Introduction: Examining The Roles And Possible Roles Of State Departments Of Education In Comprehensive School Reform, Edmund T. Hamann

Department of Teaching, Learning, and Teacher Education: Faculty Publications

Though I have only just realized it, this special issue of Journal of Education for Students Placed at Risk (JESPAR) did not originate at the annual meeting of the American Educational Research Association in April of 2004, where four of the five articles shared here were first presented, although that forum obviously mattered to the creation of this issue. Rather, this issue began taking shape 14 years ago, in 1990, when, as an undergraduate, I took a seminar with the founder of the Coalition of Essential Schools, Ted Sizer, and his colleague, Rick Lear. At that time, I learned …

Multidisciplinary Practice In The International Context: Realigning The Perspective On The European Union’S Regulatory Regime, George C. Nnona

Cornell International Law Journal

Multidisciplinary practice (MDP) and the controversy surrounding it have ebbed in the wake of the Enron scandal and the subsequent enactment of the Sarbanes-Oxley Act. However, legal professionals continue to debate the viability of MDP and rules that currently prohibit lawyer fee-sharing arrangements and partnerships with non-lawyers-some of the rules that aim to safeguard lawyer independence from external influences. This Article addresses one of the most common arguments supporting MDP, namely, that the pervasive propagation of MDP in Europe will inevitably exert an overwhelming influence and pressure to conform on regulators of the legal profession in the United States. The …

Standards Of Proof In Japan And The United States, Kevin M. Clermont Jan 2004

Standards Of Proof In Japan And The United States, Kevin M. Clermont

Cornell International Law Journal

This article treats the striking divergence between Japanese and U.S. civil cases as to standards of proof. The civil law of Japan requires that facts be proven to a high probability similar to beyond a reasonable doubt, while the common law of the United States requires that the burdened party satisfy merely a more-likely-than-not standard. This divergence not only entails great practical consequences, but also suggests a basic difference in attitudes toward the process of trial. As to the historical causation of the difference in standards of proof, civil law and common law standards diverged in the late eighteenth century, …

The Virgin Mother In The Sermons Of Fra Girolamo Savonarola, Frank Leo Jr. Jan 2004

The Virgin Mother In The Sermons Of Fra Girolamo Savonarola, Frank Leo Jr.

Graduate Theses and Dissertations

This doctoral dissertation gives a comprehensive, organic and profound systematization to all that he preached to the people of his time regarding the Virgin Mother of God. No complete, organic study of Savonarolan Marian theology has been done except for the Licentiate thesis that was based mainly on the writings or treatises of the friar. This present study will examine and relate Savonarola's thoughts on the Virgin Mary as they come forth from his sermons. These sermons were based on an array of biblical books, especially Old Testament prophets, and include a rich diversity of subject matter relative to this …

Reparations Decisions And Dilemmas, Naomi Roht-Arriaza Jan 2004

Reparations Decisions And Dilemmas, Naomi Roht-Arriaza

UC Law SF International Law Review

The International Bill of Rights declares a right to a remedy for violations of human rights. States are obliged to provide remedies for violations, both as a matter of treaty law and as part of the general rules of state responsibility. The U.N. Human Rights Commission and its Subcommission have formulated draft Basic Principles and Guidelines on the Right to a Remedy and Reparation for Victims of Violations of International Human Rights and Humanitarian Law (Principles), which outline restitution, rehabilitation, compensation and satisfaction as interlinked but distinct obligations on states. In addition, the statute of the newlycreated International Criminal Court …

Legalistic Individualism: An Alternative Analysis Of Kagan's Adversarial Legalism, Michael Dominic Meuti Jan 2004

Legalistic Individualism: An Alternative Analysis Of Kagan's Adversarial Legalism, Michael Dominic Meuti

UC Law SF International Law Review

An underlying ethos of American law is that an adversarial setting is a prerequisite for proper resolution of a dispute. But is that accurate? Comparative scholars have illustrated the diversity of methods available. In Adversarial Legalism, Robert Kagan considers the merits of these alternative systems. Although the book is not intended as a comprehensive agenda for reform, Kagan's message is clear: our procedures and methods for resolving disputes are a matter of choice, no matter how natural or entrenched they may appear to be. To the extent they do not serve us well, we should exercise our ability to make …

Legal War: When Does It Exist, And When Does It End, John Alan Cohan Jan 2004

Legal War: When Does It Exist, And When Does It End, John Alan Cohan

UC Law SF International Law Review

The popular conception of war is clearly different from war in the legal sense. It is important to ascertain when war in the formal, legal sense (Legal War) exists because various legal consequences attach. However, when a Legal War exists between belligerent states is far from certain. Few wars are waged pursuant to a formal declaration, and there is substantial disagreement as to when a Legal War has ended. Further complicating the problem, governments have engaged in significant armed conflicts while vigorously denying a state of war has existed between them, notwithstanding the obvious state of belligerency, the engagement of …

Bargaining In Two Languages: Conversational Functions Of Transactional Code-Switching, Lotfi Sayahi Jan 2004

Bargaining In Two Languages: Conversational Functions Of Transactional Code-Switching, Lotfi Sayahi

Languages, Literatures and Cultures Faculty Scholarship

Studies on the pragmatic functions of code-switching, in opposition to its macro sociolinguistic significance or syntactic structure, have been largely influenced by Gumperz's pioneering classification presented in the chapter he dedicated to this topic in his 1982 book, Discourse strategies. Many other taxonomies followed Gumperz's initial proposal (Appel and Muysken 1987, Poplack 1988, Romaine 1989, Heller 1992) in spite of the usually claimed difficulty in interpreting and predicting the exact functions of code-switching in any given bilingual context. Their purpose has been to identify the sociopragmatic motivation for the occurrence of a particular code-switched utterance and ultimately classify it under …
