This report examines the provision of a variety of government services within Kentucky. The provision of these public services, specifically the cost of providing these services is examined for the years 1992, 1997, and 2002. In addition, employment and salaries in government services are also examined. In addition to comparing costs within Kentucky during this period, the costs of providing public services are also compared to costs of the same government services by its neighboring states (Illinois, Indiana, Missouri, Ohio, Tennessee, Virginia, and West Virginia).

Retrospective On The Postwar Productivity Slowdown, William D. Nordhaus

Cowles Foundation Discussion Papers

The present study reviews the “productivity slowdown” of the 1970s and 1980s. The study also develops a new data set — industrial data available back to 1948 — as well as a new set of tools for decomposing changes in productivity growth. The major result of this study is that the productivity slowdown of the 1970s has survived three decades of scrutiny, conceptual refinements, and data revisions. The slowdown was primarily centered in those sectors that were most energy-intensive, were hardest hit by the energy shocks of the 1970s, and therefore had large output declines. One doubts that Robert Carter, Thurgood Marshall, Spottswood Robinson, Jack Greenberg and the rest of the legal team that argued Brown v. Board of Education spent much time thinking about mass torts. Nonetheless, it is entirely appropriate that a commemoration of their achievements include not only that topic but also international human rights and health care, as well as the more expected ones of education and social welfare. Brown was part of a revolution, and revolutions often have collateral effects as important as their immediate consequences. The civil rights movement followed the same pattern.

Defamation Law And Free Speech: Reynolds V. Times Newspapers And The English Media, Andrew T. Kenyon, David F. Partlett, Clive P. Walker, Russell L. Weaver

Vanderbilt Journal of Transnational Law

The common law of defamation cut the balance between speech and reputation decisively in favor of reputation and allowed for the imposition of significant damages against media outlets that defamed. For the last four decades, U.S. media outlets have been insulated against the common law rules by the United States Supreme Court's landmark decision in New York Times Co. v. Sullivan. Following Sullivan, Commonwealth countries clung steadfastly to common law rules and are only now beginning to modify the common law rules to provide speech and media protections. This Article explores the English approach to punitive damages. It begins with a brief history of punitive damages in England and a look at where punitive damages are going in the country. Then, the author discusses the criteria for an award and the possibility of punitive damages for break of contract. Other aspects of punitive damages in England explored in the Article include public defendants, liability, judge and jury and the size of punitive awards.

With All Deliberate Speed: Civil Human Rights Litigation As A Tool For Social Change, Beth Van Schaack

It has been said that Fildrtiga v. Peha-Irala is the Brown v. Board of Education of human rights litigation. Like Brown, Fildrtiga presents one of those rare "breakthrough moments" in law. In Fildrtiga, the Second Circuit confirmed that victims of human rights abuses abroad could seek legal redress in United States courts under the then-obscure Alien Tort Claims Act (ATCA). Fildrtiga thus inaugurated a steady line of cases in U.S. courts invoking the ATCA and related statutes to adjudicate international human rights claims. States around the country have begun to adopt programs to divert drug offenders from jails and prisons to community-based drug treatment services. For this strategy to succeed, local officials will need to expand the availability of outpatient and residential treatment programs and address the barriers to siting treatment services, the most significant of which are community opposition and government zoning policies that facilitate community resistance. Civil rights laws, including the Americans With Disabilities Act (ADA) and the Fair Housing Act (FHA), prohibit zoning discrimination against persons with histories of alcoholism and drug dependence and provide a solid legal foundation for …

Between May of 2002 and December of 2003, the New Hampshire Estuaries Project provided the Society for the Protection of New Hampshire Forest/Center for Land Conservation Assistance with $64,400 for matching grants to distribute to assist with transaction costs associated with permanent land conservation projects in the New Hampshire estuaries area. Application materials were created and distributed, applications were received and reviewed and grants were made. The project was well received and very successful. Twenty-three grants were made to support transaction costs associated with projects that provided permanent protection for 1158 acres in 9 estuaries area communities. Grant funds of …

Economic Impact Of Sheep Predation In The United States, Keithly Jones

Sheep and Goat Research Journal

Though accounting for less than 1 percent of U.S. livestock industry receipts, sheep and goat operations are still important to the economies of several states in the Southern Plains, Mountain States and Pacific regions. Revenues from sales of lambs and culled ewes amount to more than three-fourths of the total receipts in the sheep industry. However, nearly 4 percent of the animals in the sheep industry are lost each year. Most of this loss is from predation. Predators include coyotes, domestic dogs, big cats, foxes and bears, and eagles. Predator losses are concentrated in the Southern Plains, Pacific States and …
