The Interaction Between Victim Race And Gender On Capital Sentencing Outcomes: An Exploration Of Previous Research, Amy Reckdenwald

USF Tampa Graduate Theses and Dissertations

This study is an exploration and extension of previous research on the interactive effects of victim-race and victim-gender on death sentence outcomes. Williams and Holcomb's (2004) study suggests that an interactive effect exists between victim-race and victim-gender on Ohio death sentencing outcomes, such that killers of White women are especially singled out for capital punishment. The current study analyzes a sample of death eligible cases at the trial level in North Carolina to determine if Williams & Holcomb's findings hold up for a different sample of cases and in a different state. Logistic regression is used to determine if there …

Corporations, Society And The State: A Defense Of The Corporate Tax, Reuven S. Avi-Yonah Mar 2004

Corporations, Society And The State: A Defense Of The Corporate Tax, Reuven S. Avi-Yonah

Law & Economics Working Papers Archive: 2003-2009

This article attempts to provide the first comprehensive rationale for defending the current corporate income tax. It argues that the usual reasons given for the tax (primarily as an indirect way of taxing shareholders, or alternatively as a form of benefit tax) are inadequate. It then explains what the original rationale to adopt this tax was in 1909, namely to regulate managerial power, and that this rationale stems from the real view of the corporation, which was the dominant view throughout the many transformations underwent by the corporate form from Roman times to the present. Turning to normative argument, the …

From Individual Rights To Societal Health: Before, During, And After The Michigan Cases, Nancy Cantor Mar 2004

From Individual Rights To Societal Health: Before, During, And After The Michigan Cases, Nancy Cantor

Chancellor's Collection

We are reminded of just how large the gap is between the principles and dreams set forth 50 years ago in Brown v. Board and the practices of daily life in this country today; practices that block access to opportunity at every turn. We learn of race disparities in health care, employment, and criminal justice sentencing, painting a stark portrait of life in this country if you are not white.2 We hear from the latest surveys of the Harvard Civil Rights Project that our schools are substantially segregated and differentially resourced by race, and that residential segregation is apparent all …

A Cost Benefit Analysis Of The State Of Tennessee's Child Support Guidelines : How Can The Orders Be Better Encouraged And Enforced?, Jennifer B. Vanzant

Honors Theses

Due to a growing number of The State of Tennessee's parents who should be receiving child support instead receiving welfare, the State is reexamining the makeup of the guidelines. Tennessee's existing child support regulations are written in a language that most individuals can interpret, but issues of compensation for additional dependents, low and very low income families, and shared parenting are three key circumstances producing inequalities that need to be improved within the guidelines. Judicial review has already made several advances in the way child support is awarded. New law has recently developed from child support case decisions regarding moneys …

Time Travel, Hovercrafts, And The Fourth Amendment: If James Madison Could Have Seen The Future, George C. Thomas Mar 2004

Time Travel, Hovercrafts, And The Fourth Amendment: If James Madison Could Have Seen The Future, George C. Thomas

ExpressO

Recent historical work has raised the intriguing possibility that the Framers meant to accomplish only one goal in the Fourth Amendment: to forbid general warrants. On this historical account, the first clause stating a right of the people to be "free from unreasonable searches and seizures" is merely declaratory of the principle that led the Framers to ban general warrants. Rephrased to be true to this history, the Fourth Amendment would say: "The right of the people to be secure in their persons, houses, papers, and effects against general warrants shall not be violated, and no general warrants shall issue." …
