A Public Policy Toward The Management Of Feral Cats, Shawn Gorman, Julie Levy Jun 2004

A Public Policy Toward The Management Of Feral Cats, Shawn Gorman, Julie Levy

The University of New Hampshire Law Review

[Excerpt] “This paper examines the current wildlife laws, both federal and state, to determine what laws may apply to managing the feral cat population. It begins with a determination of how domestic cats are classified under these laws. Since many laws are vague, the intent of the legislatures is investigated to determine if domestic cats were meant to be defined as a nonindigenous species. The focus then shifts to indicate ways to control the feral domestic cat population. Current trends in the control of other nonindigenous species appear to revolve around public nuisance claims; however, due to the unique nature …

Mining In Irian Jaya: How Citizens Should Think About Environmental Justice, Jeremy Bendik-Keymer Jun 2004

Mining In Irian Jaya: How Citizens Should Think About Environmental Justice, Jeremy Bendik-Keymer

Faculty Scholarship

"All around me are the facts of my life. But I can't see them, because the way I think gets in the way." I am making a case for environmental justice. We'll explore how questioning our lives and actions helps us grasp environmental justice. I believe environmental justice calls many of us to conceive of our lives in new ways so that we can become true ecological citizens. First, relations between humans and lands need to be articulated, and we need to think of our lives in spatially, temporally and ecologically extended ways. This paper is intended initially as an …

The Duty To Support An Aged Parent In Singapore, Wing-Cheong Chan Jun 2004

The Duty To Support An Aged Parent In Singapore, Wing-Cheong Chan

Washington International Law Journal

When the legislation to impose a financial obligation on adult children to provide for their aged parents was introduced in Singapore in 1994, it generated heated public debate which polarized the population. Several criticisms of this proposal emerged: it subsumed the Asian value of filial piety in a legalistic, Western framework; it was unnecessary given the small number of parents being neglected by their children; and it was an undesirable intrusion into family life. Nonetheless, the proposal managed to gain enough Parliamentary support to be referred to a Select Committee. Several adjustments to the proposed legislation were made to take …

Gay Marriage: Analyzing Legal Strategies For Reform In Hong Kong And The United States, Robin A. Warren Jun 2004

Gay Marriage: Analyzing Legal Strategies For Reform In Hong Kong And The United States, Robin A. Warren

Washington International Law Journal

Like many countries, both the United States and Hong Kong face the question of whether to legalize gay marriage due to social, legal, and political forces within and beyond their borders. The legalization of same-sex marriage in one jurisdiction forces other jurisdictions to decide whether to recognize marriages celebrated there. Comparing the current state of U.S. and Hong Kong law reveals that only a direct challenge to discriminatory marriage laws will successfully effect change. Two U.S. state supreme court decisions provide examples of effective legal arguments in a direct challenge. Conflict of laws analysis for marriage and the public policy …

Cambodia's Wto Accession: A Strenuous But Necessary Step For A Poor Nation Seeking Economic Prosperity, Rebecca Povarchuk Jun 2004

Cambodia's Wto Accession: A Strenuous But Necessary Step For A Poor Nation Seeking Economic Prosperity, Rebecca Povarchuk

Washington International Law Journal

During the 2003 World Trade Organization ("WTO") Ministerial Conference, Cambodia became the first least-developed nation to accede to the WTO through the organization's full working party accession process. Due to domestic, political, and economic pressures to accede, Cambodia agreed to an arduous package of legal and economic reform that have left many, including Cambodian officials, wondering whether the small country is capable of meeting its obligations. Having plunged into the WTO with the belief that accession is its best hope for a prosperous future, Cambodia now faces the challenges of implementation. In arguing against WTO membership for Cambodia, critics condemn …

No More Waiting For Revolution: Japan Should Take Positive Action To Implement The Convention On The Elimination Of All Forms Of Discrimination Against Women, M. Christina Luera Jun 2004

No More Waiting For Revolution: Japan Should Take Positive Action To Implement The Convention On The Elimination Of All Forms Of Discrimination Against Women, M. Christina Luera

Washington International Law Journal

In 1985, Japan ratified the United Nations Convention on the Elimination of All Forms of Discrimination Against Women ("CEDAW"), which requires the eradication of all legal, political, social and cultural structures that prevent women from enjoying full equality with men. Under CEDAW, Japan is legally obligated to strive for actual, not just formal, equality between men and women. CEDAW also requires States Parties to take positive action to achieve gender equality. Despite the Japanese government's apparent efforts to comply with CEDAW over the last two decades, gender equality remains a distant reality. On July 8, 2003, the Committee on the …

The Australian National Representative System Of Marine Protected Areas And The Marine Zoning System: A Model For The United States?, Jennifer L. Schorr Jun 2004

The Australian National Representative System Of Marine Protected Areas And The Marine Zoning System: A Model For The United States?, Jennifer L. Schorr

Washington International Law Journal

Marine Protected Areas ("MPAs") are increasingly recognized as a critical component of marine conservation. MPAs are areas of the marine ecosystem set aside for special protection and management in order to conserve biological or cultural resources. MPAs manage the use of marine resources by limiting or controlling activities within the area. Marine reserves, the most restrictive type of MPA, severely limit or forbid all extractive activities. Scientific research has demonstrated that MPAs, especially marine reserves, can have rapid and long-term benefits for biological diversity, lead to recovery of specific species, and may have a "spill over" effect that benefits adjacent …

Gödel, Kaplow, Shavell: Consistency And Completeness In Social Decision-Making, Giuseppe Dari Mattiacci Jun 2004

Gödel, Kaplow, Shavell: Consistency And Completeness In Social Decision-Making, Giuseppe Dari Mattiacci

Chicago-Kent Law Review

The recent debate on what criteria ought to guide social decision-making has focused on consistency: it has been argued that criteria contradicting one another—namely, welfare and fairness—should not be simultaneously employed in order for policy assessment to be consistent. This Article raises the related problem of completeness—that is, the question of whether or not a set of consistent criteria is capable of providing answers to all social decision problems. If not, as it is suggested might be the case, then the only way to decide otherwise undecidable issues is to simultaneously employ both welfare and fairness, which implies a certain …

The Transformation Of The Professional Workforce, Marion Crain Jun 2004

The Transformation Of The Professional Workforce, Marion Crain

Chicago-Kent Law Review

For professionals, work is not a commodity to be sold on the market, but a calling that constitutes personal identity while simultaneously conferring a relatively privileged class status. Historically, the professions avoided commodification through a social bargain in which they exchanged their professional expertise and dedication to public service for autonomy, the ability to self-regulate through peer review, and monopoly power over their knowledge base. Over the last twenty-five years, market instability and technological development have fundamentally altered the conditions under which this social bargain was formed, and the professional class has been transformed from self-employed to salaried employee status. …

The Changing World Of Employee Benefits, Maria O'Brien Hylton Jun 2004

The Changing World Of Employee Benefits, Maria O'Brien Hylton

Chicago-Kent Law Review

The employee benefits picture, at least for many plan participants and some plan sponsors, is a scary and bleak one. The number of workers with pension coverage is declining, health insurance rates are rising much faster than the rate of inflation, and the number of uninsured continues to rise as well. The decline in union density, the recent boost given by the U.S. Supreme Court to Any Willing Provider ("AWP") laws, and the deluge of recent benefits-related scandals are also all part of this landscape. This Article examines each of these issues, with a focus on reforms that would increase …

Reasonable Accommodation Under The Ada: Are Employers Required To Participate In The Interactive Process? The Courts Say "Yes" But The Law Says "No", John R. Autry Jun 2004

Reasonable Accommodation Under The Ada: Are Employers Required To Participate In The Interactive Process? The Courts Say "Yes" But The Law Says "No", John R. Autry

Chicago-Kent Law Review

The Americans with Disabilities Act ("ADA") generally requires employers to "reasonably accommodate" a "qualified" employee's disability. Unfortunately, the ADA is silent as to the appropriate method for fashioning reasonable accommodations. The Equal Employment Opportunity Commission ("EEOC") issued regulations endorsing an "interactive process" by which an employer and its "qualified" disabled employee work together to devise the proper accommodation. However, the Supreme Court has yet to determine whether courts must defer to these regulations, leaving the circuit courts of appeals to issue differing opinions on whether the EEOC's interactive process is best characterized as a requirement or merely a suggestion.

Thus, …

It describes the lawsuit filed by Enron employees in an attempt to recover some of the lost funds, as well as the probability of success for that action specifically and similar actions under ERISA in the future.

How Did Belle La Follette Resist Racial Segregation In Washington D.C., 1913-1914?, Nancy Unger

History

Beginning in 1913, progressive reformer Belle Case La Follette wrote a series of articles for the "women's page" of her family's magazine, denouncing the sudden racial segregation in several departments of the federal government. Those articles reveal progressive efforts to appeal specifically to women to combat injustice, and also demonstrate the ability of women to voice important political opinions prior to suffrage.

The Understanding And Utilization Of Occupational Therapy Services By Medical Doctors In Acute Hospital Settings, Naina Jamani Jun 2004

The Understanding And Utilization Of Occupational Therapy Services By Medical Doctors In Acute Hospital Settings, Naina Jamani

Masters Theses

The purpose of this study was to determine what medical doctors working in the Canadian healthcare system know about occupational therapy, and if this understanding of occupational therapy is deemed valuable by the rate of referrals generated by these practitioners. This study will examine the relationship between physician's knowledge level and referrals to occupational therapy. The study instrument was a survey that consisted of eight questions, seven multiple choice and one open-ended response. The study took approximately five minutes to complete. A total of forty surveys were distributed at three different acute hospital settings. A total of fourteen or thirty-five …
