relationship Between Juvenile Delinquency And Family Unit Structure, Angela D. Mullens

Theses, Dissertations and Capstones

The purpose of this study was to investigate the relationship between parental absence and juvenile delinquency and to determine if a link exists between the two variables. Data was collected from male juveniles who were alleged to have committed status or delinquent offenses between 1996 and 2004. Each offense was categorized according to the family unit (e.g., intact, father only, mother only, etc.), offense type (e.g., underage consumption, petit larceny, breaking and entering, etc.), offense level (e.g., status misdemeanor, and felony), the victim (e.g., crimes against the person, crimes against property, etc.) and the juvenile’s age at the time the …

2004 Trafficking In Persons Report, U.S. Department Of State Jan 2004

2004 Trafficking In Persons Report, U.S. Department Of State

Human Trafficking: Data and Documents

The State Department is required by law to submit a report each year to the Congress on foreign government efforts to eliminate severe forms of trafficking in persons. This June 2004 report is the fourth annual TIP Report. Although country actions to end human trafficking are its focus, the report also tells the painful stories of the victims of human trafficking—21st century slaves. This report uses the term “trafficking in persons” which is used in U.S. law and around the world, and that term encompasses slave-trading and modern-day slavery in all its forms.

No. 14: Policing Migration: Immigration Enforcement And Human Rights In South Africa, Jonathan Crush, Vincent Williams Jan 2004

No. 14: Policing Migration: Immigration Enforcement And Human Rights In South Africa, Jonathan Crush, Vincent Williams

Southern African Migration Programme

This paper examines reported incidents of human rights abuses and violence directed towards foreigners where government employees have been the perpetrators. We discuss both direct human rights abuses and incidents of violence (with examples drawn from policing exercises such as “Operation Crackdown” and from the detention of undocumented migrants) and institutional violence (such as migration policy development and other executive actions promoting or at least failing to prevent victimisation of foreigners). In many of the reported incidents, law enforcement officials have been the direct perpetrators of the human rights violations.

The South African government is legally responsible for ensuring adherence …
