Stoning Single Nigerian Mothers For Adultery: Applying Feminist Theory To An Analysis Of Gender Discrimination In International Law, Sarah Crutcher
Stoning Single Nigerian Mothers For Adultery: Applying Feminist Theory To An Analysis Of Gender Discrimination In International Law, Sarah Crutcher
UC Law SF Journal on Gender and Justice
In 2003, an Islamic Sharia court in northern Nigeria sentenced Amina Lawal to death by stoning for having sex outside of marriage. After the man Lawal named as the father of her baby was acquitted for lack of evidence, the international community pressured Nigeria to oppose the ruling by adhering to its own constitutional provisions, and international law prohibiting torture and gender discrimination. This article explores the fundamental conflicts between international human rights law and Islamic law as implemented by Sharia courts. The author cites the UN Charter, the Universal Declaration of Human Rights, jus cogens and customary international law, …
The Admissibility Of Tape Recordings In Criminal Trials Involving Domestic Disputes: California's Proposition 8 And Title Iii Of The Federal Omnibus Crime Control And Safe Streets Act, Lee Ashely Smith
UC Law SF Journal on Gender and Justice
Domestic cases of eavesdropping and wiretapping pose a special problem for laws that were initially meant to govern police misconduct and espionage. California voters passed Proposition 8 but its passage led to many additional questions including whether the law truly champions victims' rights and whether it protects innocent defendants. Federal law, by comparison, sets a minimum standard of one-party consent for the admissibility of wiretap or eavesdropping evidence in criminal trials. This standard has been shown to permit parental wiretaps without allowing purely clandestine recording of another's activities, including spouses and domestic partners. In short, privacy rights are protected to …
Lighting The Lantern: Visions Of A Virtual All-Women's Law School, Nancy E. Shurtz
Lighting The Lantern: Visions Of A Virtual All-Women's Law School, Nancy E. Shurtz
UC Law SF Journal on Gender and Justice
"Lighting the Lantern: Visions of a Virtual All-Women's Law School" is a fictional narrative of a hypothetical all women's law school. It is written in non-traditional form in the hope that it will prompt the reader to view the law, academic institutions and societal constructs in ways more consistent with an evolving society that should embrace all differences, whether those differences are gender or racially based.
The mission of the All Women's Law School is threefold: "First, to teach specific lawyering skills and disseminate knowledge in a context designed to help students function effectively in the existing culture while working …

Part II also criticizes the reliance on command and control measures as the primary means of addressing the security issues created by businesses that engage in activities that could harm the environment, health, or safety. Recently Incarcerated Homeless Men's Opinions On Rehabilitation Programs, Heather Eleanor Mooney
Recently Incarcerated Homeless Men's Opinions On Rehabilitation Programs, Heather Eleanor Mooney
Senior Honors Theses and Projects
Homelessness and incarceration have been recognized as national social problems that affect millions every year. Currently, about one-third of homeless men have also been incarcerated. The existence the population of doubly marginalized homeless felons indicates a very serious deficit within the status quo. This study utilizes a grassroots qualitative approach to further understanding aspects of this social problem. A snowball sample was conducted in a medium sized city in a Great Lakes state homeless shelter. Research was collected through in-depth qualitative interviews with the recently incarcerated homeless men about their opinions and experiences of rehabilitation programs in prison. This study …
Women Representing Women's Interests In Congress, Carmen R. Allen
Women Representing Women's Interests In Congress, Carmen R. Allen
Masters Theses
Do congresswomen try to represent women's interests in Congress? Are congresswomen more likely than congressmen to sponsor bills dealing with women's issues? In the past, research has shown that women do seem to sponsor more legislation than men that deals directly with women. Research has also shown that women legislators feel that they are responsible for representing the interests of all women. This research looks at bill sponsorship in the U.S. House of Representatives during the 106th and 107th Congresses. The data from these two Congresses show that women do sponsor more women's issue legislation than men do. They also …
Information Control In Times Of Crisis: The Tools Of Repression (Symposium, Privacy And Surveillance), Christina E. Wells
Information Control In Times Of Crisis: The Tools Of Repression (Symposium, Privacy And Surveillance), Christina E. Wells
Faculty Publications
This article identifies several tools of information control that occur consistently throughout history. The government does not use all of these tools in every national security crisis. Nor does it always abuse them. However, the patterns that emerge suggest a certain predictability to (1) the government's actions during national security crises, and (2) the potentially negative consequences flowing from them that warrants our attention. Understanding this historical pattern of government action allows one to identify and potentially prevent future problems. This is especially important in the post-9/11 world in which the government has asked for and received controversial powers with …

Banning Books, Burning Bridges: Recognizing Student Freedom Of Expression Rights In Canadian Classrooms, Devon Peavoy
Banning Books, Burning Bridges: Recognizing Student Freedom Of Expression Rights In Canadian Classrooms, Devon Peavoy
Dalhousie Journal of Legal Studies
In Canada, books and magazines are regularly intercepted at the border and are consistently removed from libraries, schools and bookstores. The banning of books is a controversial topic that involves issues of censorship and freedom of expression rights. The Supreme Court of Canada recently examined the issue in Chamberlain v. Surrey School District No. 36, where it was found that the School Board acted unreasonably in banning several books depicting same sex couples. The Court, however, did not consider the freedom of expression rights of students in reaching their decision. Despite this recent opportunity to comment on a student’s right …

Does Prison Harden Inmates? A Discontinuity-Based Approach, Keith M. Chen, Jesse M. Shapiro
Does Prison Harden Inmates? A Discontinuity-Based Approach, Keith M. Chen, Jesse M. Shapiro
Cowles Foundation Discussion Papers
Some two million Americans are currently incarcerated, with roughly six hundred thousand to be released this year. Despite this, little is known about the effects of confinement conditions on the post-release lives of inmates. Focusing on post-release criminal activity, we identify the causal effect of prison conditions on recidivism rates by exploiting a discontinuity in the assignment of federal prisoners to security levels. We find that harsher prison conditions are associated with significantly more post-release crime.
