The study presents a comparison of the legislation, regulation and economic effectiveness. It indicates that there is a very high level of regulation and a large number of restrictions, which …

Defining Dicta, Michael Abramowicz, Maxwell Stearns Oct 2004

Defining Dicta, Michael Abramowicz, Maxwell Stearns

ExpressO

The doctrine of stare decisis applies only to holdings of past cases, but scholars and courts have paid far more attention to stare decisis doctrine than to the distinction between holding and dicta, particularly in recent years. The lack of attention that the distinction receives may reflect a sense among legal analysts that they know dicta when they see it, but the problem is considerably more analytically complex than it may at first appear. In this Article, Professors Abramowicz and Stearns identify a number of structural problems that may affect whether statements in judicial opinions should be classified as holding …

Law Student Field Projects In Community Law, Fran Ansley

College of Law Faculty Scholarship

This website is an exhibition of student work. It features selected projects in which my law students at the University of Tennessee have collaborated with people in under-represented communities. Many projects have centered on research and innovative education for lay people about some aspect of law or the legal system. In other projects, law students have helped to frame and make justice claims - sometimes focused on relief for individuals, more often seeking a change in social policy.

Reflections Of A Recoving Lawyer: How Becoming A Cognitive Psychologist —And (In Particular) Studying Analogical And Causal Reasoning—Changed My Views About The Field Of Psychology And Law, Barbara A. Spellman

Chicago-Kent Law Review

known as Law and Psychology), a small number of topics have stimulated the overwhelming majority of research. However, the topics available for psychology and law inquiry are infinite—limited only by the experience and imaginations of the re- searchers. I describe several areas of basic research in cognitive and social psychology that I, my colleagues, and my students, have been involved in during the past dozen years and demonstrate how they can be applied to the law. The major areas include: analogical reasoning—relevant to legal training and the use of precedent in judicial reasoning and legal scholarship; and causal and counterfactual …

Taking The Punishment Out Of The Process: From Substantive Criminal Justice Through Procedural Justice To Restorative Justice, Brenda Sims Blackwell, Clark D. Cunningham Oct 2004

Taking The Punishment Out Of The Process: From Substantive Criminal Justice Through Procedural Justice To Restorative Justice, Brenda Sims Blackwell, Clark D. Cunningham

Law and Contemporary Problems

If the punishment is taken out of the process, and the processes of criminal justice become effective at restoration--and if rigorous empirical research might show that a restorative process costs less money and produces greater public safety--that would be a result everyone would embrace.
