The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
The “marijuana cases” (R. v. Malmo-Levine; R. v. Caine) and the “spanking case” (Canadian Foundation for Children Youth and the Law v. Canada) provide contrasting circumstances for the application of J.S. Mill’s “harm principle” to the courts’ consideration of the liberty interests in section 7 of the Charter. The history of the harm principle demonstrates that it is not well suited to a diverse modern society concerned with the broad aspects of public good, social well-being and the balance of competing harms, reflected in underlying Charter values. To this point, the Supreme Court has relied, increasingly, on the harm principle …

In Defense Of The "Old" Public Health: The Legal Framework For The Regulation Of Public Health, Richard A. Epstein
In Defense Of The "Old" Public Health: The Legal Framework For The Regulation Of Public Health, Richard A. Epstein
Faculty Articles
The traditional forms of public health law were directed largely toward communicable diseases and other externalities, such as pollution, with negative health impacts. The more modern view treats any health issue as one of public health so long as it affects large numbers of individuals, and this definition includes such matters as obesity and diabetes. This paper examines the historical and constitutional evolution of the public health principle as it moved from the narrower to the broader conception. It then argues that the narrower principle better defines the appropriate scope of coercive government intervention than the broader definition, which could …

Hierarchies Of Harm In Canadian Criminal Law: The Marijuana Trilogy And The Forcible “Correction” Of Children, Janine Benedet
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
This paper examines the Supreme Court of Canada’s use of the concept of “harm” in its decisions in R. v. Malmo-Levine, which upholds the criminal prohibition on marijuana possession, and Canadian Foundation for Children, Youth and the Law v. Canada (Attorney General), which upholds the reasonable correction defense for parents and teachers charged with assaults against children in their care. The author argues that these decisions employ contradictory characterizations of the role of harm in determining the proper scope of the criminal law. Although the majority in Malmo-Levine cites protecting vulnerable groups from harm as a valid purpose of the …

Charter Remedies And Jurisdiction To Grant Them: The Evolution Of Section 24(1) And Section 52(1), Debra M. Mcallister
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
The issue addressed in this paper is whether we have effective remedies for breach of Charter protected rights and freedoms, as well as clear jurisdictional guidelines for granting such remedies. The relationship between the judiciary and the other branches of government provides the context for exploring the jurisprudence on remedies and jurisdiction. The cases that establish the foundational principles regarding the interpretation of section 24(1) and section 52(1), and the relationship between these provisions, are examined. The guidelines for granting section 52(1) remedies and for identifying the decision makers that have jurisdiction to do so are explored, as are the …
