Commons Ignorance: The Failure Of Environmental Law To Produce Needed Information On Health And The Environment, Wendy E. Wagner
Duke Law Journal
One of the most significant problems facing environmental law is the dearth of scientific information available to assess the impact of industrial activities on public health and the environment. After documenting the significant gaps in existing information, this Article argues that existing laws both exacerbate and perpetuate this problem. By failing to require actors to assess the potential harm from their activities, and by penalizing them with additional regulation when they do, existing laws fail to counteract actors' natural inclination to remain silent about the harms that they might be causing. Both theory and practice confirm that when the stakes …

The New Japanese Law Schools: Putting The Professional Into Legal Education, James Maxeiner, Keiichi Yamanaka
All Faculty Scholarship
In April 2004, more than sixty law schools began operation in Japan. Legal education, previously treated as a combination of undergraduate education in law and extra-university training in professional skills, will now be concentrated in new professional law schools. The reforms of Japanese legal education are intended both to produce more attorneys in a nation that has a shortage of legally trained professionals, and to help increase the role of law in Japanese society generally.
In order for Japan's new Jaw schools to achieve their educational objectives, they must successfully address a host of conceptual, pedagogical and organizational challenges. Foremost …

Felony Jury Sentencing In Practice: A Three-State Study, Nancy J. King, Rosevelt L. Noble
Felony Jury Sentencing In Practice: A Three-State Study, Nancy J. King, Rosevelt L. Noble
Vanderbilt Law Review
The Court's recent decision in Apprendi v. New Jersey, 530 U.S. 466 (2000), has prompted renewed interest in sentencing by jury in non-capital cases. Yet jury sentencing in felony cases remains one of the least understood procedures in contemporary American criminal justice. This Article looks beyond idealized visions of jury sentencing to examine for the first time how felony jury sentencing actually operates in three different states-Kentucky, Virginia, and Arkansas. Dozens of interviews with prosecutors, defenders, and judges, as well as an analysis of state sentencing data, reveal that this neglected corner of state criminal justice provides a unique window …
Federalism And Drug Control, Michael M. O'Hear
Federalism And Drug Control, Michael M. O'Hear
Vanderbilt Law Review
Federalism issues have been neglected in the scholarship on drug control policy. This Article addresses both empirical and normative questions relating to federal-state-local relations in the "war on drugs." Contrary to common views of federal domination and national uniformity, drug control policy actually varies considerably from state to state. State diversity has increased since the mid- 1990s, when drug reformers began to use the ballot initiative to change state laws. While the federal government has contested these reforms, it has not sought to use its preemption powers to enforce federal preferences.
The Article employs public choice models to explain the …

Cost/Benefit Analysis Of The Douglas County Drug Court, R. K. Piper, Cassia Spohn
Cost/Benefit Analysis Of The Douglas County Drug Court, R. K. Piper, Cassia Spohn
Past Publications
The primary purpose of this cost-benefit evaluation of the Douglas County Drug Court (DCDC) is to provide administrators and policy-makers with critical information for future policy and funding decisions. This study expands and refines previous DCDC cost-benefit analyses through an investigation of drug court program investment, outcome and societal-impact costs and savings.
This study employs a Transaction Cost model that examines complex, multi-agency events and costs for participants in drug court and non-drug court comparison groups. A “cost-to-taxpayer” approach is used that includes any criminal justice related costs (or avoided costs) generated by drug court or non-drug court comparison group …
